CASE SUMMARY
Charter of Rights ‑ Equality rights ‑ Whether s. 133(1)(k) of the Immigration and Refugee Protection Regulations, S.O.R./2002‑227, barring approval of sponsorship application if sponsor in receipt of social assistance for reason other than disability, violates s. 15 of the Charter on basis of analogous ground of receipt of social assistance ‑ Whether the Federal Court of Appeal erred in determining the appeal is moot or in failing to exercise its discretion to hear the appeal.
The Applicant, Guzman, came to Canada with her family, from Columbia in 2000 when she was 14 years old. They were refugee claimants and became permanent residents in 2003. Guzman became romantically involved with Hernan Cosma, an Argentinean citizen, who had arrived in Canada in 2002 at the age of 19, claiming refugee status. He obtained a temporary work permit from December 2002 to January 2004 and was employed during that time in Montreal. Guzman and Cosma moved in together in February 2003 and Guzman supported both parties until the expiration of his work permit. In September 2003, Cosma’s refugee claim was rejected. Two months later, the couple married and in December 2003, their daughter was born. In August 2004, the couple moved to Victoria, British Columbia and in November 2004, they began receiving social assistance. In April 2005, Guzman applied to sponsor Cosma as a member of the “In Canada” family class, but the application was rejected because Guzman was in receipt of social assistance for reason other than disability from the date the sponsorship application was made until the day a decision with respect to the application was made pursuant to s. 133(1)(k) of the Immigration and Refugee Protection Regulations, S.O.R./2002‑227. Guzman sought judicial review of this decision on the grounds s. 133(1)(k) violated her s. 15 Charter rights, because it discriminated against her on the basis of the analogous ground of receipt of social assistance. Cosma left Canada in 2006.

Charte des droits ‑ Droits à l’égalité ‑ L’alinéa 133(1)k) du Règlement sur l’immigration et la protection des réfugiés, D.O.R.S./2002‑227, qui pose un obstacle à l’approbation d’une demande de parrainage si le répondant est bénéficiaire d’assistance sociale pour une cause autre qu’une invalidité viole-t-il l’art. 15 de la Charte du fait qu’il établit une discrimination fondée sur un motif analogue, en l’occurrence le fait d’être bénéficiaire de l’assistance sociale? ‑ La Cour d’appel a-t-elle eu tort de statuer que l’appel revêtait un caractère théorique ou de ne pas avoir exercé son pouvoir discrétionnaire d’entendre l’appel?
La demanderesse, Mme Guzman, est arrivée au Canada avec sa famille de Colombie en 2000 alors qu’elle était âgée de 14 ans. Ils étaient demandeurs d’asile et sont devenus des résidents permanents en 2003. Madame Guzman a commencé à fréquenter Hernan Cosma, un citoyen argentin, qui était arrivé au Canada en 2002 à l’âge de 19 ans, demandant l’asile. Il a obtenu un permis de travail temporaire de décembre 2002 à janvier 2004 et il a exercé un emploi pendant cette période à Montréal. Madame Guzman et M. Cosma ont entrepris de faire vie commune en février 2003 et Mme Guzman a subvenu aux besoins du couple jusqu’à l’expiration du permis de travail de M. Cosma. En septembre 2003, la demande d’asile de M. Cosma a été rejetée. Deux mois plus tard, le couple s’est marié et en décembre 2003, leur fille est née. En août 2004, le couple est allé vivre à Victoria, en Colombie-Britannique, et en novembre 2004, ils ont commencé à recevoir des prestations d’assistance sociale. En avril 2005, Mme Guzman a présenté une demande de parrainage de M. Cosma au titre du regroupement familial « au Canada », mais la demande a été rejetée parce que Mme Guzman était bénéficiaire d’assistance sociale pour une raison autre qu’une invalidité, de la date du dépôt de la demande jusqu’à celle de la décision, en vertu de l’al. 133(1)k) du Règlement sur l’immigration et la protection des réfugiés, D.O.R.S./2002‑227. Madame Guzman a demandé le contrôle judiciaire de cette décision, alléguant que l’al. 133(1)k) violait les droits que lui garantit l’art. 15 de la Charte, parce qu’il établit une discrimination fondée sur un motif analogue, en l’occurrence le fait d’être bénéficiaire de l’assistance sociale. Monsieur Cosma a quitté le Canada en 2006.

In 2004, the Société d’énergie de la Baie James (SEBJ) awarded HMI‑Promec S.E.N.C. (HMI) a contract under which it was to be the general contractor for the work of supplying and installing electrical and mechanical equipment and systems for the Eastmain‑1 hydroelectric powerhouse. HMI subcontracted part of the work to the Applicant (Construction Kay‑Bek Inn). On March 9, 2007, Kay‑Bek had a notice of legal hypothec published for the [translation] “[i]mmovable property located at Eastmain camp, consisting of administrative offices, housing units and units for sports and other recreational activities”. HMI then filed a motion to institute proceedings to have the hypothec cancelled. It argued, inter alia, that no work had been done on the property in question, that the property was not immovable and that, even assuming that it was immovable, it was owned by the state and was therefore exempt from seizure.
In response, Kay‑Bek filed a cross demand (which it called a motion to institute proceedings) against HMI and SEBJ and against, as surety, the Respondent Travelers Guarantee Company of Canada (Travelers). It sought, inter alia, recognition of the legal hypothec and $1,788,863.39 in damages. HMI, SEBJ and Travelers then filed a motion to dismiss those proceedings.
The trial judge dismissed both motions. The Court of Appeal reversed the judgment, finding that it was not open to the trial judge to decide that the property at Eastmain camp, which was owned by Hydro‑Québec, could be seized. It allowed the motion to cancel the legal hypothec. It also dismissed the cross demand against HMI and SEBJ, since they had not filed a demand against Kay‑Bek at first instance.

En 2004, la Société d’énergie de la Baie James (SEBJ) accorde à HMI-Promec S.E.N.C. (HMI) un contrat d’entrepreneur général pour réaliser des travaux de fourniture et d’installation de l’appareillage et des systèmes électriques et mécaniques de la centrale hydroélectrique de l’Eastmain‑1. HMI confie la réalisation d’une partie de ces travaux en sous-traitance à la demanderesse (Construction Kay-Bek Inn). Le 9 mars 2007, Kay-Bek fait publier un avis d’hypothèque légale sur les « [i]mmeubles situés au Camp d’Eastmain composés des bureaux administratifs, des unités de logement, des unités d’activités sportives et autres loisirs ». HMI dépose alors une requête introductive d’instance pour faire radier l’hypothèque. Elle soutient notamment que les biens visés n’ont pas fait l’objet de travaux, qu’ils ne constituent pas des immeubles, et que même en tenant pour acquis qu’ils s’agit d’immeubles, ceux-ci appartiennent à l’État et sont dès lors insaisissables.
En réponse, Kay-Bek dépose une demande reconventionnelle (qu’elle intitule requête introductive d’instance) dirigée contre HMI et SEBJ et, à titre de caution, l’intimée Compagnie Travelers garantie du Canada (Travelers). Elle souhaite obtenir, notamment, une déclaration d’hypothèque légale et des dommages-intérêts pour une somme de 1 788 863,39 $. HMI, SEBJ et Travelers déposent alors une requête en irrecevabilité à l’encontre de cette procédure.
Le juge de première instance rejette les deux requêtes. La Cour d’appel renverse le jugement. Elle conclut que le premier juge ne pouvait décider que les biens situés au Camp d’Eastmain, qui appartiennent à Hydro-Québec, étaient saisissables. Elle accueille la requête en radiation de l’hypothèque légale. De plus, elle rejette la demande reconventionnelle dirigée contre HMI et SEBJ puisque ces personnes n’ont présenté aucune demande contre Kay-Bek en première instance.

