Criminal Law ‑ Offences ‑ Elements of offence ‑ Sexual assault ‑ Whether the Court of Appeal erred in concluding that the respondent’s low viral count or use of condoms meant that his failure to disclose his HIV‑positive status before sexual intercourse did not place the complainants at a significant risk of serious bodily harm.
The respondent was charged with ten counts of aggravated sexual assault (and other charges) because he had sex with different complainants without disclosing that he was HIV‑positive. An expert opined that antiretroviral therapy during the relevant time period reduced the respondent’s viral load such that the risk of transmission of HIV was probably low but possible during part of the relevant time period and that there was a very high probability that the respondent was not infectious during the remainder of the relevant time. The respondent also used condoms in some incidents. None of the complainants have contracted HIV. The trial judge convicted the respondent of aggravated sexual assault on six charges because no condom was used, without considering the respondent’s viral loads. The trial judge acquitted the respondent of aggravated sexual assault if a condom was used and viral loads were undetectable at the time of the assaults. The Court of Appeal set aside four of the six convictions and entered acquittals on the basis that sexual intercourse either using a condom or when viral loads are very low does not place a sexual partner at significant risk of serious bodily harm.

Droit criminel ‑ Infractions ‑ Éléments de l’infraction ‑ Agression sexuelle ‑ La Cour d’appel a t elle commis une erreur en concluant que, vu les faibles charges virales de l’intimé ou l’utilisation de condoms, son omission de déclarer qu’il était séropositif pour le HIV avant d’avoir des rapports sexuels n’a pas eu pour effet d’exposer les plaignantes à un risque élevé de préjudice corporel grave?
L’intimé a été accusé de dix chefs d’accusation d’agression sexuelle grave (ainsi que d’autres chefs d’accusation) parce qu’il a eu des rapports sexuels avec différentes plaignantes sans leur dire qu’il était séropositif pour le VIH. Un expert a affirmé qu’une thérapie antirétrovirale administrée au cours de la période de temps pertinente avait diminué la charge virale de l’intimé de sorte que le risque de transmission du VIH, bien qu’étant probablement faible, était possible au cours d’une partie de la période de temps pertinente et qu’il y avait une forte probabilité que l’intimé n’était pas contagieux au cours du reste de la période pertinente. L’intimé a utilisé des condoms dans certains cas. Aucune des plaignantes n’a contracté le VIH. La juge de première instance a déclaré l’intimé coupable de six chefs d’accusation d’agression sexuelle grave parce qu’il n’avait utilisé aucun condom, et ce, sans tenir compte de ses charges virales. La juge de première instance a acquitté l’intimé de l’accusation d’agression sexuelle grave dans les cas où celui ci avait utilisé un condom et qu’aucune charge virale n’avait été détectée au moment des agressions. La Cour d’appel a annulé quatre des six déclarations de culpabilité et a inscrit des verdicts d’acquittement au motif qu’une personne qui a des rapports sexuels en utilisant un condom ou lorsque ses charges virales sont faibles n’expose pas un partenaire sexuel à un risque de préjudice corporel grave.

The respondent, D.C., who was HIV‑positive at the time, had unprotected sex with her former spouse without first informing him of her medical condition. D.C. was convicted of sexual assault and aggravated assault on her former spouse. The Court of Appeal acquitted her on the basis that, since her viral load had been undetectable during the entire period covered by the charges and the risk of transmission had therefore been very low, the fact that she had not disclosed her HIV‑positive condition had not had the effect of exposing her former spouse to “a significant risk of serious harm” within the meaning of R. v. Cuerrier, [1998] 2 S.C.R. 371.

Alors séropositive, D.C., intimée, a une relation sexuelle non protégée avec son ex‑conjoint sans l’avoir informé au préalable de sa condition médicale. D.C. est déclarée coupable d’agression sexuelle et de voies de fait graves contre son ex‑conjoint. La Cour d’appel acquitte D.C. au motif que puisque sa charge virale était indétectable pendant toute la période visée par les chefs d’accusation et donc que le risque de transmission était très faible, le fait pour D.C. de ne pas avoir dévoilé qu’elle était porteuse du VIH n’a pas eu pour effet d’exposer son ex‑conjoint à « un risque important de préjudice grave » au sens de l’arrêt R. c. The appellant unions and associations representing federal government employees, the RCMP and armed forces personnel brought actions against the government seeking an order requiring the government to return over $28 billion to their pension plans. They alleged that the money had been improperly taken by way of contribution holidays and/or withdrawal of surplus. The plans are mandatory, contributory, defined benefit pension plans and the same in all aspects relevant to the proceedings. Their terms are not subject to collective bargaining or to the Pension Benefits Standards Act, 1985, R.S.C. 1985, c. 32 (2nd Supp.). Two relevant dates exist: (1) the period up to and including March 31, 2000 which precedes the coming into force of Bill C‑78 (the legislation amending the Superannuation Acts and thus the plans); and, (2) the period after April 1, 2000 when Bill C‑78 came into effect.

