DISMISSED / REJETÉE
UPON APPLICATION by the Respondent to be relieved from the requirements of Rule 33, noting that her record contains errors with respect to marginal line numbering, table of contents and headlines.
AND HAVING READ the material;
IT IS HEREBY ORDERED THAT:
I have reviewed the record as submitted and observe that it has been assembled with a serious disregard for the requirements of Rule 33(2) of the Rules of the Supreme Court of Canada. The record is not bound in the sequence required by the Court, it is not printed with the printed pages facing up on the left, the table of contents is wrong, there are no headlines, there is no marginal line numbering and there is no Certificate of Counsel. The index provided indicates that tab three contains an application to intervene. It contains an application for leave to appeal.
The reasons given for the failure to comply with the Rules are inadvertence and haste. Mr. Hoffman’s affidavit in support of the motion also makes reference to the fact that the Appellant’s motion for acceptance of her record as submitted to the Court was granted. I note that the Appellant’s record complies with the Rules except only for the absence of marginal line numbering.
The errors in the assembly of the Respondent’s record are many and the explanations for the failure to comply with the Rules are weak. For these reasons, the motion is denied. The Respondent is required to resubmit a record filed in accordance with Rule 33 as soon as possible.

Torts - Vicarious liability - Intentional torts - Sexual assault of a child in the care of an employee in residential setting - Whether the Court of Appeal erred in law in rejecting the Salmond test and replacing it with a new test for determining whether an employee’s intentional acts of sexual abuse were committed within the course of his or her employment - Whether the Court of Appeal erred in law by adopting and applying opportunity tests in deciding that the employee’s intentional acts of sexual abuse were committed within the course of his employment - Whether the Court of Appeal erred in law by finding that policy considerations did not support the adoption of a different legal test for considering whether a non-profit society was vicariously liable for the intentional acts of sexual abuse committed by its employees.

Motion for new evidence dismissed / Requête visant à produire de nouveaux éléments de preuve rejetée.
Nature of the case:
Canadian Charter of Rights and Freedoms - Indians - Statutes - Interpretation - Right to equality - Residency requirement - Whether section 77(1) of the Indian Act, R.S.C. 1985, c. I-5, contravenes section 15(1) of the Canadian Charter of Rights and Freedoms - Whether a residency requirement for voting in Band elections cannot be justified under section 1 of the Charter - If section 77(1) of the Indian Act is found to contravene the Charter, whether a constitutional exemption is an available or appropriate remedy in the circumstance of this case - Whether the Court of Appeal erred in finding a legislative provision constitutionally invalid in the absence of any evidence on a point given significance by the Court, namely that women constituted a large proportion of those reinstated to membership in the band.
(1985), ch.
