The applications for an extension of time are granted. The motion to adduce new evidence and the application for leave to appeal from the judgment of the Court of Appeal for Ontario, Number C43227, dated November 18, 2005, are dismissed with costs.

CASE SUMMARY
Property law – Mortgages – Whether Court of Appeal erred in holding costs and expenses not recoverable where no default or “waste” committed by mortgagors
Albert Sewell held a second mortgage on property owned by George Botros and Mouris Botros, issued in September 2002. In a letter dated December 14, 2002, before the first payment was due, Mr. Sewell demanded repayment of the entire amount by April 30, 2003, and indicated that in the meantime he would accept monthly payments from January to April inclusive. The March 2003 cheque was returned “NSF”. Mr. Sewell refused to accept a money order to replace the NSF cheque and declined to accept further payments. In July 2003 Mr. Sewell issued a Notice of Sale on the basis that he had not received full payment pursuant to his demand letter. George Botros and Mouris Botros sold the property in September 2003 to 4188381 Canada Inc., subject to the first and second mortgages. In October 2003 Mr. Sewell commenced an application seeking an award for amounts due under the second mortgage and his costs. So that the sale could be closed, George Botros and Mouris Botros obtained an order discharging the second mortgage on the basis of monies paid into court. In his application for costs and expenses in the amount of $71,002.42, Mr. Sewell claimed that George Botros and Mouris Botros had defaulted on the mortgage and had committed “waste” by failing to keep the property rented, by turning off the heat and abandoning the property. He claimed that the default and waste committed by George Botros and Mouris Botros entitled him to his costs and expenses necessarily incurred in realizing on his security.
The trial judge found there had been no default or waste committed by George Botros and Mouris Botros and, in result, held that there was no basis for Mr. Sewell’s claim of $71,002.42. Mr. Sewell’s expenses in the amount of $5000.00 were allowed. Costs in the amount of $15,000 were awarded to George Botros and Mouris Botros. The Ontario Court of Appeal dismissed Mr. Sewell’s appeal, allowing the cross-appeal by George Botros and Mouris Botros with respect to the $5000.00 in expenses. Costs against Mr. Sewell in the amount of $10,000 were awarded.

RÉSUMÉ DE L’AFFAIRE
Droit des biens – Hypothèques – La Cour d’appel a‑t‑elle eu tort de conclure que les frais et déboursés ne sont pas recouvrables lorsque les débiteurs hypothécaires n’ont commis aucun manquement ou « dégradation »?
Albert Sewell détenait une hypothèque de second rang, consentie en septembre 2002, sur un immeuble appartenant à George Botros et Mouris Botros. Dans une lettre du 14 décembre 2002, et avant que le premier paiement ne devienne exigible, M. Sewell a exigé que la somme soit remboursée intégralement au plus tard le 30 avril 2003, indiquant qu’entre‑temps, il accepterait les versements des mois de janvier à avril inclusivement. Le chèque de mars 2003 a été retourné pour insuffisance de fonds. M. Sewell a refusé le mandat visant à remplacer le chèque sans provision, ainsi que les autres versements. En juillet 2003, M. Sewell a donné un avis de vente parce qu’il n’avait pas reçu le remboursement intégral exigé dans sa lettre. En septembre 2003, George Botros et Mouris Botros ont vendu l’immeuble à 4188381 Canada Inc., sous réserve de la première et de la deuxième hypothèques. En octobre 2003, M. Sewell a déposé une demande visant le paiement des sommes dues en vertu de la deuxième hypothèque et de ses frais. Afin que la vente puisse être conclue, George Botros et Mouris Botros ont obtenu une ordonnance les libérant de la deuxième hypothèque moyennant consignation des sommes à la cour. Dans sa demande de frais et déboursés s’élevant à 71 002, 42 $, M. Sewell a prétendu que George Botros et Mouris Botros avaient fait défaut de respecter l’hypothèque et avaient commis une « dégradation » en ne louant pas l’immeuble, en cessant de le chauffer et en l’abandonnant. Il a soutenu que le manquement et la dégradation commis par George Botros et Mouris Botros lui donnaient droit au paiement des frais et déboursés nécessairement engagés pour l’exécution de sa garantie.
Le juge de première instance a conclu que George Botros et Mouris Botros n’avaient pas commis de manquement ou de dégradation et a donc conclu que l’action de 71 002,42 $ intentée par M. Sewell n’était pas fondée. Il a accordé à M. Sewell une somme de 5000 $ pour ses déboursés. Des frais de 15 000 $ ont été accordés à George Botros et à Mouris Botros. La Cour d’appel de l’Ontario a rejeté l’appel de M. Sewell, accueillant l’appel incident de George Botros et Mouris Botros concernant les déboursés de 5000 $. M. Sewell a été condamné à payer des frais de 10 000 $.