Les syndicats et associations appelants, qui représentent des fonctionnaires fédéraux ainsi que le personnel de la GRC et des forces armées, ont intenté contre le gouvernement des actions dans lesquelles ils sollicitent une ordonnance enjoignant au gouvernement de rembourser plus de 28 milliards de dollars à leurs régimes de pension. Ils ont soutenu que les sommes avaient été recueillies irrégulièrement au moyen de périodes d’exonération de cotisations ou du retrait des surplus. Les régimes en l’espèce constituent des régimes contributifs obligatoires à prestations déterminées qui sont identiques à tous égards pertinents en l’espèce. Leurs modalités sont exclues de la négociation collective et de la Loi de 1985 sur les normes de prestation de pension, L.R.C. 1985, ch. 32 (2e suppl.). Deux périodes revêtent de l’importance : 1) la période se terminant le 31 mars 2000, la veille de l’entrée en vigueur du projet de loi C‑78 (la loi modifiant les lois sur les pensions et, partant, les régimes); et 2) la période postérieure au 1er avril 2000, la date d’entrée en vigueur du projet de loi C‑78.

Rapidz Baseball fielded a professional baseball team in the Can‑Am League during the 2008 season. The team played its home games in a stadium owned by the City of Ottawa. However, because of losses it had incurred during the season, Rapidz Baseball gave the League notice that it would be unable to operate beyond 2008. It applied under the League’s by‑laws to withdraw voluntarily because of financial hardship. The League’s Board of Directors rejected Rapidz Baseball’s application. Instead, they terminated its membership and drew down a $200,000 letter of credit Rapidz Baseball had been required to post under the by‑laws. Rapidz Baseball and its related companies sued the League and its principals, and the City of Ottawa, both in contract and tort. The League and its principals brought a motion under rule 21.01(3)(a) of the Rules of Civil Procedure to stay or dismiss the action on the ground that an Ontario court has no jurisdiction over the subject matter of the action. They relied on the choice of forum and arbitration clauses in the League’s by‑laws and in the agreements signed by the plaintiffs, under which the plaintiffs agreed that all disputes with the League would be resolved in the state of North Carolina and would be subject to arbitration.

Rapidz Baseball avait introduit une équipe de baseball professionnelle dans la Ligue Can‑Am au cours de la saison 2008. L’équipe a joué ses matchs à domicile dans un stade appartenant à la Ville d’Ottawa. Toutefois, en raison des pertes qu’elle a encourues au cours de la saison, Rapidz Baseball a prévenu la Ligue qu’elle serait incapable de fonctionner après 2008. Elle a demandé, en application des règlements de la Ligue, l’autorisation de se retirer volontairement en raison de difficultés financières. Le conseil d’administration de la Ligue a rejeté la demande de Rapidz Baseball. La Ligue a plutôt mis fin à la qualité de membre de Rapidz Baseball et a retiré, en vertu d’une lettre de crédit, un montant de 200 000 $ que Rapidz Baseball avait dû déposer en application des règlements. Rapidz Baseball et ses sociétés affiliées ont intenté une poursuite en responsabilité contractuelle et en responsabilité délictuelle contre la Ligue, ses dirigeants et la Ville d’Ottawa. La Ligue et ses dirigeants ont déposé une motion en application de l’alinéa 21.01(3)a) des Règles de procédure civile en vue d’obtenir un sursis ou un rejet de l’action au motif qu’un tribunal ontarien n’a pas compétence sur l’objet de l’action. Les demanderesses ont invoqué les dispositions des règlements de la Ligue et les ententes qu’elles ont conclues relativement au choix du tribunal et à l’arbitrage qui prévoient que tout conflit avec la Ligue sera réglé par arbitrage en Caroline du Nord.

On August 1, 2006, a tree collapsed on an automobile and killed Gabriel Anthony Rossy, who was in the automobile. The respondents, his parents and three brothers, then brought an action in extracontractual liability against the applicant City of Westmount. They alleged that the City had failed to maintain the tree, which it owned, and that it was liable on that basis. At the preliminary stage, the City moved to dismiss the action on the ground that the damage had been caused by an automobile and that compensation was therefore governed by the Automobile Insurance Act. The respondent Société de l’assurance automobile du Québec was impleaded.
The Superior Court allowed the City’s motion and dismissed the Rossy family’s action. Relying on Les Productions Pram inc. v. Lemay, [1992] R.J.Q. 1738 (C.A.), Reimnitz J. concluded that, since the Automobile Insurance Act should be given a large and liberal interpretation based on its social and compensatory nature, the accident was covered by the Act because it had resulted in “damage caused by an automobile” within the meaning of s. 1 of the Act. On appeal, the Court of Appeal set aside the decision. It noted that, on the face of the pleadings, it was established that the tree’s collapse was the sole cause of death and that there was nothing to connect the death with the fact that Mr. Rossy had been in an automobile. According to the Court, the automobile [translation] “was merely where [Mr. Rossy] was sitting when the tree collapsed” (para. 40). In short, the automobile [translation] “was not a factor in the accident or the damage resulting therefrom” (para. 42), which meant that the government compensation scheme did not apply in the circumstances.

