The application for leave to appeal from the judgment of the Federal Court of Appeal, Number A‐208‐09, 2009 FCA 246, dated August 14, 2009, and the motion to stay the order fo the Federal Court of Appeal and to expedite the hearing of the appeal are granted without costs. The appeal is to be heard on November 13, 2009, and the schedule for serving and filing the material and any application for leave to intervene shall be set by the Registrar.
La demande d’autorisation d’appel de l’arrêt de la Cour d’appel fédérale, numéro A‐208‐09, 2009 CAF 246, daté du 14 août 2009, ainsi que la requête en sursis de l’ordonnance de la Cour d’appel fédérale et en vue d’accélérer l’audition de l’appel sont accordées sans dépens. Cet appel sera entendu le 13 novembre 2009 et l’échéancier pour la signification et le dépôt des documents et pour toute requête en intervention sera fixé par le registraire.
CASE SUMMARY
Constitutional law - Charter of Rights - Right to life, liberty and security of person - Fundamental justice - Remedy - Crown prerogative in matters of foreign relations - Interviews conducted in Guantanamo Bay by Canadian officials who knew that Canadian child had been subjected to sleep deprivation techniques - Refusal of the Canadian Government to repatriate its national - Whether the lower courts could find that s. 7 of the Canadian Charter of Rights and Freedoms has been breached and that the breach was not justified under s. 1 - Whether the lower courts could find that the Government had a duty to protect its national - Whether it was open to the lower courts to order the Government to request the repatriation of its national.
Mr. Khadr, a Canadian citizen, was taken prisoner in Afghanistan when he was 15 years old and has been detained by U.S. Forces since 2002 at Guantanamo Bay, Cuba, where he is currently facing murder and other terrorism‐related charges. During his detention, Mr. Khadr was given no special status as a minor. He was not allowed to communicate with anyone outside Guantanamo Bay until November 2004, when he met with legal counsel for the first time. The Canadian Government has asked, through diplomatic channels, for consular access and other assurances, but it is its policy not to request his repatriation until the conclusion of the prosecution. In 2003, Canadian officials questioned Mr. Khadr, still a minor, at Guantanamo Bay, with respect to matters connected to the charges he is now facing, and shared the product of these interviews with U.S. authorities. In 2006, after formal charges were laid against him, Mr. Khadr sought disclosure in Canada of, notably, the records of the interviews conducted at Guantanamo Bay. The Supreme Court of Canada ordered the disclosure. After the information was disclosed, it became clear that when the officials interviewed Mr. Khadr, they were aware that he had been subjected to a form of sleep-deprivation, known as the “frequent flyer program”, to make him more amenable and willing to talk.
Mr. Khadr asked the Canadian Government to repatriate him, but to no avail. He sought judicial review of the policy and decision of the Canadian Government not to seek his repatriation.

Monsieur Khadr, un citoyen canadien fait prisonnier en Afghanistan à l’âge de 15 ans, est détenu depuis 2002 par les forces américaines à Guantanamo Bay (Cuba), où il est actuellement accusé de meurtre et d’autres actes liés au terrorisme. Pendant sa détention, M. Khadr n’a pas bénéficié d’un traitement spécial en qualité de mineur. Il n’a pas été autorisé à communiquer avec quiconque à l’extérieur de Guantanamo Bay avant novembre 2004, lorsqu’il a rencontré un avocat pour la première fois. Le gouvernement canadien a utilisé les voies diplomatiques pour demander que des représentants consulaires lui rendent visite et pour obtenir d’autres assurances, mais il a pour politique de ne pas demander son rapatriement avant la conclusion de la poursuite. En 2003, des responsables canadiens ont interrogé M. Khadr, encore mineur, à Guantanamo Bay, sur des sujets liés aux accusations qui pèsent aujourd’hui contre lui et ils ont relayé l’information recueillie aux autorités américaines. En 2006, après le dépôt officiel des accusations contre lui, M. Khadr a demandé la communication de documents au Canada, dont ceux relatifs à l’interrogatoire mené à Guantanamo Bay. La Cour suprême du Canada a ordonné la communication. Ces documents divulgués, il est devenu évident que les responsables canadiens savaient, au moment où ils ont interrogé M. Khadr, qu’il avait été soumis au « programme grand voyageur », une forme de privation de sommeil visant à le rendre mieux disposé et plus enclin à faire des déclarations.
Monsieur Khadr a demandé en vain au gouvernement canadien de le rapatrier. Il a demandé le contrôle judiciaire de la politique et de la décision du gouvernement de ne pas demander son rapatriement.
