Registrar advising the Attorney General of Alberta by letter dated June 6, 2003.
I refer to your motion requesting reconsideration of the order of Mr. Justice Major, dated May 20, 2003, which denied the Attorney General of Alberta the opportunity to present oral submissions at the hearing of the appeal, and requesting that the Attorney General of Alberta be authorized to make submissions at the hearing of this appeal.
Under Rule 75 of the Rules of the Supreme Court of Canada, there is no reconsideration of motions. Accordingly, the Chief Justice declined to address your motion.
Nevertheless, Mr. Justice Major has read the materials submitted in support of your motion, and concluded that there was no reason justifying a change in his order of May 20, 2003.
The larger concerns raised in your motion with respect to the practices of the Court in authorizing oral arguments from interveners are matters for consideration in consultation with the Canadian Bar Association Liaison Committee.

Je réponds par la présente à la requête dans laquelle vous demandez que la Cour réexamine l’ordonnance rendue par le juge Major, le 20 mai 2003, refusant au procureur général du Québec l’autorisation de présenter une plaidoirie orale à l’audition de l’appel, et qu’elle autorise le procureur général du Québec à présenter des observations à l’audition de l’appel.
Selon la règle 75 des Règles de la Cour suprême du Canada, aucune requête ne peut faire l'objet d'un réexamen. Pour cette raison, la Juge en chef a refusé d’examiner votre requête.
Le juge Major a néanmoins pris connaissance des documents que vous avez soumis à l’appui de votre requête et il a conclu qu’aucun motif ne justifiait la modification de son ordonnance du 20 mai 2003.
Les préoccupations plus générales soulevées dans votre requête quant aux pratiques de la Cour d’autoriser les intervenants à présenter une plaidoirie orale sont des questions à considérer en collaboration avec le Comité de liaison de l’Association du Barreau canadien.

The Spring Session of the Supreme Court of Canada started April 7, 2003.
The Supreme Court of Canada has enacted new rules that came into force on June 28, 2002.
Pursuant to the Supreme Court Act and Rules, the following requirements for filing must be complied with before an appeal can be heard:
1) For notices of appeal filed on and after June 28, 2002
Appellant’s record; appellant’s factum; and appellant’s book(s) of authorities must be filed within 12 weeks of the filing of the notice of appeal or 12 weeks from decision on the motion to state a constitutional question.
Respondent’s record (if any); respondent’s factum; and respondent’s book(s) of authorities must be filed within eight weeks after the service of the appellant's documents.
Intervener's factum and intervener’s book(s) of authorities, (if any), must be filed within eight weeks of the order granting leave to intervene or within 20 weeks of the filing of a notice of intervention under subrule 61(4).
Parties’ condensed book, if required, must be filed on the day of hearing of the appeal.
2) For notices of appeal filed before June 28, 2002
Appellant’s record; appellant’s factum; and appellant’s book(s) of authorities must be filed within four months of the filing of the notice of appeal.
