Subscriptions may be had at $200 per year, payable in advance, in accordance with the Court tariff.  During Court sessions it is usually issued weekly.

Le prix de l'abonnement, fixé dans le tarif de la Cour, est de 200 $ l'an, payable d'avance.  Le Bulletin paraît en principe toutes les semaines pendant les sessions de la Cour.

 

The Bulletin, being a factual report of recorded proceedings, is produced in the language of record.  Where a judgment has been rendered, requests for copies should be made to the Registrar, with a remittance of $10 for each set of reasons.  All remittances should be made payable to the Receiver General for Canada.

Le Bulletin rassemble les procédures devant la Cour dans la langue du dossier.  Quand un arrêt est rendu, on peut se procurer les motifs de jugement en adressant sa demande au registraire, accompagnée de 10 $ par exemplaire.  Le paiement doit être fait à l'ordre du Receveur général du Canada.

La Forest J. -- This is an application by the appellant, Clarence Maxwell Shorting, for an order pursuant to s. 70  of the Supreme Court Act , R.S.C., 1985, c. S-26 , as am., reversing the judgment of the Court of Appeal for Manitoba dated November 8, 1995.  The judgment of the Court of Appeal  upheld the sentence imposed on the appellant by Mr. Justice Scollin of the Court of Queen’s Bench of Manitoba on June 20, 1995 following the appellant’s conviction for manslaughter.  Mr. Justice Scollin sentenced the appellant to life imprisonment and ordered that the appellant serve a minimum period of incarceration of ten years prior to his eligibility for parole under the provisions of s. 741.2  of the Criminal Code of Canada , R.S.C., 1985, c. C-46 , as am. 


Le juge La Forest -- L’appelant, Clarence Maxwell Shorting, sollicite, conformément à l’art. 70  de la Loi sur la Cour suprême du Canada , L.R.C. (1985), chap. S-26 , et ses modifications, une ordonnance cassant le jugement de la Cour d’appel du Manitoba daté du 8 novembre 1995. Dans ce jugement, la Cour d’appel confirmait la peine infligée à l’appelant par le juge Scollin de la Cour du Banc de la Reine du Manitoba, le 20 juin 1995, à la suite de sa condamnation pour homicide involontaire coupable. Le juge Scollin a condamné l’appelant à l’emprisonnement à perpétuité et ordonné, en vertu de l’art. 741.2  du Code criminel , L.R.C. (1985), chap. C-46 , et ses modifications, que ce dernier purge une période d’emprisonnement minimale de 10 ans avant d’être admissible à la libération conditionnelle.


 


Upon reading the materials filed by the appellant, including the affidavit of Jeffrey F. Harris affirmed the 29th day of October 1996, and the consent of the respondent to an order reversing the decision of the Court of Appeal for Manitoba by deleting the requirement that the appellant serve a minimum period of incarceration of ten years prior to his eligibility for parole;

(orally) -- We are of the view that this appeal should be dismissed.  With regard to the issue of the late Crown disclosure, we are not persuaded that there was any prejudice to the appellant’s ability to effect his right to full answer and defence, and would dismiss this ground substantially for the reasons of Coté J.A. in the Court of Appeal.


 

LE JUGE L’HEUREUX-DUBÉ (oralement) -- Nous sommes d’avis qu’il y a lieu de rejeter ce pourvoi.  Quant à la question de la communication tardive de la preuve du ministère public, nous ne sommes pas persuadés que l’appelant ait subi une préjudice en ce qui concerne sa capacité d’exercer son droit à une défense pleine et entière et il y a lieu de rejeter ce moyen essentiellement pour les raisons du juge Côté de la Cour d’appel.


 

                We would also dismiss the second ground of appeal.  In our view, the K.G.B. application proceeded correctly and the trial judge properly considered the indicia of reliability and necessity in admitting the evidence.  As Coté J.A.  stated, where defence counsel is unable to effect a complete cross-examination due to a witness’ failure of memory, this alone is not a reason to bar admission of the prior inconsistent statement for its substantive use.  Rather, it is a factor to be considered in respect to the weight of the prior statement.  We see no reason to interfere with the trial judge’s finding on this ground.


 

                Nous rejetterions de même le second moyen d’appel.  À notre avis, la demande fondée sur l’arrêt K.G.B. a été traitée correctement et le juge du procès, a, à bon droit, tenu compte des indices de fiabilité et de nécessité en déclarant le preuve admissible.  Comme le juge Côté l’a affirmé, lorsque l’avocat de la défense est incapable d’effectuer un contre-interrogatoire complet à cause de la mémoire défaillante d’un témoin, ce fait ne justifie pas à lui seul de refuser l’admission de la déclaration incompatible antérieure quant à son contenu.  C’est plutôt un facteur qui doit être pris en considération pour déterminer le poids à accorder à la déclaration antérieure.  Nous ne voyons aucune raison d’intervenir dans la conclusion du juge du procès sur ce point.


 

                The appeal is dismissed.


 

                Le pourvoi est rejeté.

                In this case, however, for the reasons of Doherty J.A. dissenting, we agree with the appellant that the learned trial judge did not pre-judge or appear to pre-judge the credibility of the witness, Clause.  Moreover, the respondent was not impeded from making full answer and defence.


 

                En l’espèce, toutefois, pour les motifs de dissidence exposés par le juge Doherty, nous sommes d’accord avec ce dernier que le juge du procès n’a pas préjugé ni donné l’impression de préjuger de la crédibilité du témoin Clause. Qui plus est, l’intimé n’a pas été empêché de présenter une défense pleine et entière.


 

                With respect to propriety of the cross-examination by counsel for the Crown, while it approached the limits of permissible cross-examination, it did not exceed them.


 

                En ce qui concerne la question du caractère convenable du contre-interrogatoire mené par l’avocat du ministère public, même si le contre-interrogatoire a frôlé les limites du permissible à cet égard, il ne les a pas dépassés.


 

                There is no merit in any of the respondent’s alternative grounds. 


 

                Aucun des autres motifs invoqués par l’intimé n’a de fondement.

                The appeal is allowed, the judgment of the Court of Appeal is set aside, and the judgment at trial is restored.

The winter session of the Supreme Court of Canada will commence January 20, 1997.

 

Pursuant to the Supreme Court Act  and Rules, the following requirements for filing must be complied with before an appeal will be inscribed and set down for hearing:

 

Case on appeal must be filed within three months of the filing of the notice of appeal.

 

Appellant's factum must be filed within four months of the filing of the notice of appeal.

 

Respondent's factum must be filed within eight weeks of the date of service of the appellant's factum.

 

Intervener's factum must be filed within four weeks of the date of service of the respondent's factum.

 

 

The Registrar shall inscribe the appeal for hearing upon the filing of the respondent's factum or after the expiry of the time for filing the respondent's factum

 

 

La session d'hiver de la Cour suprême du Canada commencera le 20 janvier 1997.

 

Conformément à la Loi sur la Cour suprême  et aux Règles, il faut se conformer aux exigences suivantes avant qu'un appel puisse être inscrit pour audition:
