NCJ Educational Services Limited (“NCJ”) provides educational services such as tutoring by retaining approximately twenty tutors a year in various fields of academic study. Its clients are parents of students from elementary school, high school, CÉGEP and university. NCJ’s service operates out of a tutoring hall in Westmount, Quebec, consisting of a single room commercial space that can accommodate up to fifty people. At the end of the 2004/2005 school year, one of the tutors ceased working for NCJ and requested employment insurance benefits. The Minister of National Revenue determined that the services provided by seven of NCJ’s workers constituted insurable employment within the meaning of the Employment Insurance Act, S.C. 1996, c. 23, during the 2004, 2005 and 2006 calendar years. The Tax Court dismissed the appeals from the Minister’s determinations. The Federal Court of Appeal dismissed the appeal.

NCJ Educational Services Limited (« NCJ ») offre des services éducatifs, notamment du tutorat, en retenant les services d’environ vingt tuteurs par année dans divers domaines d’enseignement. In 1990, Albert Duterville was convicted of second degree murder. From that time on, he repeatedly brought legal proceedings complaining of persecution by the Correctional Service of Canada. The Applicant Construction et Démolition Deschênes (“contractor”) built an immovable for the Respondent Ateliers Non‑Tech (“client”) under a “turnkey” contract. During the work, the client paid the contractor part of the agreed price. At the end of the work, the client accepted the immovable with reservations pursuant to art. 2110, para. 2 C.C.Q. because of some apparent defects, and did not pay the balance of the agreed price. Having registered a hypothec on its client’s immovable, the contractor brought a hypothecary action for forced surrender to have the immovable sold by judicial authority. In response, the client filed an amended defence alleging that the immovable had apparent construction defects. The client’s defence also included an implied cross demand concerning certain latent defects it had discovered after accepting the immovable. An expert was later appointed under art. 2112 C.C.Q. to determine the amount the client was entitled to deduct because of the apparent construction defects. A few months later, without any other form of trial, the Superior Court allowed an [translation] “Inscription for judgment following the report of engineer Claude Trempe” (the expert) filed by the contractor in its hypothecary action against its client. The court ordered the client to pay the contractor $58,070.18. The Court of Appeal allowed the appeal.

La demanderesse Construction et Démolition Deschênes (« entrepreneur ») a construit un immeuble pour l’intimée Ateliers Non‑Tech (« cliente ») aux termes d’un contrat « clef en main ». En cours des travaux, la cliente a versé à l’entrepreneur une partie du prix convenu. À la fin des travaux, la cliente a reçu l’immeuble avec réserves en vertu de l’art. 2110, al. 2 C.c.Q., vu certains défauts apparents, et elle n’a pas payé le solde du prix fixé. Ayant inscrit une hypothèque sur l’immeuble de sa cliente, l’entrepreneur a intenté une action hypothécaire en délaissement forcé pour vente sous contrôle de justice. En réponse, la cliente a produit une défense amendée dans laquelle elle a allégué que l’immeuble était affecté de défauts de construction apparents. Cette dernière a également déposé dans cette défense une demande reconventionnelle implicite afférente à certains vices cachés qu’elle avait découverts postérieurement à sa réception de l’immeuble. Par la suite, un expert chargé d’établir le montant que la cliente avait le droit de retenir en raison des défauts de construction apparents a été nommé en vertu de l’art. 2112 C.c.Q. Quelques mois plus tard, sans autre forme de procès, la Cour supérieure a fait droit à une « Inscription pour jugement suivant le rapport de monsieur Claude Trempe, ingénieur [expert] » produite par l’entrepreneur dans le cadre de son action hypothécaire contre sa cliente, et la cour a ordonné à cette dernière de payer à l’entrepreneur la somme de 58 070, 18 $. La Cour d’appel a accueilli l’appel.

