UPON APPLICATION for Directions by the Governor in Council to obtain an order (1) directing the Registrar to enter this reference on the list of cases to be heard by the Court; (2) appointing an amicus curiae to have carriage of the reference to argue the case against the proposed legislation, and allowing the amicus curiae to seek further directions on the conduct of the reference; (3) directing that the amicus curiae be paid reasonable expenses occasioned by participation in the reference in accordance with s. 53(7) of the Supreme Court Act; (4) directing the Attorney General of Canada to serve a copy of the Notice of Reference and a copy of the Order for Directions on the parties and interveners in the cases before the British Columbia, Ontario and Quebec courts involving a challenge to the opposite-sex requirement for marriage; and (5) directing those served with copies of the Notice of Reference and the Order for Directions who wish to intervene in the reference to make a motion for intervention within 4 weeks of service on them of the Notice of Reference and Order for Directions;
HAVING READ the material filed;
IT IS HEREBY ORDERED THAT:
1. The Registrar is directed to enter this reference on the list of cases to be heard by the Court;
2. The request to appoint an amicus curiae to have carriage of this reference is refused. The Attorney General of Canada is ordered to have carriage of this reference and shall file documents as required for an appellant by the Rules of the Supreme Court of Canada. Notwithstanding this, the Court may at any time decide to appoint an amicus curiae to argue the case with respect to any interest that is affected by this reference and with respect to which counsel does not appear pursuant to the provisions of s. 53(7) of the Supreme Court Act.
3. In view of paragraph 2 of this Order for Directions, the request for directions for the payment of the expenses of an amicus curiae does not need to be decided at this time.
4. Paragraph (4) of the motion is refused. The Attorney General of Canada is directed to serve a copy of the Notice of Reference and a copy of this Order for Directions on the Attorneys General of the each of the provinces and the Ministers of Justice of the governments of the territories.
5. Paragraph (5) of the motion is refused. The relevant provisions of the Supreme Court Act and the Rules of the Supreme Court of Canada shall govern interventions in this reference.
À LA SUITE D’UNE DEMANDE de directives présentée par le Gouverneur en conseil en vue d’obtenir une ordonnance (1) enjoignant au registraire d’inscrire le renvoi au rôle; (2) nommant un amicus curiae responsable de la conduite du renvoi pour qu’il présente une argumentation contre la législation proposée, et permettant à l’amicus curiae de demander des directives plus précises sur le déroulement du renvoi; (3) ordonnant le paiement à l’amicus curiae des frais raisonnables entraînés par sa participation au renvoi conformément au par. 53(7) de la Loi sur la Cour suprême; (4) enjoignant au procureur général du Canada de signifier une copie de l’Avis de renvoi et une copie de l’Ordonnance tranchant la demande de directives aux parties et intervenants dans les instances engagées devant les tribunaux de la Colombie-Britannique, de l’Ontario et du Québec qui soulèvent la validité de la condition selon laquelle seules deux personnes de sexe différent peuvent se marier; et (5) enjoignant aux personnes qui ont reçu signification de l’Avis de renvoi et de l’Ordonnance tranchant la demande de directives et qui souhaitent intervenir de présenter une requête en intervention dans un délai de quatre semaines après avoir reçu signification de l’Avis de renvoi et de l’Ordonnance tranchant la demande de directives;
APRÈS EXAMEN des documents déposés;
IL EST ORDONNÉ CE QUI SUIT :
1. Le registraire inscrira le renvoi au rôle.
2. La demande de nomination d’un amicus curiae responsable de la conduite du renvoi est rejetée. Le procureur général du Canada sera responsable de la conduite du renvoi et déposera les documents qu’un appelant doit déposer en vertu des Règles de la Cour suprême du Canada. La Cour pourra néanmoins décider, à n’importe quel moment, par application du par. 53(7) de la Loi sur la Cour suprême, de nommer un amicus curiae relativement à un intérêt auquel le renvoi porte atteinte, en l’absence de toute autre représentation.
3. Eu égard au paragraphe 2 de la présente ordonnance, il n’est pas nécessaire de trancher maintenant la demande de directives concernant le paiement des frais d’un amicus curiae.
4. La demande formulée au paragraphe (4) est rejetée. Le procureur général du Canada signifiera une copie de l’Avis de renvoi et de l’Ordonnance tranchant la demande de directives au procureur général de chaque province et au ministre de la Justice du gouvernement de chaque territoire.
5. La demande formulée au paragraphe (5) est rejetée. Les dispositions pertinentes de la Loi sur la Cour suprême et des Règles de la Cour suprême du Canada régiront les interventions dans le présent renvoi.

The Fall Session of the Supreme Court of Canada will commence October 6, 2003.
Pursuant to the Supreme Court Act and Rules, the following requirements for filing must be complied with before an appeal can be heard:
Appellant’s record; appellant’s factum; and appellant’s book(s) of authorities must be filed within 12 weeks of the filing of the notice of appeal or 12 weeks from decision on the motion to state a constitutional question.
Respondent’s record (if any); respondent’s factum; and respondent’s book(s) of authorities must be filed within eight weeks after the service of the appellant's documents.
Intervener's factum and intervener’s book(s) of authorities, (if any), must be filed within eight weeks of the order granting leave to intervene or within 20 weeks of the filing of a notice of intervention under subrule 61(4).
Parties’ condensed book, if required, must be filed on the day of hearing of the appeal.
The Registrar shall enter the appeal on a list of cases to be heard after the respondent’s factum is filed or at the end of the eight-week period referred to in Rule 36. |

La session d’ automne de la Cour suprême du Canada commencera le 6 octobre 2003.
Conformément à la Loi sur la Cour suprême et aux Règles, il faut se conformer aux exigences suivantes avant qu'un appel puisse être entendu:
Le dossier de l’appelant, son mémoire et son recueil de jurisprudence et de doctrine doivent être déposés dans les douze semaines du dépôt de l’avis d’appel ou douze semaines de la décision de la requête pour formulation d’une question constitutionnelle.
Le dossier de l’intimé (le cas échéant), son mémoire et son recueil de jurisprudence et de doctrine doivent être déposés dans les huit semaines suivant la signification des documents de l’appelant.
Le mémoire de l'intervenant et son recueil de jurisprudence et de doctrine, le cas échéant, doivent être déposés dans les huit semaines suivant l’ordonnance autorisant l’intervention ou dans les vingt semaines suivant le dépôt de l’avis d’intervention visé au paragraphe 61(4).
Le recueil condensé des parties, le cas échéant, doivent être déposés le jour de l’audition de l’appel.
Le registraire inscrit l’appel pour audition après le dépôt du mémoire de l’intimé ou à l’expiration du délai de huit semaines prévu à la règle 36. |
