E-23 gives jurisdiction to the extradition judge to decide Charter issues under s. 24 and 52 which are not limited to matters related to the extradition judge’s modest function to decide on the sufficiency of evidence - Can the allegation of the Respondent, if true, that Canadian and American law enforcement authorities worked together to ensure that the alleged co-conspirators would be prosecuted in the foreign state, support an argument that the Extradition Act and the Extradition Treaty Between Canada and the United States are unconstitutional in their application to the Respondent by virtue of sections 6 and 7 of the Charter?

Charte canadienne des droits et libertés - Droit criminel - Extradition - La Cour d’appel a-t-elle erré en droit en décidant que le Ministre de la Justice n’avait pas commis une erreur de droit justifiant l’annulation de sa décision d’ordonner le transfèrement du demandeur en ne respectant pas la procédure établie à l’article 17 bis du Traité d’extradition entre le Canada et les États-Unis d’Amérique - La Cour d’appel a-t-elle erré en droit en décidant que si le demandeur voulait établir que la décision du Ministre de ne pas intenter de poursuites criminelles contre lui au Canada violait son droit constitutionnel garanti à l’article 6(1) de la Charte canadienne des droits et libertés, il devait démontrer que cette décision était déraisonnable - La Cour d’appel a-t-elle erré en droit en décidant que la décision du Ministre de la Justice d’ordonner le transfèrement du demandeur aux États-Unis ne violait pas ses droits constitutionnels garantis aux articles 6(1) et 7 de la Charte canadienne des droits et libertés et en maintenant cette ordonnance de transfèrement.

We agree with the trial judge that no duty of care was owed to the respondent in the circumstances of this case. Accordingly, the appeal is allowed, the judgment of the Court of Appeal is reversed, and the trial judgment is restored, the whole with costs throughout.
Nous sommes d’accord avec le juge de première instance qu’aucune obligation de diligence n’était due à l’intimée dans les circonstances de l’espèce. En conséquence, le pourvoi est accueilli, l’arrêt de la Cour d’appel est infirmé, la décision du juge de première instance est rétablie, le tout avec dépens devant toutes les cours.

SOPINKA J. (orally for the Court) -- We are of the opinion that the appellant’s rights under s. 10(b) of the Canadian Charter of Rights and Freedoms were violated in that the appellant should have been rewarned concerning his right to counsel when there was a substantial change in his jeopardy. This occurred when the police officer concluded that the appellant had committed the offence and advised the appellant accordingly.
LE JUGE SOPINKA (oralement pour la Cour) -- Nous sommes d’avis qu’il y a eu violation des droits garantis à l’appelant par l’al. 10b) de la Charte canadienne des droits et libertés, car ce dernier aurait dû être mis en garde à nouveau relativement à son droit à un avocat quand il y a eu changement important du risque qu’il courait. Ce changement est survenu lorsque l’agent de police a conclu que l’appelant avait commis l’infraction et a avisé ce dernier en conséquence.
The appeal is allowed, the judgment of the Court of Appeal is set aside and the acquittal is restored.
Le pourvoi est accueilli, l’arrêt de la Cour d’appel est infirmé et l’acquittement est rétabli.
