Les appelants ont présenté une requête à conclusions multiples devant notre Cour et pour fin d’obtenir un sursis d’exécution d’un arrêt de la Cour d’appel du Québec rendu le 5 juin 2001. En même temps, ils ont déposé une demande d’autorisation de pourvoi à l’encontre de la décision rendue le 5 juin 2001.
Les appelants représentent un groupe de parents de langue française et de religion protestante. Devant les tribunaux de la province de Québec, ceux-ci attaquent la demande d’annulation de la Modification constitutionnelle de 1997 (Québec), qui modifiait l’article 93 de la constitution du Canada et demandent également de reconnaître l’invalidité de l’article 68 de la Loi modifiant la loi sur l’instruction publique, la Loi sur les élections scolaires et d’autres dispositions législatives, L.Q. 1997 ch. 47, ainsi que celle de diverses dispositions de la Loi modifiant diverses dispositions législatives dans le secteur de l’éducation concernant la confessionnalité, L.Q. 2000, ch. 24. Toutes ces procédures visent à préserver l’existence d’un réseau d’écoles confessionnelles protestantes qui déssert environ 2000 enfants. Après le dépôt de leur procédure en nullité, les appelants ont obtenu, en Cour supérieure un sursis de la mise en vigueur des nouvelles dispositions législatives. L’arrêt de la Cour d’appel du 5 juin 2000 a renversé ce jugement et annulé le sursis. Le 5 juillet 2001, un juge de la Cour d’appel a refusé d’accorder un sursis de ce jugement en vertu de l’article 65.1 de la Loi sur la Cour suprême.
Devant l’arrivée de la prochaine année scolaire, et la perspective de devoir inscrire leurs enfants dans des écoles laïques qui ne correspondent pas à leurs orientations religieuses, les appelants demandent un sursis de l’exécution selon l’article 65.1. Alléguant, l’extrême urgence de la situation et des ententes, ils demandent que la Cour abrège les délais normaux de présentations des réponses et des répliques à la requête en sursis et de la requête en autorisation de pourvoi. Le Procureur général du Québec s’oppose à ces mesures. Les avocats du Ministère du procureur général du Canada, ont déjà, quant à eux, déposé leur réponse à la demande d’autorisation et sursis.
Devant les circonstances particulières de cette affaire et l’impact des délais inhérents à la procédure d’appel, il apparaît nécessaire de prendre certaines mesures pour hâter la présentation du dossier à une formation de notre Cour. Malgré l’absence de certains avocats qui ont été effectivement chargés de ce dossier, dans les services juridiques du Procureur général du Québec, les faits pertinents et les questions de droit paraissent suffisamment bien définis pour qu’une réponse puisse être produite dans un délai assez court. D’ailleurs, tel que mentionné plus haut, les avocats du Procureur général du Canada ont déjà déposé une réponse complète à la demande d’autorisation. Pour éviter des délais supplémentaires, et en raison du lien étroit entre la requête en sursis et la demande d’autorisation, il est préférable que ces deux procédures soient soumises à la même formation de notre Cour.
Pour ces motifs, il est fait droit en partie à la requête des appelants. Le délai pour répondre à la requête pour sursis, est fixé au 8 août 2001 et le délai pour présenter une réplique, au 15 août 2001. Le traitement de la demande d’autorisation est accéléré, le délai pour répondre à la demande étant fixé au 17 août 2001 et celui du dépôt d’une réplique au 20 août 2001. À cette dernière date, la demande d’autorisation devra être soumise à une formation de cette Cour. La formation de cette Cour chargée de l’examen de la requête en autorisation de pourvoi sera également saisie de la demande de sursis.
