Subscriptions may be had at $200 per year, payable in advance, in accordance with the Court tariff.  During Court sessions it is usually issued weekly.

The Bulletin, being a factual report of recorded proceedings, is produced in the language of record.  Where a judgment has been rendered, requests for copies should be made to the Registrar, with a remittance of $10 for each set of reasons.  All remittances should be made payable to the Receiver General for Canada.

Administrative law - Judicial review - Human rights - Equality rights - Discrimination on the basis of physical disability - Complainant’s driver’s licence cancelled due to physical disability affecting vision - Whether the member designate of the British Columbia Council of Human Rights erred in finding that the complainant had been discriminated against and that the discrimination was unjustified - Test to be applied to persons with disabilities who have been discriminated against - Issue of accommodation.

 

At the age of 40, Terry Grismer (the “Complainant”) suffered a stroke.  As a result, he lost peripheral vision to the left in both eyes.  This was reported by his doctor to the Superintendent of Motor Vehicles, as required by statute.   The doctor indicated “[i]t is up to your department to state whether he should drive.  He appears capable to me.”  The Complainant was called in for a driving re-examination and passed both the road test and a vision screening test.  Nevertheless, his driver’s licence was cancelled by the Branch. 

 

The Complainant relied upon driving to commute  the considerable distance between his ranch and the mine at which he worked.  He also drove at the mine, as part of his job.  He appealed the cancellation of his driver’s licence, and the matter was reviewed by a medical board comprised of two doctors.  The board concluded that the Complainant did not meet the vision standard accepted by the Superintendent.  After his licence was denied, the Complainant continued to drive and operate mobile equipment at work: he was not prohibited from driving on private property.  He learned to compensate for lower periphery, make use of the mirrors and to use prism glasses.  In a nine year period, he was involved in one accident where he was found not to be at fault.

 

The Complainant persisted in his attempts to regain his driver’s licence.  In 1991 he filed a complaint under the Human Rights Act alleging that the Superintendent had refused him an accommodation, service or facility customarily available to the public, because of a physical disability, contrary to section 3 of the Act.  The member designate of the Human Rights Council found that the Respondent had discriminated against the Complainant.

 

Shortly after the decision was released, the Complainant died.  The British Columbia Superintendent of Motor Vehicles and the Attorney General of British Columbia petitioned for an order quashing  the decision, and claimed that the Complainant’s death had not rendered the question academic, given the potential effect of the decision on other cases.  The Complainant’s widow continued to represent his interests.  The Supreme Court of British Columbia held that the member designate had not erred in his  interpretation of the legislation or committed an error of law so as to exceed his jurisdiction, and therefore dismissed the petition.  The Court of Appeal for British Columbia found that the member designate had made errors of law and a patently unreasonable error of fact, and it therefore allowed the appeal and set aside the decision of the member designate.

Terry Grismer (le «plaignant») a subi un accident cérébrovasculaire à l’âge de 40 ans.  En conséquence, il a perdu la vision périphérique gauche dans les deux yeux.  Son médecin en a informé le surintendant des véhicules automobiles, comme l’exige la loi.  Le médecin a signalé [TRADUCTION] «il appartient à votre ministère de décider s’il devrait conduire.  Il me paraît capable de le faire.»  Le plaignant a été convoqué à un nouvel examen de conduite et il a réussi à la fois le test sur route et l’examen de la vue.  Son permis de conduire a quand même été révoqué par le service.

 

Le plaignant avait besoin de conduire pour effectuer le trajet important entre son ranch et la mine où il travaillait.  Il conduisait aussi à la mine, dans le cadre de son travail.  Il a interjeté appel de la révocation de son permis de conduire, et l’affaire a été examinée par un conseil médical formé de deux médecins.  Le conseil a conclu que le plaignant ne satisfaisait pas à la norme relative à la vision reconnue par le surintendant.  Après avoir perdu son permis, le plaignant a continué à conduire et à opérer de l’équipement mobile au travail: il avait le droit de conduire sur une propriété privée.  Il a appris à compenser pour une vision périphérique plus faible, à utiliser les miroirs et des verres à prismes.  Au cours d’une période de neuf ans, il a eu un seul accident pour lequel il n’était pas responsable.

 

Le plaignant a continué à tenter de récupérer son permis de conduire.  En 1991, il a déposé une plainte aux termes de la Human Rights Act alléguant que le surintendant lui avait refusé un service ou une installation destinés au public, en raison d’une déficience physique, en contravention de l’article 3 de la Loi.  Le membre désigné du Human Rights Council a conclu que l’intimé avait exercé une discrimination contre le plaignant.

