CASE SUMMARY
Criminal law - Whether it is wrong to instruct juries that incriminating statements may carry greater weight than self‑serving, exculpatory statements on the basis that such instruction is prejudicial to the accused and invites reversal of the burden of proof.
Samuels was convicted of first‑degree murder of his common law wife, Barbara Lanthier. He appealed his conviction to the Court of Appeal for Ontario. The appeal was allowed, and a new trial ordered. The Crown seeks leave to appeal and to have the conviction restored.
Samuels was charged with murder nearly 19 months after Lanthier’s death. It was the Crown’s theory that he planned Lanthier’s killing to collect life insurance. The principal issue was whether Lanthier died as a result of an accident or whether Samuels had murdered her and staged an accident.
The trial judge charged the jury, in part, as follows:
.... In this case, the statements of the accused Samuels contain both admissions or confessions as well as excuses which tend to exonerate him. In the ordinary course of human behaviour, it often occurs that statements of an incriminating nature, such as admissions or confessions, are likely to be true, otherwise why say them? On the other hand, excuses for one’s behaviour do not necessarily carry the same persuasive weight. ....
The Court of Appeal held that the trial judge erred in respect of the characterization of Samuels’s statements as containing “confessions”, “admissions” or “excuses”. The balance of his charge did not rehabilitate this instruction, and this was not an appropriate case to apply the curative proviso in s. 686(1)(b)(iii) of the Criminal Code.

RÉSUMÉ DE L’AFFAIRE
Droit criminel - Est-il erroné de dire au jury que des déclarations incriminantes peuvent avoir plus de poids que des déclarations disculpatoires intéressées pour le motif qu’une telle directive nuit à l’accusé et favorise l’inversion du fardeau de la preuve?
M. Samuels a été déclaré coupable du meurtre au premier degré de sa conjointe de fait, Barbara Lanthier. Il a appelé de sa déclaration de culpabilité devant la Cour d’appel de l’Ontario. L’appel a été accueilli et un nouveau procès a été ordonné. Le ministère public demande l’autorisation d’appeler et le rétablissement de la déclaration de culpabilité.
M. Samuels a été accusé de meurtre près de 19 mois après le décès de Mme Lanthier. Selon le ministère public, il aurait planifié le meurtre de Mme Lanthier afin de toucher une indemnité au titre d’une police d’assurance-vie. La principale question était de savoir si Mme Lanthier était décédée à la suite d’un accident ou si M. Samuels l’avait assassinée et avait simulé un accident.
Le juge du procès a notamment donné au jury la directive suivante :
[traduction] En l’espèce, les déclarations de l’accusé Samuels comportent à la fois des aveux ou des confessions ainsi que des excuses qui tendent à l’innocenter. Il arrive souvent, dans le comportement humain normal, que des déclarations de nature incriminante, comme des aveux ou des confessions, soient susceptibles d’être véridiques, sinon à quoi bon les faire? En revanche, les excuses données pour expliquer son comportement n’ont pas nécessairement la même valeur persuasive. . . .
La Cour d’appel a conclu que le juge du procès a commis une erreur en affirmant que les déclarations de M. Samuels comportaient des « confessions », des « aveux » ou des « excuses ». Le reste de son exposé n’a pas remédié à cette directive, et il ne convenait pas en l’espèce d’appliquer la disposition réparatrice du sous-al. 686(1)b)(iii) du Code criminel.

A-25, in determining Applicant’s liability - Whether, in light of those presumptions, evidence introduced at hearing, and failure of SAAQ to call driver of automobile involved in accident as witness, it appropriate for court to find Applicant fully responsible.
The application concerns the refusal of the Société de l’assurance automobile du Québec (SAAQ) to compensate Mr. Rekabi for bodily injury suffered in an accident on the ground that he was solely responsible for that accident. Under s. 9 of the Automobile Insurance Act, an accident victim who does not reside in Quebec is entitled to compensation only to the extent that he or she is not responsible for the accident. Mr. Rekabi contested the SAAQ’s decision in the Quebec Superior Court, which dismissed the application, concluding that the accident was entirely due to Mr. Rekabi’s negligence. He appealed on the basis that the trial judge had erred in ignoring the legal presumptions set out in ss. 108 and 109 of the Automobile Insurance Act. Under s. 108, the owner of an automobile is liable for property damage caused by the automobile unless he or she can rebut or reduce that liability in accordance with the provision. Section 109 provides that the driver of an automobile is solidarily liable with the owner unless he or she proves that the accident was caused by the fault of the victim or of a third person, or by superior force. On the SAAQ’s motion to dismiss the appeal, the Court of Appeal unanimously held that the appeal was certain to fail and dismissed it. The Court was of the view that whether or not the presumptions were applied would not alter the trial judge’s finding of fact to the effect that Mr. Rekabi was the author of his own misfortune.