Le 1er août 2006, un arbre s’abat sur l’automobile dans laquelle se trouve Gabriel Anthony Rossy et le tue. Les intimés, ses parents et ses trois frères, intentent alors une action en responsabilité extracontractuelle contre la Ville de Westmount demanderesse. Ils allèguent que la Ville a fait défaut d’entretenir l’arbre dont elle était propriétaire et qu’elle était responsable à ce titre. Au stade préliminaire, la Ville demande le rejet de l’action au motif que le préjudice avait été causé par une automobile et qu’en conséquence, l’indemnisation était régie par la Loi sur l’assurance automobile. La Société de l’assurance automobile du Québec intimée est mise en cause.
La Cour supérieure accueille la requête de la Ville et rejette l’action de la famille Rossy. S’appuyant sur l’arrêt Les Productions Pram inc. c. Lemay, [1992] R.J.Q. 1738 (C.A.), le juge Reimnitz conclut qu’au vu de l’interprétation large et libérale qu’il convient d’accorder à la Loi sur l’assurance automobile vu son caractère social et indemnitaire, l’accident était visé par celle‑ci car il en avait résulté un « préjudice causé par un automobile » au sens de l’art. 1 de cette Loi. En appel, la Cour d’appel infirme la décision. Elle note qu’au vu des procédures, il était établi que la cause unique du décès était la chute de l’arbre et que rien ne permettait de relier le décès au fait que M. Rossy était dans une automobile. Selon la Cour, l’automobile « ne constituait que l’habitacle où [M. Rossy] se trouvait lors de la chute de l’arbre » (par. 40). En somme, l’automobile « n’a pas été l’un des facteurs de l’accident et du préjudice qui en a découlé » (par. 42), de sorte que le régime étatique d’indemnisation ne s’applique pas dans les circonstances.

The respondent, T.L.M. was convicted of sexual assault, sexual interference and invitation to touch for a sexual purpose. He was the uncle, by marriage, of the complainant. She was 8 to 10 years old at the time of the alleged offences. In each instance, the offence was alleged to have occurred with only the complainant and T.L.M. present, although others were said to have been nearby on several occasions. The trial judge admitted as similar fact evidence an agreed statement of facts relating to T.L.M.’s prior conviction for sexual assault on another eight year old girl at her home. The trial judge found that it served to rebut the defences of innocent association and lack of opportunity, and bolstered the complainant’s credibility. The majority of the Court of Appeal allowed T.L.M.’s appeal and ordered a new trial. In its view, the trial judge erred in according undue probative value to the similar fact evidence in the context of the test for admissibility. Finding the trial judge’s decision to admit the evidence deserving of deference, and finding no error in his approach or analysis in doing so, Hoegg J.A., dissenting, would have dismissed the appeal.

L’intimé, T.L.M. a été déclaré coupable d’agression sexuelle, de contacts sexuels et d’incitation a des contacts sexuels. Il était l’oncle par alliance de la plaignante. Celle‑ci était âgée de 8 à 10 ans à l’époque des infractions alléguées. Dans chaque cas, l’infraction aurait été commise alors que seule la plaignante et T.L.M. étaient présents, même si d'autres personnes se trouvaient censément à proximité à plusieurs occasions. Le juge du procès a admis à titre de preuve de faits similaires un exposé conjoint des faits relatif à la déclaration de culpabilité antérieure de T.L.M. pour agression sexuelle commise sur une autre fillette âgée de huit ans à son domicile. Le juge du procès a conclu que cette preuve servait à réfuter les moyens de défense de rapports innocents et d’absence de possibilité et renforçait la crédibilité de la plaignante. Les juges majoritaires de la Cour d’appel ont accueilli l’appel de T.L.M. et ont ordonné la tenue d’un nouveau procès. À leur avis, le juge du procès avait eu tort d’accorder une valeur probante indue à la preuve de faits similaires dans le contexte du critère d’admissibilité. Concluant que la décision du juge de procès d’admettre la preuve méritait qu’on fasse preuve de retenue à son égard, et concluant qu’il n’avait commis aucune erreur dans son raisonnement ou son analyse qui a mené à cette décision, la juge Hoegg, dissidente, aurait rejeté l’appel.

