Canadian Charter of Rights and Freedoms - Civil - Immigration law - Citizenship - Allegation of misrepresentation as to wartime collaboration in application for visa - Documentation of immigration and citizenship applications destroyed in routine purging of inactive files - Did Federal Court (Trial Division) judge and Federal Court of Appeal erred in denying the Appellant his requested Stay in context of the following: (i) the Minister’s destruction and/or loss of documentation essential to the case; (ii) the Minister’s refusal to provide further necessary disclosure through a certificate issued under s. 39 of the Canada Evidence Act; (iii) the delay of the Minister in presenting her case in regard to limitations for fraud as operating in a civil action; (iv) the denial of the protections of s.7 and 15(1) of the Charter of Rights and Freedoms to the Appellant; and (v) the Minister’s use of civil proceedings, by way of an administrative expeditious reference, to try to establish criminality - Did Federal Court (Trial Division) judge and the Federal Court of Appeal err in refusing to consider and find the denial of rights of appeal under s. 18(3) of the Citizenship Act a violation of the Appellant’s rights under s. 7 of and 15(1) of the Charter of Rights and Freedoms, and if such rights were violated to consider whether the restriction was reasonably justifiable - Did the Federal Court (Trial Division) misdirect himself, and the Federal Court of Appeal err, in dismissing loss of jurisdiction when no evidence was present to establish a finding of fraud as alleged by the Minster, thereby denying the Appellant natural justice.