 

Peu de temps après que la décision a été rendue, le plaignant est décédé.  Le surintendant des véhicules automobiles de la Colombie-Britannique et le procureur général de la Colombie-Britannique ont demandé une ordonnance annulant la décision, et ont soutenu que le décès du plaignant n’avait pas rendu la question théorique, compte tenu de l’effet possible de la décision sur d’autres affaires.  La veuve du plaignant a continué de représenter les intérêts de ce dernier.  La Cour suprême de la Colombie-Britannique a conclu que le membre désigné n’avait pas interprété la loi de façon erronée, ni commis d’erreur de façon à outrepasser sa compétence, et a donc rejeté la demande.  La Cour d’appel de la Colombie-Britannique a conclu que le membre désigné avait commis des erreurs de droit et une erreur de fait manifestement déraisonnable, et a donc accueilli l’appel et annulé la décision du membre désigné.

26695      Vincent Scalera v. M.J. Oppenhem in his quality as Attorney in Canada for the Non-Marine Underwriters, Members of Lloyd’s of London

 

Commercial law - Insurance - Duty to defend - Interpretation - Appellant’s homeowners’ policy provides liability coverage for actions relating to “bodily injury” subject to an intentional act exclusion - Can an insurer under a contract of insurance obligate itself to provide a defence to a claim even if the insurance contract does not create a possible obligation to indemnify the insured - Do liability insurance policies containing intentional act exclusions relieve the insurer of its duty to defend a claim alleging harm as a result of sexual activity?

 

The Appellant and four co-workers, all bus drivers employed by British Columbia Transit, are named as defendants in an action commenced July 25, 1996. The plaintiff alleges that the drivers engaged in sexual relations with her at various times and in various places while she was an adolescent, and that she suffered injury, loss and expense as a result. She claims compensatory and exemplary damages.

 

The Respondent sought a declaration that a policy of residential insurance  issued by the Respondent did not oblige it to defend the Appellant in the underlying action. The policy reads, in part:

 

SECTION TWO - PERSONAL LIABILITY INSURANCE

 

¼ “This insurance applies only to accidents or occurrences which take place during the period of insurance indicated on the Declarations.

¼

You are insured for claims made against you arising from:

1. Personal Liability - legal liability arising out of your personal actions anywhere in the world.

¼

We will defend, by counsel of our choice, any suit against you alleging bodily injury or property damage and seeking compensatory damages, even if it is groundless, false or fraudulent. We reserve the right to investigate, negotiate and settle any claim or suit if we decide this is appropriate.

GENERAL EXCLUSIONS APPLICABLE TO THIS SECTION TWO

 

You are not insured for claims arising from:

¼ (5) bodily injury or property damage caused by any intentional or criminal acts or failure to act by:

(a) any person insured by this document.

 

The chambers judge followed the decision of the chambers judge in Nicodemo Sansalone v. The Wawanesa Mutual Insurance Company, File No. 26708. The wording of the two policies differed but the allegations were substantially similar. She found that the Respondent had a duty to defend the Appellant in the underlying action. The instant appeal was heard along with a the appeal in  Sansalone. The Court of Appeal allowed both appeals.

L’appelant et quatre collègues, tous des conducteurs d’autobus au service du British Columbia Transit, ont été nommés comme défendeurs dans une action intentée le 25 juillet 1996.  La demanderesse allègue que les conducteurs ont eu des relations sexuelles avec elle à différents moments et à différents endroits quand elle était adolescente, et qu’en conséquence elle a subi un préjudice, une perte et des frais.  Elle demande des dommages-intérêts compensatoires et punitifs.

 

L’intimée a cherché à obtenir une déclaration selon laquelle une police d’assurance résidentielle qu’elle a délivrée ne l’obligeait pas à défendre l’appelant dans l’action sous-jacente.  La police prévoit notamment:

Le juge en chambre a suivi la décision du juge en chambre dans Nicodemo Sansalone c. The Wawanesa Mutual Insurance Company, no du greffe 26708.  Le libellé des deux polices était différent, mais les allégations étaient essentiellement semblables.  Elle a conclu que l’intimée avait l’obligation de défendre l’appelant dans l’action sous-jacente.  Le présent appel a été entendu en même temps que celui dans Sansalone.  La Cour d’appel a accueilli les deux appels.

