C‑46, s. 7(7). |

The respondent, Aloise Hoch, a French citizen, was charged with sexual offences that were committed on an aircraft, on a flight from Paris to Montréal, and were therefore deemed to have been committed in Canada. Under s. 7(7) of the Criminal Code, the Attorney General of Canada’s consent to the proceedings had to be obtained not later than eight days after they were commenced, but the Attorney General failed to give it. The applicant, the Crown, laid new charges after the error was noticed. At the commencement of his trial, the respondent filed a motion for a stay of proceedings, alleging that the laying of the new charges against him constituted an abuse of process. The Court of Québec granted the respondent’s motion for a stay. The Court of Appeal held instead that the eight‑day time limit under s. 7(7) Cr. C. is mandatory and that it barred the Crown from laying new charges. Rather than affirming the trial judge’s stay order, the Court of Appeal allowed the appeal solely to declare the charges to be null.

L’intimé, M. Aloise Hoch, citoyen français, est accusé d’infractions à caractère sexuel. Ces infractions ont été commises dans un avion, dont le vol, en provenance de Paris, s’est terminé à Montréal, et elles sont donc réputées avoir été commises au Canada. Selon le par. 7(7) du Code criminel, le procureur général du Canada devait donner son consentement aux poursuites au plus tard huit jours après qu’elles furent engagées, ce qu’il a omis de faire. La demanderesse, la Couronne, a déposé de nouvelles accusations après avoir constaté son erreur. Au début de son procès, l’intimé dépose une requête en arrêt des procédures alléguant abus de la poursuite dans le dépôt des nouvelles accusations contre lui. La Cour du Québec accorde la requête de l’intimé en arrêt des procédures. La Cour d’appel conclut plutôt que le délai de huit jours prévu au par. 7(7) C. cr. est de rigueur et ne permet pas à la Couronne de déposer de nouvelles accusations. Plutôt que de confirmer la conclusion du juge de procès ordonnant l’arrêt des procédures, la Cour d’appel accueille l’appel pour la seule fin de déclarer les accusations nulles.

In 2008, the parties entered into an agreement of purchase and sale of 5 acres of land for the price of $1,175,000 per acre. Prior to the finalization of the agreement, Abstak sought to obtain a development permit for the land from the City of Calgary. The City refused Abstak’s development permit application. Abstak filed a notice of appeal of this decision. The day before the appeal was to be heard, Abstak withdrew its appeal. It terminated the agreement between the parties.
The Court of Queen’s Bench of Alberta found that Abstak had an obligation to pursue the appeal for the permit and that Telsec was entitled to damages in the amount of $2,000,000. The majority of the Court of Appeal found no error in the trial judge’s reasons warranting its intervention. It disagreed however with the damages award, and found that Abstak’s initial deposit on the transaction should be deducted from the damages. O’Ferrall J.A., dissenting, would have allowed the appeal, set aside Telsec’s $2,000,000 judgment and directed the return of Abstak’s deposit.

En 2008, les parties ont conclu une convention d’achat‑vente de 5 acres de terrain au prix de 1 175 000 $ l’acre. Avant la rédaction définitive de la convention, Abstak a tenté d’obtenir un permis d’aménagement du terrain de la Ville de Calgary. La Ville a rejeté la demande de permis d’aménagement d’Abstak. Abstak a déposé un avis d’appel de cette décision. La veille de l’audition de l’appel, Abstak a retiré son appel. Elle a résilié la convention conclue entre les parties.
La Cour du Banc de la Reine de l’Alberta a conclu qu’Abstak avait l’obligation de poursuivre l’appel relatif au permis et que Telsec avait droit à des dommages‑intérêts de 2 000 000 $. La Cour d’appel n’a trouvé aucune erreur dans les motifs du juge de première instance justifiant son intervention. Toutefois, elle n’était pas d’accord avec le montant des dommages‑intérêts accordé, et a conclu que le dépôt initial d’Abstak sur l’opération devait être déduit des dommages‑intérêts. Le juge O’Ferrall, dissident, aurait accueilli l’appel, annulé le jugement de 2 000 000 $ en faveur de Telsec et ordonné le remboursement du dépôt d’Abstak.

They do not agree on the interpretation of the contract. Muslim Green Cemeteries Corporation applied for a ruling interpreting aspects of the contract. The applications judge issued declarations interpreting parts of the contract. The Court of Appeal dismissed an appeal. |
