Subscriptions may be had at $200 per year, payable in advance, in accordance with the Court tariff.  During Court sessions it is usually issued weekly.

The Bulletin, being a factual report of recorded proceedings, is produced in the language of record.  Where a judgment has been rendered, requests for copies should be made to the Registrar, with a remittance of $10 for each set of reasons.  All remittances should be made payable to the Receiver General for Canada.

Procédures - Compétence - Droit criminel - La Cour d’appel du Québec a-t-elle commis une erreur de droit en concluant que le juge Morier avait juridiction pour prononcer  une ordonnance de mise en liberté provisoire sujet à une promesse assortie de conditions? - La Cour d’appel a-t-elle commis une erreur de droit en concluant que les principes de l’arrêt Taylor, [1990] 3 R.C.S. 892, s’appliquent à une condition d’une promesse remise à un juge de paix à la suite d’une ordonnance de mise en liberté provisoire? - Dans les circonstances de la présente affaire, la Cour d’appel a-t-elle commis une erreur de droit en concluant que le juge à l’enquête préliminaire a correctement agi en citant le demandeur à procès sur de nouveaux chefs d’accusation qui découlaient “de la même affaire”? - Dans les circonstances de la présente affaire, la Cour d’appel  a-t-elle mal exercé son pouvoir discrétionnaire en refusant au demandeur la permission de retirer son plaidoyer de culpabilité sur chacun des chefs?

SOPINKA J.  (orally for the Court) -- In this appeal a new trial was ordered by the Court of Appeal on a number of grounds based on errors in the charge to the jury.  We have concluded that the address to the jury by Crown counsel exceeded the limits laid down by this Court in Boucher v. The Queen, [1955] S.C.R. 16.

               


 

 

LE JUGE SOPINKA (oralement au nom de la Cour) -- En l’espèce, la Cour d’appel a ordonné la tenue d’un nouveau procès pour un certain nombre de motifs fondés sur des erreurs commises dans l’exposé au jury.  Nous avons conclu que l’exposé que le substitut du procureur général a fait au jury a excédé les limites fixées par notre Cour dans Boucher c. La Reine, [1955] R.C.S. 16.


               

In the circumstances the trial judge ought to have specifically directed the jury with respect to these improprieties.  The charge by the trial judge was inadequate in this respect.


 

Dans les circonstances, le juge du procès aurait dû donner au jury des directives précises sur ces irrégularités.  L’exposé du juge du procès était insuffisant à cet égard.


With respect to the other grounds, counsel for the respondent properly conceded that the Court of Appeal erred in finding that the trial judge’s charge was defective in treating as corroborative, evidence that did not implicate the accused.  Such evidence need not, although it may, implicate the accused.  We find no error in the charge in respect of this ground nor in the charge relating to the alibi evidence.


Quant aux autres moyens, l’avocat de l’intimé a reconnu à bon droit que la Cour d’appel avait commis une erreur en concluant que l’exposé du juge du procès était déficient du fait qu’on y considérait comme corroborante une preuve qui n’impliquait pas l’accusé.  Il n’est pas nécessaire qu’une telle preuve implique l’accusé, quoiqu’elle puisse le faire.  Nous concluons que l’exposé ne comporte aucune erreur relativement à ce moyen ni relativement à la preuve d’alibi.


 

                The appeal is dismissed.  In the circumstances, it is unnecessary to consider the application to adduce fresh evidence.


 

                Le pourvoi est rejeté.  Dans les circonstances, il n’est pas nécessaire d’examiner la demande de production de nouveaux éléments de preuve.

SOPINKA J.:  (orally for the Court) -- This is an appeal as of right.  The trial judge properly charged the jury with respect to the special need for caution in considering identification evidence.  In dealing with the circumstances surrounding the identification, the trial judge referred to recognition as a factor.  In view of the express caution with respect to acceptance of identification evidence generally, failure to specifically repeat the warning with respect to recognition did not constitute an error in this case.  With respect to the specific weaknesses in the evidence relied on by the appellant we are of the view that the charge was adequate.  In our view, in all the circumstances, the jury was sufficiently alerted to these weaknesses.

 

 

 

                The appeal is dismissed.


 

LE JUGE SOPINKA (oralement au nom de la Cour) -- Le présent pourvoi est formé de plein droit.  Le juge du procès a donné au jury des directives appropriées sur le besoin particulier de prudence dans l’examen de la preuve d’identification.  En traitant les circonstances entourant l’identification, le juge a décrit la reconnaissance comme étant un facteur.  Compte tenu de la directive générale explicite de prudence dans l’acceptation de toute preuve d’identification, l’omission de répéter l’avertissement relativement à la reconnaissance n’a pas constitué une erreur en l’espèce.  Quant aux faiblesses particulières de la preuve invoquées par l’appelant, nous sommes d’avis que l’exposé était suffisant.  Nous estimons que, compte tenu de toutes les circonstances, l’attention du jury a suffisamment été attirée sur ces faiblesses.

 

                Le pourvoi est rejeté.

The winter session of the Supreme Court of Canada will commence September 30, 1996.

 

Pursuant to the Supreme Court Act and Rules, the following requirements for filing must be complied with before an appeal will be inscribed and set down for hearing:

 

Case on appeal must be filed within three months of the filing of the notice of appeal.

 

Appellant's factum must be filed within four months of the filing of the notice of appeal.

 

Respondent's factum must be filed within eight weeks of the date of service of the appellant's factum.

 

Intervener's factum must be filed within four weeks of the date of service of the respondent's factum.

 

 

The Registrar shall inscribe the appeal for hearing upon the filing of the respondent's factum or after the expiry of the time for filing the respondent's factum

 

 

La session d'hiver de la Cour suprême du Canada commencera le 30 septembre 1996.

 

Conformément à la Loi sur la Cour suprême et aux Règles, il faut se conformer aux exigences suivantes avant qu'un appel puisse être inscrit pour audition:
