Torts - Motor Vehicles - Assessment - Apportionment for contributory negligence by injured party - Failure to wear seat belt - - Whether Court of Appeal erred in overturning apportionment for contributory negligence - Whether Court of Appeal erred by arbitrarily creating new policy and law that the upper limit of the range for contributory negligence for failure to wear a seatbelt is 25% and most cases fall between 5% and 10% - Whether the issue of a cap on contributory negligence for not wearing a seatbelt should be addressed by the Legislature - Whether an apportionment in excess of 25% for contributory negligence for failure to wear a seatbelt is unreasonable and ought not to be a possibility - Whether the Court of Appeal’s decision is inconsistent with other judicial decisions - Whether the Court of Appeal determined that most cases fall into the lower end of the range without supporting evidence - Whether Court of Appeal erred with respect to appropriate jury instructions.
Daniel Fulsang drove his car into the rear of George Vetzal’s car. Carol Snushall, a passenger in Fulsang’s car, was injured. She was wearing a lap belt as required by statute. She was not wearing an optional shoulder belt available in Fulsang’s car and she was not statutorily required to wear the optional shoulder belt. The jury apportioned contributory negligence to Snushall at 35%. The Court of Appeal lowered the apportionment to 5% and held that there should be an upper cap of 25% on apportionments to injured parties for contributory negligence by failure to wear a seat belt.

Daniel Fulsang a embouti l’arrière du véhicule de George Vetzal. Une passagère de Fulsang, Carol Snushall, a subi des blessures. Elle portait la ceinture abdominale exigée par la loi. Elle n’avait pas bouclé la ceinture diagonale dont la voiture était équipée mais dont le port n’était pas obligatoire. Le jury a établi à 35 % la part de responsabilité que Snushall assumait pour négligence contributive. La Cour d’appel a réduit le pourcentage de responsabilité à 5 % et statué que ce pourcentage ne devrait pas dépasser 25 % pour la négligence contributive découlant de l’omission de porter une ceinture de sécurité.

The applicant, Eugene Fletcher sought an extension of time to appeal the conviction and sentence imposed by Meehan J., after pleading guilty to a charge of sexual assault causing bodily harm and choking in 1985. Fletcher was found to be a dangerous offender and received an indeterminate sentence. He applied to the Ontario Court of Appeal for an extension of time to appeal this decision 19 years after the appeal period had expired. The Crown opposed the extension of time. Fletcher submitted that he did not know he could appeal until recently and submitted that there had been a change in the dangerous offender provisions under the Criminal Code and a change in their interpretation, as a result of the decision in R. v. Johnson, [2003] 2 S.C.R. 357. The Court of Appeal dismissed the application for an extension of time.

Le demandeur, Eugene Fletcher, a demandé la prorogation du délai pour interjeter appel de la déclaration de culpabilité et de la peine prononcées par le juge Meechan par suite du plaidoyer de culpabilité aux infractions d’agression sexuelle ayant causé des lésions corporelles et de strangulation inscrit en 1985. Le juge a déclaré Fletcher délinquant dangereux et lui a imposé une peine de détention de durée indéterminée. Fletcher a soumis sa demande de prorogation dix-neuf ans après l’expiration du délai d’appel. Le ministère public s’est opposé à la demande. Fletcher a fait valoir qu’il n’a su que récemment qu’il pouvait interjeter appel et que l’arrêt R. c. Johnson, [2003] 2 R.C.S. 357, avait apporté des modifications aux dispositions du Code criminel relatives aux délinquants dangereux et à leur interprétation. The trial judge also dismissed claims for loss of income and for loss of future earning capacity. The Court of Appeal ordered a new trial.

The Applicant suffered a serious fall, sustained injuries and was hospitalized in South Korea. He made a claim for reimbursement under OHIP which was denied by the General Manager of OHIP on account of his failure to provide supporting documentation evidencing entitlement and his claims were determined to be stale dated. The appeal from the General Manager’s decision was dismissed by the Health Services Appeal and Review Board. A review of the decision before the Board was dismissed. The Divisional Court dismissed the appeal. Leave to appeal was not granted by the Ontario Court of Appeal.
