Code civil - Responsabilité civile - Responsabilité du fait d'autrui - Négligence - Preuve - Action en dommages-intérêts intentée par l'intimée contre la demanderesse suite à une blessure à la main causée par le bris d'un verre - Juge de première instance concluant que lors de la manutention des verres par les serveuses du bar, certains verres peuvent subir des fissures que les serveuses, dans leur empressement, ne sont pas en mesure de déceler et que le bris du verre entre les mains de l'intimée dépendait d'une défectuosité inhérente dont il était affecté et dont la demanderesse est responsable - La Cour d'appel a-t-elle erré en confirmant le jugement de première instance et en concluant que la demanderesse n'avait fait voir aucun motif qui puisse justifier son intervention? - Art. 1054 et 1238 du Code civil du Bas-Canada.

Code civil - Droit de la famille - Divorce - Partage des biens - Parties cessant de faire vie commune en 1986 - Action en divorce intentée en 1991 - Deuxième alinéa de l'art. 42 de la Loi modifiant le Code civil du Québec et d'autres dispositions législatives afin de favoriser l'égalité économique des époux, L.Q. 1989, ch. 55, stipulant que les art. 462.1 à 462.13 du Code civil du Québec, relatifs au patrimoine familial des époux, "ne sont pas applicables, à moins de reprise de la vie commune, aux époux qui, avant le 15 mai 1989, avaient cessé de faire vie commune et avaient réglé, par une entente écrite ou autrement, les conséquences de leur séparation" - La Cour d'appel a-t-elle commis une erreur et outrepassé son rôle en concluant, au contraire du premier juge, que l'ensemble de la preuve ne laissait pas croire que l'attitude des parties après leur séparation de fait laissait présumer qu'elles avaient réglé implicitement les conséquences de leur séparation? - La Cour d'appel a-t-elle usurpé le rôle du juge de première instance de statuer sur la crédibilité des témoins en concluant que le demandeur n'avait pas rencontré son fardeau de preuve quant à l'existence d'une entente implicite entre les parties réglant les conséquences de leur séparation?

The next session of the Supreme Court of Canada commences on April 24, 1995.

 

Pursuant to the Supreme Court Act and Rules, the following requirements for filing must be complied with before an appeal will be inscribed and set down for hearing:

 

Case on appeal must be filed within three months of the filing of the notice of appeal.

 

Appellant's factum must be filed within five months of the filing of the notice of appeal.

 

Respondent's factum must be filed within eight weeks of the date of service of the appellant's factum.

 

Intervener's factum must be filed within two weeks of the date of service of the respondent's factum.

 

 

The Registrar shall inscribe the appeal for hearing upon the filing of the respondent's factum or after the expiry of the time for filing the respondent's factum

 

The Registrar shall enter on a list all appeals inscribed for hearing at the April 1995 Session on February 28, 1995.

Le mémoire de l'intimé doit être déposé dans les huit semaines suivant la signification de celui de l'appelant.

 

Le mémoire de l'intervenant doit être déposé dans les deux semaines suivant la signification de celui de l'intimé.

 

Le registraire inscrit l'appel pour audition après le dépôt du mémoire de l'intimé ou à l'expiration du délai de signification du mémoire de l'intimé.

 

Le 28 février 1995, le registraire met au rôle de la session d'avril 1995 tous les appels inscrits pour audition.
