This appeal comes to us as of right. In the final analysis, we agree with the majority in the Ontario Court of Appeal (2002), 4 C.R. (6th) 157 that: “While there was evidence upon which a trier of fact could make a finding of dangerous driving, in the circumstances, the failure to do so did not amount to an error of law” (para. 11).
Accordingly, the appeal is dismissed.

The Supreme Court of Canada has enacted new rules that came into force on June 28, 2002.