The Applicant, George Minde, was the Chief of the Ermineskin Cree Nation. Relying on a previous resolution modifying the composition and quorum of the Elders Council, nine Elders were selected to sit as members of the Elders Council to investigate into alleged improprieties by Minde in a transaction involving Ermineskin Cree Nation funds. Notices to appear before the Elders Council were sent to Minde throughout this investigation but there was no evidence that Minde responded to the communications. On October 31, 2005, the appointed members gave Minde notice that he had vacated his office as Chief. On December 4, 2005, at a special meeting of the Tribal Council to which Minde did not receive notice and did not attend, a resolution was passed by the Ermineskin Tribal Council that Minde had vacated his office as Chief. On January 20, 2006, Minde sought judicial review of the December 4 Band Council Resolution. Justice Lemieux of the Federal Court granted Minde’s judicial review application and quashed the December 4 Band Council Resolution. The Federal Court of Appeal allowed the appeal, set aside Justice Lemieux’s decision and dismissed Minde’s judicial review application.

RÉSUMÉ DE L’AFFAIRE
Droit administratif - Contrôle judiciaire - Droit des autochtones - Autonomie gouvernementale - Constitution et règlements du système tribal d’Ermineskin - Pouvoirs - Conseil tribal - Conseil des anciens - Opérations financières irrégulières reprochées au chef -Résolution de destitution du chef - Lorsque la Cour fédérale divise ses deux décisions sur le fond en deux ordonnances distinctes délivrées à deux moments différents, quand expire le délai d’appel de la première décision sur le fond en vertu de la Loi sur les Cours fédérales ?- Est-il loisible à une partie à une action de soutenir une thèse devant une cour sur laquelle une décision est fondée et d’adopter une thèse contraire devant une autre cour sur laquelle une décision différente est fondée? - Lorsqu’une bande autochtone est régie par une constitution et des règlements, la procédure qui permet la modification de la constitution et des règlements revêt-elle un caractère obligatoire ou indicatif? - Quelle nature et quelle étendue doit avoir un pouvoir décisionnel pour qu’un organisme autochtone désigné soit considéré comme un « office fédéral » au sens de la Loi sur les Cours fédérales ? - La Cour d’appel fédérale a-t-elle eu tort de ne pas reconnaître que les causes expresses de destitution du demandeur n’existaient pas en l’espèce, si bien que l’identité du décideur n’avait aucune importance?
Le demandeur, George Minde, était le chef de la Nation crie d’Ermineskin. S’appuyant sur une résolution précédente qui modifiait la composition et le quorum du Conseil des anciens, neuf anciens ont été choisis pour siéger comme membres du Conseil des anciens afin d’enquêter sur des irrégularités reprochées à M. Minde relativement à une opération engageant des fonds de la Nation crie d’Ermineskin. Des avis de convocation devant le Conseil des anciens ont été envoyés à M. Minde tout au long de l’enquête mais rien n’indique que celui-ci a répondu aux communications. Le 31 octobre2005, les membres désignés ont informé M. Minde qu’il avait été démis de ses fonctions de chef. Le 4 décembre 2005, à une assemblée spéciale du Conseil tribal à laquelle M. Minde n’a pas été convoqué et n’a pas assisté, une résolution a été adoptée par le Conseil tribal d’Ermineskin comme quoi M. Minde avait été démis de ses fonctions de chef. Le 20 janvier 2006, M. Minde a demandé le contrôl judiciaire de la résolution du conseil de bande adoptée le 4 décembre. Le juge Lemieux de la Cour fédérale a accueilli la demande de contrôle judiciaire de M. Minde et a annulé la résolution du conseil de bande adoptée le 4 décembre. La Cour d’appel fédérale a accueilli l’appel, annulé la décision du juge Lemieux et rejeté la demande de contrôle judiciaire de M. Minde.