The Appellant and four co-workers, all bus drivers employed by British Columbia Transit, are named as defendants in an action commenced July 25, 1996. The plaintiff alleges that the drivers engaged in sexual relations with her at various times and in various places while she was an adolescent, and that she suffered injury, loss and expense as a result. She claims compensatory and exemplary damages.

 

The Appellant sought a declaration that his homeowners’ insurance policy obliges the Respondent to defend him in the underlying action, that he is entitled to select and instruct defence counsel at the Respondent’s expense, and that the Respondent is obligated to reimburse him for all legal costs incurred to date in defending the underlying action. It reads, in part:

 

Coverage E – Legal liability

 

We will pay all sums which you become legally liable to pay as compensatory damages because of bodily injury ¼ to which this insurance applies. We will defend any action against you alleging bodily injury ¼ and seeking those compensatory damages, even if it is groundless, false or fraudulent.

¼ You are insured for claims made or actions brought against you for:

(1)           Personal Liability: bodily injury ¼ arising out of your personal activities anywhere in the world.

¼ Exclusions: You are not insured for claims made or actions brought against you for:

¼ (8) bodily injury ¼ caused intentionally by you or at your direction ¼ .

 

The chambers judge found that the Respondent had a duty to defend the Appellant in the underlying action. The appeal was heard along with another appeal of a declaration that an insurer had a duty to defend one of the other defendants in the underlying action: Vincent Scalera v. M.J. Oppenheim in his quality as Attorney in Canada for the Non-Marine Underwriters, Members of Lloyd’s of London, File No. 26695. The wording of the two policies differed but the allegations were substantially similar. The trial judge in Scalera had followed the chambers decision in the instant case. The Court of Appeal allowed both appeals.

Le juge en chambre a conclu que l’intimée avait l’obligation de défendre l’appelant dans l’action sous-jacente.  L’appel a été entendu en même temps qu’un autre appel d’une déclaration selon laquelle un assureur avait l’obligation de défendre l’un des autres défendeurs dans l’action sous-jacente: Vincent Scalera c. M.J. Oppenheim en sa qualité de Procureur au Canada pour les Non-Marine Underwriters, Members of Lloyd’s of London, no du greffe 26695.  Le libellé des deux polices était différent, mais les allégations étaient essentiellement semblables.  Le juge du procès dans Scalera avait suivi la décision du juge en chambre dans la présente affaire.  La Cour d’appel a accueilli les deux appels.

26990      B59 443 132 Master Corporal G.C. Brown v. Her Majesty The Queen

 

Canadian Charter of Rights and Freedoms  - Criminal law - Narcotics - Defence - Entrapment - Whether the President of the Standing Court Martial misunderstood the legal test for entrapment and  the breadth of the offence of trafficking under the Narcotic Control Act - Whether the President of the Standing Court Martial failed to consider the legal test required before a stay of proceedings could be imposed - Whether in the absence of legal error, the Court Martial Appeal Court erred in setting aside the decision of the Standing Court Martial.

 

The Appellant was posted to the Canadian Forces base at Hare Bay, Newfoundland where he was an helicopter mechanic in the Regular Forces.  Based on reports from allegedly reliable informants in January and February 1996, and Brown’s coincidental arrival at the home of a friend during a drug bust, the military police and R.C.M.P. suspected that Brown was heavily involved in the local drug trade.  A joint undercover operation commenced on May 2, 1996, involving Military Police Corporal Stanford and Constable Kaiser of the R.C.M.P.  Stanford befriended the Appellant and visited his home on a regular basis, while Kaiser posed as Stanford’s girlfriend.  Stanford provided Brown with several large bottles of alcohol which he represented as being contraband liquor and did not demand monetary repayment.

 

From the outset of the operation in early May until late November 1996, no evidence was found to support the informants’ allegations that Brown was trafficking in narcotics.  Stanford did uncover that Brown was an alcoholic and an occasional, recreational user of cannabis.  He saw Brown using cannabis alone once and on two occasions witnessed Brown engaged in the communal use of cannabis.

 

On November 30, 1996, Stanford presented Brown with an opportunity to purchase some hashish for him, but it was a third party who actually bought a small quantity of drugs and delivered them to Stanford.  On December 7, Kaiser requested some hashish and provided Brown with $40 to purchase some for her.  Brown returned with four small pieces of hashish, two for Kaiser and two for a friend.  On December 9, virtually the same series of events transpired.  Brown was charged with two counts of trafficking.  At trial, President Barnes found that Brown’s actions amounted to trafficking, but granted a stay of proceedings on the basis that the defence of entrapment had been established.  On appeal, the majority of the Court of Appeal allowed the appeal, quashed the stay and sent the matter back for a new trial.