The appellant was convicted of forcible confinement but acquitted of kidnapping. He forcibly confined a man for eight days after he was initially abducted by others. The Crown appealed the acquittal, arguing that the trial judge failed to recognize that kidnapping is a continuing offence that begins with the victim’s initial abduction and lasts continuously throughout the entire period of confinement, ending only with the rescue or escape of the victim. The Crown argued that if the trial judge found sufficient evidence to convict the appellant of forcible confinement, then there was enough evidence to convict him of kidnapping. The Court of Appeal allowed the Crown’s appeal and entered a conviction on the charge of kidnapping on the basis that the trial judge had found all the facts necessary to convict the appellant as a party to that offence by the application of the aiding and abetting provision in the Criminal Code.

L’appelant a été déclaré coupable de séquestration, mais acquitté de l’infraction d’enlèvement. Il a séquestré un homme pendant huit jours après que celui‑ci a été initialement enlevé par d'autres. Le ministère public a interjeté appel de l’acquittement, plaidant que le juge du procès avait omis de reconnaître que l’enlèvement était une infraction continue qui commence dès le rapt initial de la victime et qui se poursuit pendant toute la période de séquestration, ne prenant fin qu’avec le sauvetage ou la fuite de la victime. Le ministère public a plaidé que si le juge du procès avait conclu qu’il existait une preuve suffisante pour déclarer l’appelant coupable de séquestration, il y avait une preuve suffisante pour le déclarer coupable d’enlèvement. La Cour d'appel a accueilli l'appel du ministère public et a inscrit une déclaration de culpabilité relativement à l'accusation d’enlèvement au motif que le juge du procès avait constaté tous les faits nécessaires pour déclarer coupable l’appelant à titre de partie à cette infraction par l’application des dispositions du Code criminel en matière d’aide et d’encouragement.

Mr. Bellusci, an inmate, was charged with assaulting a correctional services officer and using violence against a justice system participant. The charges stemmed from an incident that had taken place while Mr. Bellusci was being transported. Mr. Bellusci claimed that the officer had roughed him up, but the officer alleged that Mr. Bellusci had injured him by violently pushing the cell door. At trial, Mr. Bellusci applied for a stay of proceedings on the ground that he had been assaulted by the officer. The trial judge acquitted him on the two counts of assault. Regarding the offence of using violence against a justice system participant, the trial judge considered the motion for a stay of proceedings and found that Mr. Bellusci had been roughed up by the officer, that his fundamental rights had therefore been violated and that a stay of proceedings was the only appropriate remedy. The Court of Appeal allowed the appeal in part and set aside the order granting the stay of proceedings. The Court of Appeal remitted the matter to the trial judge to proceed with the trial on the offence of using violence against a justice system participant.

M. Bellusci, un détenu, est accusé de voies de fait sur la personne d’un agent des services correctionnels ainsi que d’avoir usé de violence envers une personne associée au système judiciaire. Les accusations découlent d’un incident ayant pris place lors du transport de M. Bellusci. Selon lui, l’agent l’a rudoyé, mais selon l’agent, M. Bellusci l’a blessé en poussant violemment la porte de la cellule. En première instance, M. Bellusci demande l’arrêt des procédures au motif qu’il a été victime de voies de fait de la part de l’agent. Le juge de première instance l’acquitte des deux infractions de voies de fait. En ce qui concerne l’infraction d’avoir usé de violence envers une personne associée au système judiciaire, le juge de première instance considère la requête en arrêt des procédures et conclut que M. Bellusci a été rudoyé par l’agent et donc qu’il y a eu atteinte à ses droits fondamentaux, et que seul l’arrêt des procédures constitue une réparation adéquate. La Cour d’appel accueille en partie le pourvoi et annule l’ordonnance d’arrêt des procédures. La Cour d’appel retourne le dossier en première instance pour que le procès se continue sur l’infraction d’avoir usé de violence envers une personne associée au système judiciaire.

The appellant was severely injured while riding on a motorcycle driven by her husband, the respondent. The trial judge found that the respondent was negligent in two respects: he was driving at an excessive speed and the motorcycle was overloaded. Applying the material contribution test, he found that causation had been established and that, therefore, the respondent was liable for the injuries sustained by the appellant. The Court of Appeal allowed the respondent’s appeal. It set aside the trial judge’s order and dismissed the appellant’s action.

L’appelante a été grièvement blessée alors qu’elle prenait place sur une motocyclette conduite par son époux, l’intimé. Le juge de première instance a conclu que l’intimé avait été négligent à deux égards : il conduisait à une vitesse excessive et la motocyclette était surchargée. Appliquant le critère de la contribution appréciable, il a conclu que le lien de causalité avait été établi et que l’intimé était donc responsable des blessures subies par l’appelante. La Cour d'appel a accueilli l’appel de l'intimé. Elle a rejeté l'ordonnance du juge de première instance et rejeté l’action de l’appelante.
