Alexander François Thomas
v. (25943)
Her Majesty The Queen (Crim.)(B.C.)
Sheldon Goldberg, for the appellant.
Gregory J. Fitch, for the respondent.
RESERVED / EN DÉLIBÉRÉ
Nature of the case:
Criminal law - Appeal - Procedure - Judgments and Orders - Whether the Court of Appeal exceeded its jurisdiction by ordering, pursuant to s. 686(8) of the Criminal Code, that the Appellant’s new trial be confined to the issue of whether the Appellant is guilty of second degree murder or manslaughter - If the Court of Appeal had jurisdiction to make such an order, whether it erred in concluding that the circumstances of this case were sufficiently exceptional to warrant making it - Whether the Court of Appeal erred in considering an affidavit filed by the Crown relating to exhibit destruction in the absence of an application to adduce fresh evidence - Whether the restricted new trial ordered by the Court of Appeal violates the Appellant’s Charter rights.

Kristian Lee Warsing (Crim.)(B.C.)
William F. Ehrcke, Q.C. and W.J. Scott Bell, for the appellant.
Manuel A. Azevedo and Albert C. Peeling, for the respondent.
RESERVED / EN DÉLIBÉRÉ
Nature of the case:
Criminal law - Trial - Defence - Evidence - Whether the Court of Appeal erred by permitting the Respondent to raise an entirely new defence on appeal which had been specifically disavowed at trial - Whether the Court of Appeal erred in admitting as fresh evidence the letter of Dr. Wanis, when the conditions for the admission of fresh evidence on appeal had not been met - Whether the Court of Appeal erred in law in ordering a new trial based on the fresh evidence adduced on appeal.

Nature of the case:
Maritime law - Shipping - Jurisdiction - Limitation of actions - prescription - Does the Ontario Court (General Division) have concurrent original jurisdiction with the Federal Court in claims for wrongful death brought pursuant to s. 646 in Part XIV of the Canada Shipping Act, R.S.C. 1985, c.S-9 - Did the Court of Appeal err when it decided that certain parts of provincial legislation applied to supplement the provisions of the Canada Shipping Act - Whether the limitation period in s.649 of the Canada Shipping Act can be extended at the discretion of a court.

Mary Elizabeth Beaton and Rita Godin, for the appellant.
Sylvia Mendes-Roux, for the intervener Child Sollicitor.
Terrence P. Lenihan, for the respondent M.L.
Peter J.C. White, for the respondent R.L.
L’HEUREUX-DUBÉ (orally for the Court):
It will not be necessary to hear from you Ms. Beaton and Ms. Godin. The Court is ready to render judgment now.
We are all of the view to allow the appeal, set aside the order of the New Brunswick Court of Appeal and restore the orders made on March 20, 1997 and May 8, 1997 of Boisvert J. Reasons to follow.

v. (25973)
Her Majesty The Queen (Crim.)(Alta.)
Ruth Reimer, for the appellant.
Arnold Schlayer, for the respondent.
CORY J. (orally for the Court):
The motion brought by the respondent’s Crown to strike out paragraphs 3 to 24 of the appellant’s factum must be granted since they do not deal with the legal issues raised in the dissent of Berger J.A. As a result there is no appeal before us arising from the issue of law raised in the dissent.
[traduction]
The appellant (respondent in the motion) now seeks leave to appeal on the matters that were raised in the factum in paragraphs 3 to 24. However, the appellant had been informed in the Order made by Justice L’Heureux-Dubé that leave would be required to present that argument and leave was not sought.
At this late stage there is nothing further that the court can do and the appeal is therefore dismissed.