A-25, dans la détermination de la responsabilité du demandeur? - Compte tenu de ces présomptions, la preuve présentée à l’audience et le défaut de la SAAQ d’appeler comme témoin le conducteur du véhicule automobile impliqué dans l’accident permettaient-ils au tribunal de conclure à l’entière responsabilité du demandeur?
La demande porte sur le refus de la SAAQ d’indemniser M. Rekabi pour les dommages corporels subis lors d’un accident au motif qu’il était le seul responsable. Aux termes de l’art. 9 de la Loi sur l’assurance automobile, la victime d’un accident qui ne réside pas au Québec a le droit d’être indemnisée seulement dans la proportion où elle n’est pas responsable. M. Rekabi conteste la décision de la SAAQ devant la Cour supérieure du Québec, qui rejette la demande en concluant que l’accident n’était dû qu’à la négligence de M. Rekabi. Il interjette appel en alléguant que le premier juge a erré en ignorant les présomptions légales édictées aux art. 108 et 109 de la Loi sur l’assurance automobile. Aux termes de l’art. 108, le propriétaire de l'automobile est responsable du préjudice matériel causé par cette automobile à moins qu’il ne repousse ou atténue cette responsabilité conformément à cet article. L’article 109 prévoit que le conducteur d'une automobile est solidairement responsable avec le propriétaire, à moins qu'il ne prouve que l'accident a été causé par la faute de la victime, d'un tiers ou par cas de force majeure. Sur requête en rejet d’appel de la SAAQ, la Cour d’appel juge à l’unanimité que le pourvoi est voué à l’échec et rejette l’appel. Elle est d’avis que l’application ou non des présomptions ne changerait rien à la conclusion de fait du premier juge selon laquelle M. Rekabi a été l’auteur de son malheur.

Procedural law ‑ Civil procedure ‑ Pre‑trial procedure ‑ Motion to strike parts of statements of defence under Rule 21 of Rules of Civil Procedure, R.R.O. 1990, Reg. 194 - Whether in exercising their discretion to prevent subsequent litigation that is an abuse of process, courts should take a substantive approach to determining the issues decided in the initial litigation - Whether the "plain, obvious, and beyond doubt" test governs a motion to strike pleadings on abuse of process grounds - Whether a breach of fiduciary duty is established, without proof of damages, in light of conduct contrary to the interests of the beneficiary motivated by the fiduciary's self‑interest.
The Applicants brought an action against the Respondents essentially for breach of trust and breach of fiduciary duty. The Applicants alleged that the Respondents had pleaded by way of defence matters already determined in a judgment rendered on the passing of accounts. The Applicants moved for judgment, and moved to strike those parts of the statements of defence which purported to put into issue matters already determined in the earlier proceeding.

Le manquement à l’obligation fiduciaire a‑t‑il été établi, sans la preuve des dommages, compte tenu du comportement du fiduciaire, qui est contraire aux intérêts du bénéficiaire et motivé par l’intérêt personnel du fiduciaire?
Les demanderesses ont intenté contre les intimés une action qui porte essentiellement sur l’abus de confiance et le manquement à l’obligation fiduciaire. Elles ont allégué que les intimés avaient plaidé en défense des points déjà tranchés dans un jugement rendu sur la reddition des comptes. Elles ont demandé qu’un jugement soit prononcé et que les parties des défenses qui portent sur des points déjà tranchés dans le cadre de l’instance antérieure soient radiées.

The applicants signed a promissory note with the respondent for $25,000 at 11% per annum due October 7, 1993. Elsewhere in the note, the amount was set out as $11,000. Upon maturity, the respondent advised the applicants in a letter that he would prefer to retire the note immediately but he did not make demand for repayment and he accepted monthly payments thereafter until December 2001. The applicants argue the note was part of a broader business arrangement upon which the parties could not achieve a consensus and the respondent should not have been entitled to enforce the note on summary judgment.

Les demandeurs ont signé en faveur de l’intimé un billet au montant de 25 000 $ à 11% par année exigible le 7 octobre 1993. Ailleurs dans le billet, le montant a été fixé à 11 000 $. À l’échéance, l’intimé a informé par écrit les demandeurs qu’il préférerait être remboursé immédiatement, mais n’a fait aucune demande en ce sens et, par la suite, il a accepté des versements mensuels jusqu’en décembre 2001. Les demandeurs soutiennent que le billet faisait partie d’une entente commerciale plus générale qu’ils n’étaient pas parvenus à conclure et que l’intimé n’aurait pas dû obtenir l’exécution du billet par voie de jugement sommaire.

Criminal law (Non Charter) - Evidence - DNA evidence - Whether a convicted offender has a right to access and test trial exhibits post-conviction following the exhaustion of all appeals?
The Applicant, John Terceira, applied for the release for DNA testing of leotards worn by a six year old murder victim. The leotards were filed as an exhibit at Terceira’s trial. In February 1993, Terceira was convicted of first degree murder. That conviction was affirmed on appeal in February 1998 and reaffirmed by this Court in December 1999.
The Ontario Superior Court held that it did not have the jurisdiction to release the evidence for testing post-conviction and held that if it had jurisdiction, it would not exercise its discretion in granting the motion.

Le demandeur, John Terceira, a sollicité la communication d’une analyse génétique de justaucorps portés par la victime d’un meurtre âgée de six ans. Les justaucorps avaient été déposés en preuve lors du procès de M. Terceira. En février 1993, M. Terceira a été déclaré coupable de meurtre au premier degré. Ce verdict a été confirmé en appel en février 1998, et par notre Cour en décembre 1999.
La Cour supérieure de l’Ontario a décidé qu’elle n’avait pas compétence pour communiquer la preuve pour qu’elle soit analysée après une déclaration de culpabilité, et que, si elle avait compétence, elle n’exercerait pas son pouvoir discrétionnaire d’accueillir la requête.