Charte canadienne des droits et libertés  - Droit criminel - Stupéfiants - Défense - Provocation policière - Le président de la Cour martiale permanente a-t-il mal interprété le critère juridique de la provocation policière et la gravité de l’infraction de trafic visée par la Loi sur les stupéfiants? - Le président de la Cour martiale permanente a-t-il omis de tenir compte du critère juridique requis avant qu’un arrêt des procédures puisse être imposé? - En l’absence d’une erreur de droit, la Cour d’appel de la cour martiale a-t-elle commis une erreur en annulant la décision de la Cour martiale permanente?

 

L’appelant, un mécanicien d’hélicoptère dans les Forces armées régulières, était en poste à la base des Forces armées canadiennes à Hare Bay, à Terre-Neuve.  En se fondant sur des rapports faits par des informateurs prétendument fiables en janvier et en février 1996, de même que sur l’arrivée fortuite du caporal Brown à la demeure de son ami au moment d’une descente policière, la police militaire et la G.R.C. ont soupçonné que le caporal Brown était fortement impliqué dans le commerce local de la drogue.  Une opération clandestine conjointe, menée par le caporal Stanford de la police militaire et le gendarme Kaiser de la G.R.C., a débuté le 2 mai 1996.  Le caporal Stanford s’est lié d’amitié avec l’appelant et se rendait à sa demeure sur une base régulière, alors que le gendarme Kaiser se faisait passer pour l’amie du caporal Stanford.  Le caporal Stanford a fourni au caporal Brown plusieurs grandes bouteilles d’alcool, qu’il disait être de l’alcool de contrebande, et n’en a pas demandé paiement.

 

Dès le début de l’opération au début mai jusqu’à la fin novembre 1996, aucune preuve n’a pu être trouvée relativement aux allégations selon lesquelles le caporal Brown était impliqué dans le trafic de stupéfiants.  Le caporal Stanford a découvert que le caporal Brown était alcoolique et faisait un usage occasionnel et récréatif du cannabis.  Il a vu une fois le caporal Brown consommer seul du cannabis, et a été témoin à deux reprises du fait que celui-ci en consommait en collectivité.

 

Le 30 novembre 1996, le caporal Stanford a donné une occasion au caporal Brown de lui procurer un peu de hachisch, mais ce fut un tiers qui a acheté une petite quantité de drogue et qui l’a livrée au caporal Stanford.  Le 7 décembre, le gendarme Kaiser a fait une demande pour avoir du hachisch et a donné 40 $ au caporal Brown pour qu’il lui en achète.  Le caporal Brown lui en a fourni quatre petits morceaux, soit deux pour elle et deux pour un ami.  Le 9 décembre, à peu près la même séquence d’événements s’est produite.  Le caporal Brown a été inculpé de deux chefs d’accusation de trafic.  En première instance, le président Barnes a déclaré que les actes du caporal Brown équivalaient à du trafic, mais a accordé un arrêt des procédures au motif que la défense de provocation policière avait été établie.  En appel, la Cour d’appel à la majorité a accueilli l’appel, annulé l’arrêt des procédures et renvoyé le dossier pour qu’il fasse l’objet d’un nouveau procès.

Criminal law - Evidence - Charge to the jury -If the trial judge’s charge, on reasonable doubt, was in error because of a lack of direction, rather than a misdirection, can this case be distinguished from R. v. Lifchus and R.v. Bisson and therefore s. 686(1)(b)(iii) applied - Whether the trial judge erred in ruling that evidence of certain complainants could be considered similar fact evidence - Whether the trial judge erred in his instructions to the jury on the use they could make of similar fact evidence.

 

The Respondent had been charged on an indictment with twelve sexual offences involving six complainants, which offences were alleged to have occurred over a period of approximately fifteen years.  The seven counts of which he was convicted involved five of the six complainants.  Of the five counts of which he was acquitted, which included indecent assault, gross indecency and rape, two counts involved one of these complainants; three counts involved another complainant.

 

The Respondent elected to conduct his own defence at trial.  The trial judge invited him to consider the wisdom of that decision, considering the gravity of the charges he was facing.  Notwithstanding this advice, the Respondent reaffirmed his decision to conduct his own defence and the trial proceeded on that basis.  The Respondent did not testify on his own behalf.

