In its judgment rendered on May 22, 2003 dismissing the leave application, the Court awarded costs to the respondent. Having reviewed the response to the leave application and the bill of costs filed by the respondent, I noted that it had photocopied four Supreme Court cases in their entirety. In doing so, the respondent did not comply with its duty to minimize costs. Therefore, fees under item1(e) of the Tariff of Fees, Part I, and disbursements under item 2, Par II, will be calculated on the basis of 138 pages.
The Bill of Costs is taxed accordingly.
Dans son jugement rendu le 22 mai 2003, dans lequel elle a rejeté la demande d’autorisation, la Cour a accordé les frais à la défenderesse. Après examen de la réponse à la demande d’autorisation et du mémoire de frais déposé par la défenderesse, j’ai noté que celle‑ci avait photocopié intégralement quatre arrêts de la Cour suprême. Ce faisant, la défenderesse ne s’est pas acquittée de son obligation de minimiser les dépens. En conséquence, le nombre de pages sera fixé à 138 pour ce qui est du calcul des frais relatifs au poste 1e) du Tarif d’honoraires, partie I, et des débours relatifs au poste 2, partie II.
Le mémoire de frais est taxé en conséquence.

In its judgment rendered on March 20, 2003, the Court awarded costs the respondents who filed their Bill of Costs on April 10, 2003. The appellant filed its objections on April 21, 2003. Having reviewed the arguments advanced by the parties and the litigious items, I am taxing the costs as follows:
- Preparation of factum (Tariff of Fees, Part I, item 3(d)(i)): The Tariff provides that the amount of $425 for the preparation of a factum “is subject to increase, in special cases, at the discretion of the Registrar.” The respondents argue that the present case is a special case in view of the lengthy allegations of the appellant covering events over a period of ten years. However, the Court awarded party and party costs. The registrar must exercise her discretion within the bounds set by the Tariff of Fees, however inadequate they may appear. The amount claimed by the respondents cannot be accepted in this context.
- Hearing of the appeal (Tariff of Fees, Part I, item 3(g)): the same reasoning applies and the amounts applicable are those provided for in the Tariff of Fees: $1,800 for attendance at the hearing and $600 for the junior counsel.
- Disbursements: The amount claimed for Quicklaw ($570) is disallowed as searches are part of the preparation of a file and are already covered under preparation of factum.
The Bill of Costs is taxed accordingly.
Dans son jugement rendu le 20 mars 2003, la Cour a accordé les frais aux intimés, qui ont déposé leur mémoire de frais le 10 avril 2003. L’appelante a déposé ses objections le 21 avril 2003. Après examen des postes litigieux et des arguments avancés par les parties, j’établis la taxation suivante :
- Rédaction du mémoire (Tarif d’honoraires, partie I, poste 3d)(i)) : Le tarif précise que la somme de 425 $ prévue pour la rédaction du mémoire « peut faire l’objet d’une majoration dans des circonstances spéciales, à la discrétion du registraire ». Les intimés prétendent que nous sommes en présence de circonstances spéciales en raison des très longues allégations de l’appelante, qui visent une période de dix ans. Cependant, la Cour a accordé les dépens entre parties. La registraire doit exercer son pouvoir discrétionnaire dans les limites établies par le Tarif d’honoraires, aussi inadéquates qu’elles puissent paraître. La somme réclamée par les intimés ne peut être acceptée en l’espèce.
- Audition de l’appel (Tarif d’honoraires, partie I, poste 3g)) : Le même raisonnement s’applique et les sommes applicables sont celles prévues par le Tarif d’honoraires : 1 800 $ pour la comparution à l’audience et 600 $ pour un procureur adjoint.
1. Débours : La somme réclamée pour Quicklaw (570 $) est refusée parce que les recherches constituent un aspect de la préparation du dossier et qu’elles sont déjà visées sous la rubrique rédaction du mémoire.
Le mémoire de frais est taxé en conséquence.

La Cour suprême a rejeté la demande d’autorisation d’appel avec dépens le 27 mars 2003. L’intimé a déposé son mémoire de frais le 25 avril 2003.
Ayant examiné la réponse à la demande d’autorisation et le mémoire de frais de l’intimé, je constate que la réponse comprend huit volumes, pour un total de 1562 pages. Or, comme je l’ai dit dans l’affaire 1560036 Canada Inc. c. Les Pétroles Therrien Inc. (Qué.) 27158, Bulletin des procédures de la Cour suprême du Canada, 7 avril 2000, p. 620. : “Il est bien établi que les parties doivent minimiser les frais dans toute la mesure du possible, en particulier en ce qui a trait à la reproduction extensive des témoignages, de la jurisprudence et d’autres autorités”. En conséquence, le nombre de pages sera réduit à l’équivalent de deux volumes, soit 400 pages.
Au titre de l’article 1e) de la partie I du Tarif des honoraires et débours, l’intimé a droit aux honoraires calculés en fonction du nombre de pages de la réponse réduit ci-dessus. Au titre des débours, l’intimé a droit au montant calculé en fonction du nombre de pages de la réponse réduit ci-dessus et n’a pas droit au montant réclamé relativement à la demande d’autorisation. Je confirme les autres éléments du mémoire de frais.
Les dépens sont taxés en conséquence.
The Supreme Court dismissed the application for leave to appeal with costs on March 27, 2003. The respondent filed his bill of costs on April 25, 2003.
I have examined the respondent’s response on the application for leave and the respondent’s bill of costs, and note that the response consists of eight books and totals 1,562 pages in length. As I stated in 1560036 Canada Inc. v. Les Pétroles Therrien Inc. (Que.) 27158, Bulletin of Proceedings of the Supreme Court of Canada, April 7, 2000, at p. 620: “It is well established that the parties must do their utmost to minimize costs, in particular with regard to the extensive reproduction of testimony, case law and other authorities.”Consequently, the number of pages will be reduced to 400, which is equivalent to two books.
Under section 1(e) of Part I of the Tariff of Fees and Disbursements, the respondent is entitled to a fee based on the number of pages in the response as reduced above. As far as disbursements are concerned, the respondent is entitled to an amount based on the number of pages of the response as reduced above, and is not entitled to the amount claimed for the application for leave. I affirm the other elements of the bill of costs.
The costs are taxed accordingly.

The Fall Session of the Supreme Court of Canada will commence October 6, 2003.
Pursuant to the Supreme Court Act and Rules, the following requirements for filing must be complied with before an appeal can be heard:
Appellant’s record; appellant’s factum; and appellant’s book(s) of authorities must be filed within 12 weeks of the filing of the notice of appeal or 12 weeks from decision on the motion to state a constitutional question.
Respondent’s record (if any); respondent’s factum; and respondent’s book(s) of authorities must be filed within eight weeks after the service of the appellant's documents.
Intervener's factum and intervener’s book(s) of authorities, (if any), must be filed within eight weeks of the order granting leave to intervene or within 20 weeks of the filing of a notice of intervention under subrule 61(4).
Parties’ condensed book, if required, must be filed on the day of hearing of the appeal.
The Registrar shall enter the appeal on a list of cases to be heard after the respondent’s factum is filed or at the end of the eight-week period referred to in Rule 36. |

Conformément à la Loi sur la Cour suprême et aux Règles, il faut se conformer aux exigences suivantes avant qu'un appel puisse être entendu:
