AND UPON APPLICATION by the Tsawwassen First Nation to append to its factum the affidavit of Kimberley Baird;
AND HAVING READ the material filed;
IT IS HEREBY ORDERED THAT:
The motion for leave to intervene of the applicant, Tsawwassen First Nation, is granted and the applicant shall be entitled to serve and file a factum not to exceed 10 pages in length on or before November 20, 2007. The motion by Tsawwassen First Nation to append to its factum the affidavit of Kimberley Baird is dismissed.

Criminal law — Trial — Verdicts — Accused convicted of several offences — Fresh expert evidence available after convictions upheld on appeal discrediting Crown witnesses — Whether verdicts would necessarily have been the same — Whether manslaughter conviction should be substituted for conviction for murder — Whether accused should be acquitted of murder and criminal negligence causing death.
The accused, M and A, were convicted of offences committed against their infant son. M was convicted of second degree murder, aggravated assault and assault causing bodily harm; A, of criminal negligence causing death and failure to provide the necessaries of life. The Court of Appeal upheld their convictions. Following the appeal, expert opinions by P and another expert became available. This fresh evidence adduced before this Court discredits evidence given by S, an expert called by the Crown, and renders unreliable evidence given by C, a Crown witness.
Held: The appeals should be allowed.
The convictions of the accused should be set aside and a new trial ordered with respect to the offences of which M and A were convicted. S’s evidence, which is now conceded to be unreliable, was central to the Crown’s case. S’s evidence may have influenced the jury’s conclusion on both the causation and intent elements of the murder charge. It would therefore be inappropriate to substitute a conviction for manslaughter for M’s conviction for murder. Acquittals on the counts of murder and criminal negligence causing death would also not be appropriate because it cannot be said that a properly instructed jury, acting reasonably, could not find the accused guilty of the homicide‐related offences based on the remaining evidence. Lastly, although the fresh evidence relates mainly to the convictions for murder and criminal negligence causing death, it nonetheless bears as well, albeit to a lesser degree, on the other counts, and it would be speculative and unsafe to conclude that any of the verdicts would necessarily have been the same but for S’s evidence. To attempt at this stage to insulate the effect of S’s evidence on one count from its possible effect on the others would amount to an unwarranted exercise in appellate speculation. [5-7, 13-14]

Droit criminel — Procès — Verdicts — Accusés déclarés coupables de plusieurs infractions — Nouveaux témoignages d’experts disponibles après la confirmation en appel des déclarations de culpabilité qui discréditent les témoins à charge — Les verdicts auraient‐ils été nécessairement les mêmes? — Faudrait‐il remplacer la déclaration de culpabilité pour meurtre par une déclaration de culpabilité pour homicide involontaire coupable? — Les accusés devraient‐ils être acquittés des accusations de meurtre et de négligence criminelle entraînant la mort?
Les accusés, M et A, ont été déclarés coupables d’infractions commises contre leur fils en bas âge. M a été déclaré coupable de meurtre au deuxième degré, de voies de fait graves et de voies de fait causant des lésions corporelles; A, de négligence criminelle entraînant la mort et de manquement à l’obligation de fournir les choses nécessaires à l’existence. La Cour d’appel a confirmé leurs déclarations de culpabilité. Après l’appel, les témoignages de deux experts, P et une autre personne, sont devenus disponibles. Ces éléments de preuve nouvelle présentés devant notre Cour discréditent le témoignage de S, l’expert cité par le ministère public, et la déposition de C, témoin à charge, devient de ce fait non fiable.
Arrêt : Les pourvois sont accueillis.
Les déclarations de culpabilité des accusés sont annulées et un nouveau procès est ordonné à l’égard des infractions dont M et A ont été déclarés coupables. Le témoignage de S, qui est maintenant reconnu comme non fiable, a joué un rôle primordial dans la thèse du ministère public. Il aurait bien pu influer sur la conclusion du jury concernant les deux éléments de l’accusation de meurtre, à savoir le lien de causalité et l’intention. Il ne convient donc pas de remplacer la déclaration de culpabilité de M pour meurtre par une déclaration de culpabilité pour homicide involontaire coupable. Il ne convient pas non plus de prononcer l’acquittement relativement aux chefs d’accusation de meurtre et de négligence criminelle entraînant la mort, car on ne saurait dire qu’un jury ayant reçu des directives appropriées et agissant raisonnablement ne pourrait pas, en se fondant sur les autres éléments de preuve, déclarer les accusés coupables des infractions relatives à l’homicide. Enfin, même si la preuve nouvelle porte principalement sur les déclarations de culpabilité pour meurtre et négligence criminelle entraînant la mort, elle influe également, quoique dans une moindre mesure, sur les autres chefs d’accusation, et il serait spéculatif et dangereux de conclure que le verdict concernant n’importe laquelle des accusations aurait été nécessairement le même sans le témoignage de S. Essayer à ce stade‐ci d’isoler l’effet du témoignage de S sur un chef d’accusation de l’effet qu’il pourrait avoir eu sur les autres chefs équivaudrait à se livrer de façon injustifiée à des conjectures en appel. [5‐7, 13‐14]