Charter of Rights ‑ Criminal law ‑ Search and seizure ‑ Search warrants ‑ General search warrant permitting police to enter commercial unit rented by accused over 59‑day period ‑ Accused convicted of producing and possessing ecstasy for the purpose of trafficking ‑ Whether right of the accused to protection against unreasonable search and seizure under s. 8 of the Charter was violated ‑ Whether “sneak and peaks” and “confirm or deny” entries and searches of private property constitute an “investigative technique” within the meaning of s. 487.01 of the Criminal Code ‑ Meaning of s. 487.01(1)(b) which requires that the issuing judge be satisfied that “it is in the best interests of the administration of justice to issue the warrant” ‑ Meaning of s. 487.01(1)(c) which requires that there be “no other provision” in the Code or any other Act of Parliament that “would provide for a warrant, authorization or order permitting the technique, procedure or device” sought by the police - Canadian Charter of Rights and Freedoms, s. 8.
Ha was convicted of the production and possession of ecstasy for the purpose of trafficking, contrary to ss. 5(3)(b) and 7(2)(c) of the Controlled Drugs and Substances Act, S.C. 1996, c. 19, and sentenced to a period of incarceration of 4 years and 98 days. Police surveillance of Ha conducted over the course of several months revealed that he had been purchasing the ingredients to produce ecstasy in large quantities and bringing boxes to self‑storage facilities located in Ottawa. The police applied for a “general” search warrant under s. 487.01 of the Criminal Code, which are distinguishable from traditional search warrants, to permit them to enter Ha’s rented commercial and self‑storage facilities to obtain evidence that the chemicals he purchased were present; that these were being used to produce ecstasy or other controlled substances; to confirm the stage of production of the lab and the process which were being followed; to obtain samples of the chemicals found; to identify Ha’s accomplices; and to identify assets which constitute proceeds of crime. The warrant was issued under s. 487.01, permitting the police to covertly enter the premises on four occasions over a two-month period. They found evidence of the production of pills and traces of ecstasy. The police then obtained a telewarrant to search Ha’s home, where they discovered invoices for chemical purchases, information pertaining to the production of ecstasy, and some ecstasy pills. The police then entered the self‑storage facility on January 8, 2003, and seized chemicals, equipment, ecstasy pills and powder valued at $20 million. During his trial, Ha applied for an order excluding from evidence all observations made and items seized as well as any forensic examination of those items. He challenged the evidence obtained pursuant to the warrant, alleging that the information on which it was based contained material errors and discrepancies.

Monsieur Ha a été déclaré coupable de production et de possession d’ecstasy en vue d’en faire le trafic, contrairement aux al. 5(3) b et 7(2) c) de la Loi réglementant certaines drogues et autres substances, L.C. 1996, ch. 19, et condamné à une période d’incarcération de quatre ans et 98 jours. La surveillance policière de M. Ha, effectuée sur plusieurs mois, a révélé qu’il avait acheté les ingrédients pour produire de l’ecstasy en grandes quantités et qu’il apportait des boîtes à des installations de stockage en libre-service situées à Ottawa. Les policiers ont demandé un mandat de perquisition « général » en vertu de l’art. 487.01 du Code criminel, qui se distingue des mandats de perquisition classiques, pour leur permettre d’entrer dans les installations commerciales et de stockage libre-service louées par M. Ha afin d’obtenir la preuve que les produits chimiques qu’il avait achetés s’y trouvaient et qu’ils étaient utilisés pour produire de l’ecstasy ou d’autres substances réglementées, pour confirmer l’étape de production du laboratoire et le procédé suivi, pour obtenir des échantillons de produits chimiques trouvés, pour identifier les complices de M. Ha et pour identifier les biens qui constituaient les produits de la criminalité. Le mandat a été décerné en vertu de l’art. 487.01, ce qui permettait aux policiers d’entrer secrètement dans les locaux à quatre occasions sur une période de deux mois. Ils ont trouvé des éléments de preuve de production de pilules et des traces d’ecstasy. Les policiers ont ensuite obtenu un télémandat pour perquisitionner la maison de M. Ha où ils ont découvert des factures d’achats de produits chimiques, des renseignements sur la production d’ecstasy et quelques pilules d’ecstasy. Les policiers sont ensuite entrés dans l’installation de stockage libre-service le 8 janvier 2003 et ont saisi des produits chimiques, de l’équipement, des pilules et de la poudre d’ecstasy évalués à 20 millions de dollars. Pendant son procès, M. Ha a présenté une demande d’exclusion de la preuve relative à toutes les observations faites, tous les articles saisis et toute expertise judiciaire de ces articles. Il a contesté les éléments de preuve obtenus en vertu du mandat, alléguant que les renseignements sur lesquels il était fondé renfermaient des erreurs et des divergences importantes.

This application for leave to appeal by the Applicant, The House of Holy God, stems from a notice of intention to revoke its charitable registration under the Income Tax Act that was given by the Minister of National Revenue to the Applicant on July 3, 2007.
On September 24, 2007, the Applicant filed a notice of objection to the notice of intent to revoke. By notice of confirmation dated August 22, 2008, the Minister confirmed the notice of intent to revoke. The Federal Court of Appeal dismissed the Applicant’s appeal and found that the decision of the Minister in the notice to revoke was justified.

Jusqu’en 2008, les parents avaient toujours été capables de convenir du partage des responsabilités parentales; en effet, les parties avaient convenu que l’enfant résiderait avec l’intimé une fin semaine sur deux, quelques jours à Noël et une semaine à l’été. Depuis, la communication entre les parties s’est détériorée. La demanderesse cherche la garde exclusive de l’enfant, alors que l’intimé demande une garde partagée.
