UPON APPLICATIONS by Public Interest Litigation Institute, Real Property Association of Canada, BOMA Building Owners and Managers Association of British Columbia and Better Way Alliance for leave to intervene in the above appeal;
AND THE MATERIAL FILED having been read;
IT IS HEREBY ORDERED THAT:
The motions for leave to intervene filed by Public Interest Litigation Institute, Real Property Association of Canada, BOMA Building Owners and Managers Association of British Columbia and Better Way Alliance are granted and the four (4) interveners shall each be entitled to serve and file a factum not to exceed ten (10) pages in length, and book of authorities, if any, on or before December 4, 2025.
The interveners are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeal.
The appellant and respondents are granted permission to each serve and file a single factum in reply to all interventions not to exceed ten (10) pages in length on or before December 18, 2025.
The interveners are not entitled to take position as to the disposition of the appeal, to raise new issues, to adduce further evidence or otherwise to supplement the record of the parties.
Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners shall pay to the appellant and the respondents any additional disbursements resulting from their interventions.

IL EST ORDONNÉ CE QUI SUIT :
Les requêtes en autorisation d’intervenir déposées par l’Institut de litige d’intérêt public, la Real Property Association of Canada, la BOMA Building Owners and Managers Association of British Columbia et la Better Way Alliance sont accueillies, et les quatre (4) intervenants sont chacun autorisés à signifier et à déposer un mémoire d’au plus dix (10) pages et un recueil de sources, le cas échéant, au plus tard le 4 décembre 2025.
Les intervenants sont chacun autorisés à présenter une plaidoirie orale d’au plus cinq (5) minutes lors de l’audition de l’appel.
L’appelante et les intimés sont autorisés à chacun signifier et déposer un seul mémoire d’au plus dix (10) pages en réponse à toutes les interventions, et ce, au plus tard le 18 décembre 2025.
Les intervenants n’ont pas le droit de prendre position quant à l’issue de l’appel, de soulever de nouvelles questions, de produire d’autres éléments de preuve, ni de compléter de quelque autre façon le dossier des parties.

The appeal from the judgment of the Court of Appeal of Quebec (Québec), Numbers 200-10-003750-200 and 200-10-003752-206, 2023 QCCA 731, dated June 6, 2023, heard on January 20, 2025, is dismissed. The minimum sentences set out in ss. 163.1(4)a) et (4.1)a) of the Criminal Code, R.S.C. 1985, c. C-46, are contrary to s. 12 of the Canadian Charter of Rights and Freedoms and are not saved by s. 1. They are declared of no force or effect, with immediate effect, in accordance with s. 52(1) of the Constitution Act, 1982. Wagner C.J. and Côté, Rowe and O’Bonsawin JJ. dissent.

L’appel interjeté contre l’arrêt de la Cour d’appel du Québec (Québec), numéros 200-10-003750-200 et 200-10-003752-206, 2023 QCCA 731, daté du 6 juin 2023, entendu le 20 janvier 2025, est rejeté. Les peines minimales prévues aux al. 163.1(4)a) et (4.1)a) du Code criminel, L.R.C. 1985, c. C-46, sont contraires à l’art. 12 de la Charte canadienne des droits et libertés et ne sont pas sauvegardées en vertu de l’article premier. Elles sont déclarées inopérantes, avec effet immédiat, conformément au par. 52(1) de la Loi constitutionnelle de 1982. Le juge en chef Wagner et les juges Côté, Rowe et O’Bonsawin sont dissidents.