 

On appeal, the Respondent argued that because of the many errors alleged to have been made by the trial judge, the Respondent did not get a fair trial.  The majority of the Court of Appeal set aside the convictions and ordered a new trial.  The majority found that the failure of the trial judge to properly instruct the jury with respect to the meaning of proof beyond a reasonable doubt resulted in a fundamental error and was sufficient to quash the convictions and order a new trial.  The majority also  found that serious errors in law were made with respect to the admissibility and, if admissible, the way in which similar fact evidence should have been considered by the jury.  The majority found that the curative provisions of s. 686(1)(b)(iii) of the Criminal Code  could not be applied.  Marshall J.A. dissenting would have dismissed the appeal as s. 686(1)(b)(iii) should be applied to uphold the convictions and that there was no error of law committed by the trial judge in admitting the similar fact evidence.

Droit criminel - Preuve - Exposé au jury - Si l’exposé du juge du procès sur le doute raisonnable était erroné à cause d’une absence de directive, plutôt qu’à cause d’une directive erronée, la présente affaire peut-elle être distinguée d’avec R. c. Lifchus et R. c. Bisson et, par conséquent, l’art. 686(1)b)(iii) s’applique-t-il? - Le juge du procès a-t-il commis une erreur en décidant que le témoignage de certaines plaignantes pouvait être considéré comme une preuve de faits similaires? - Le juge du procès a-t-il commis une erreur dans ses directives au jury sur l’utilisation qu’il pouvait faire de la preuve de faits similaires?

 

L’intimé a été accusé par voie d’acte d’accusation de 12 infractions d’ordre sexuel contre six plaignantes. Ces infractions seraient survenues au cours d’une période d’environ 15 ans. Les sept chefs relativement auxquels il a été reconnu coupable concernaient 5 des 6 plaignantes. Des cinq chefs relativement auxquels il a été acquitté, qui comprenaient attentat à la pudeur, grossière indécence et viol, deux concernaient une de ces plaignantes et trois concernaient une autre plaignante.

 

L’intimé a choisi d’assurer sa propre défense au procès. Le juge du procès l’a invité à examiner la sagesse de cette décision, considérant la gravité des accusations dont il faisait l’objet. Nonobstant cet avis, l’intimé a confirmé sa décision d’assurer sa propre défense et le procès a eu lieu ainsi. L’intimé n’a pas témoigné pour sa défense.

 

En appel, l’intimé a allégué ne pas avoir eu un procès équitable parce que le juge du procès aurait commis de nombreuses erreurs. La Cour d’appel à la majorité a annulé les déclarations de culpabilité et ordonné la tenue d’un nouveau procès. Les juges majoritaires ont conclu que l’omission du juge du procès de donner au jury des directives appropriées sur le sens de la preuve hors de tout doute raisonnable a résulté en une erreur fondamentale suffisante pour annuler les déclarations de culpabilité et ils ont ordonné la tenue d’un nouveau procès. Les juges majoritaires ont aussi conclu que de graves erreurs de droit ont été commises relativement à l’admissibilité de la preuve de faits similaires et, si elle était admissible, à la façon dont elle aurait dû être examinée par le jury. Les juges majoritaires ont conclu que les dispositions réparatrices du sous‑al. 686(1)b)(iii) du Code criminel  ne pouvaient pas être appliquées. Le juge Marshall, dissident, aurait rejeté l’appel puisque le sous‑al. 686(1)b)(iii) devait être appliqué pour confirmer les déclarations de culpabilité et que le juge du procès n’avait pas commis d’erreur de droit en admettant la preuve de faits similaires.

The Fall Session of the Supreme Court of Canada will commence October 4, 1999.

 

Pursuant to the Supreme Court Act and Rules, the following requirements for filing must be complied with before an appeal can be inscribed for hearing:

 

Appellants record; appellants factum; and appellants book(s) of authorities  must be filed within four months of the filing of the notice of appeal.

 

Respondents record (if any); respondents factum; and respondents book(s) of authorities must be filed within eight weeks of the date of service of the appellant's factum.

 

Intervener's factum and interveners book(s) of authorities, if any, must be filed within four weeks of the date of service of the respondent's factum, unless otherwise ordered.

 

Parties condensed book, if required, must be filed on or before the day of hearing of the appeal.

 

Please consult the Notice to the Profession of October 1997 for further information.

 

The Registrar shall inscribe the appeal for hearing upon the filing of the respondent's factum or after the expiry of the time for filing the respondent's factum.

Conformément à la Loi sur la Cour suprême et aux Règles, il faut se conformer aux exigences suivantes avant qu'un appel puisse être inscrit pour audition:
