Labour relations - Arbitration - Judicial review - Standard of review - Whether the Ontario Court of Appeal erred in finding that the Grievance Settlement Board’s decision implicated the natural justice rights of the employee - Whether the Ontario Court of Appeal erred in finding that the standard of correctness applied - Whether the Ontario Court of Appeal erred in finding that the Board did not have the power to order that the grievances at issue be granted on a preliminary basis - Whether the Ontario Court of Appeal erred in finding that the Board ought to have held a full hearing on the merits of the grievances.
A consultant engaged to investigate a problematic work environment in the grievor’s office identified the grievor as the cause of the problems and recommended that he be relocated. He was reassigned. He filed a fresh grievance alleging unjust discipline, discrimination, and breaches of various settlements reached in previous grievances. Specifically, he alleged breach of the employer’s promise not to disclose various documents to the consultant or to rely on those documents in making its decision, and breach of a promise not to relocate him.
When the employer denied a request for disclosure, another grievance alleging breach of the collective agreement’s disclosure provisions was filed. On the business day before the matter was to be heard, the employer reported that, contrary to the terms of its contract, the consultant had destroyed all of the requested materials. The day after the hearing was to begin, it advised that everything but the consultant’s notes were available. The union moved to have the grievances granted because the employer’s initial refusal to provide disclosure, the shredding of relevant documents by the employer’s agent, and the employer’s change in position upon the sudden recovered of the documents had prevented it from advancing its claims. It argued that, under those circumstances, proceeding to a hearing would deny natural justice and be an abuse of process.
The Board held that the documents sought were highly relevant to the union’s case and that their destruction meant that a full and fair hearing could not take place. The only appropriate remedy was to grant the grievance. A panel of the Divisional Court refused judicial review, but a majority of the Court of Appeal allowed an appeal.

Relations du travail - Arbitrage - Contrôle judiciaire - Norme de contrôle - La Cour d’appel de l’Ontario a‐t‐elle commis une erreur en concluant que la décision de la Commission de règlement des griefs touchait les droits de justice naturelle de l’employé concerné? - La Cour d’appel de l’Ontario a‐t‐elle commis une erreur en concluant que la norme applicable était celle de la décision correcte? - La Cour d’appel de l’Ontario a‐t‐elle commis une erreur en concluant que la Commission n’avait pas le pouvoir d’ordonner que les griefs soient accueillis de façon préliminaire? - La Cour d’appel de l’Ontario a‐t‐elle commis une erreur en concluant que la Commission aurait dû entendre les griefs sur le fond?
Un expert‐conseil chargé de faire enquête au sujet d’un milieu de travail difficile au bureau du plaignant a déterminé que les problèmes étaient causés par le plaignant, et il a recommandé qu’il soit déplacé. Le plaignant a été réaffecté et il a déposé un nouveau grief dans lequel il dit avoir fait l’objet d’une mesure disciplinaire injuste et de discrimination et que l’employeur a fait défaut de respecter des ententes à l’amiable visant des griefs antérieurs. Plus particulièrement, il allègue que l’employeur a enfreint son engagement de ne pas divulguer certains documents à l’expert‐conseil ou de ne pas s’appuyer sur ceux‐ci pour prendre sa décision ainsi que son engagement de ne pas le déplacer.
Lorsque l’employeur a refusé de donner suite à une demande de communication de documents, un autre grief a été déposé au motif que les dispositions de la convention collective en matière de communication n’avaient pas été respectées. Le jour ouvrable avant la date prévue de l’audience, l’employeur a fait savoir que, contrairement aux modalités de son contrat, l’expert‐conseil avait détruit tous les documents demandés. Le jour suivant la date à laquelle l’audience était censée débuter, l’employeur a fait savoir que tous les documents, sauf les notes de l’expert‐conseil, étaient disponibles. Le syndicat a présenté une demande visant à faire accueillir les griefs, alléguant que le refus initial de l’employeur de communiquer les documents demandés, le déchiquetage de documents pertinents par le mandataire de l’employeur et le changement de position de l’employeur après la récupération soudaine des documents l’avaient empêché de faire valoir ses demandes. Le syndicat a plaidé que la tenue d’une audience dans les circonstances constituerait un déni de justice naturelle et un abus de procédure.
La Commission a conclu que les documents demandés étaient fort pertinents et qu’en raison du fait qu’ils avaient été détruits, il n’était pas possible de tenir une audience complète et équitable. La seule réparation appropriée consistait à accueillir le grief. Une formation de la Cour divisionnaire a rejeté la demande de contrôle judiciaire, mais la Cour d’appel, à la majorité, a accueilli l’appel.

Chuang, a dentist was charged with 18 acts of professional misconduct in relation to the dental treatment and subsequent conduct towards certain named patients. He was found guilty on 15 of such acts. Chuang’s licence to practice was revoked in the interests of public safety and he was ordered to pay the College $250,000 in costs. Chuang’s appeal to Superior Court of Justice (Divisional Court) was dismissed, except that the costs award was reduced to $200,000. Leave to appeal to the Ontario Court of Appeal was denied.

After a jury trial, the jury awarded $4,000.00 in general damages, and $180.00 in out-of-pocket expenses. The court of appeal allowed the appeal in part, and the jury’s assessment of general damages in the amount of $4,000.00 is thereby increased to $12,000.00.

The Applicant, Duffin Capital Corporation (“Duffin”) is a developer, which owns about 1500 acres of land in the City of Pickering in an area known as Cherrywood. In April 2003, the Respondent, the Minister of Municipal Affairs and Housing (“the Minister”) established a single development planning area in the City of Pickering under the Ontario Planning and Development Act, 1994, S.O. 1994, c. 23 (“the OPDA”). Duffin brought an application for judicial review of the statutory power of decision exercised by the Minister under the OPDA on the basis that the Minister had breached ss. 2(3) and 4(1) of the Act. The Divisional Court quashed Duffin’s application as premature. Duffin appealed with leave to the Court of Appeal for Ontario. At the commencement of the hearing, counsel advised the court that on the previous day the Minister had recommended that the Central Pickering Development Plan be approved and that an Order in Council was issued the same day. As a result, the prematurity issue had essentially dissolved. However, the court decided that it would stay seized of the appeal and hear it on the merits. Duffin advanced two arguments on the appeal: (1) the Minister’s initial reference to Planning Alliance breached s. 2(3) of the OPDA; and (2) the process established by the Minister led to the breach of the “public participation” component of the process mandated by s. 4(1) of the Act. The Court of Appeal dismissed the appeal.

La demanderesse, Duffin Capital Corporation (Duffin) est un promoteur qui possède environ 1 500 acres de terrain à Pickering, dans une zone connue sous le nom de Cherrywood. Au mois d’avril 2003, l’intimé, le ministre des Affaires municipales et du Logement (le ministre) a constitué, sous le régime de la Loi de 1994 sur la planification et l’aménagement du territoire de l’Ontario, 1994, L.O. 1994, ch. 23 (LPATO) une seule zone de planification de l’aménagement dans la Cité de Pickering. Duffin a demandé le contrôle judiciaire de l’exercice par le ministre des pouvoirs décisionnels conférés par la LPATO, affirmant que les par. 2(3) et 4(1) de la Loi avaient été enfreints. La Cour divisionnaire a rejeté la demande, la jugeant prématurée. Duffin a interjeté appel sur autorisation à la Cour d’appel de l’Ontario. Lorsque l’instruction de l’appel s’est ouverte, la Cour a été informée que le ministre avait recommandé la veille l’approbation du plan d’aménagement du centre de Pickering et qu’un décret avait été pris le jour même. La question de la prématurité ne se posait pour ainsi dire plus. Toutefois, la Cour a décidé qu’elle demeurait saisie de l’appel et qu’elle l’instruirait sur le fond. Duffin a soumis deux arguments en appel : (1) le recours initial du ministre aux services de Planning Alliance contrevenait au par. 2(3) de la LPATO et (2) le processus établi par le ministre a entraîné le non‐respect de l’élément « participation du public » du processus prescrit par le par. 4(1) de la LPATO. La Cour d’appel a rejeté l’appel.

CASE SUMMARY
Criminal and Penal law - Trial - Charge to Jury - Vetrovec Warnings - Whether Court of Appeal erred in holding that a Vetrovec warning to the jury regarding the reliability of a Crown witness’s testimony was not warranted.
The applicant was charged with the first degree murder of Michael Friginette. Several witnesses provided circumstantial evidence and the applicant’s roommate provided testimony that disclosed a possible motive but the testimony of Brennan Frank was central to the Crown’s case against the applicant. The shooting occurred inside Brennan Frank’s apartment. Brennan Frank and others were told to leave the apartment by two women who had accompanied two men including the applicant to the apartment. Brennan Frank testified that he past the applicant on a stairway outside his apartment and saw the applicant pull what he thought was a gun wrapped in plastic from his belt and enter the apartment. He heard shots immediately afterwards and fled. Frank had prior convictions for dangerous driving, damage to property, theft under, forgery and failure to appear. The defence requested a Vetrovec warning in respect of Frank’s testimony. The trial judge refused to give a Vetrovec warning and did not provide reasons for his decision.

Droit criminel et pénal - Procès - Exposé au jury - Mises en garde de type Vetrovec - La Cour d’appel a‐t‐elle conclu à tort qu’il n’était pas justifié de faire une mise en garde de type Vetrovec au jury relativement à la fiabilité du témoignage d’un témoin du ministère public?
Le demandeur a été accusé du meurtre au premier degré de Michael Friginette. Plusieurs témoins ont apporté une preuve circonstancielle et le colocataire du demandeur a fourni un témoignage révélant un mobile possible, mais le témoignage de Brennan Frank constituait l’élément essentiel des allégations du ministère public contre le demandeur. La fusillade s’est produite dans l’appartement de M. Frank. Deux femmes qui avaient accompagné deux hommes, dont le demandeur, à l’appartement ont demandé à Brennan Frank et à d’autres personnes de quitter les lieux. Brennan Frank a témoigné qu’en passant devant le demandeur dans un escalier situé à l’extérieur de son appartement, il a vu ce dernier retirer de sa ceinture ce qui lui a semblé être une arme à feu enveloppée dans du plastique et entrer dans l’appartement. Il a entendu des coups de feu toute de suite après, puis s’est enfui. Monsieur Frank avait déjà été déclaré coupable de conduite dangereuse, d’avoir causé des dommages matériels, de vol de faible importance, de faux et de défaut de comparaître. La défense a demandé une mise en garde de type Vetrovec relativement au témoignage de M. Frank. Le juge du procès a refusé de donner une mise en garde de type Vetrovec et n’a pas motivé sa décision.
