CASE SUMMARY
Canadian Charter of Rights and Freedoms - Criminal law - Extradition - Whether the Court of Appeal erred in ruling that the existence of a Treaty between the Czech Republic and Canada was outside the jurisdiction of the extradition judge - Whether the Court of Appeal erred in ruling that the existence of a Treaty was not a justiciable issue before it on judicial review of the Minister’s decision on surrender
The Czech Republic requests the surrender of the Applicant, Georgios Ganis, for the enforcement of a prison sentence in that country for convictions on charges of procuring women for the purpose of prostitution and being unlawfully at large. The Czech Republic made its request pursuant to an extradition treaty between Canada and Czechoslovakia. The Applicant challenged the Treaty’s existence. Satanove J. concluded that she did not have jurisdiction to inquire into the matter at the committal hearing. The appeal and judicial review were dismissed.

31890 Suzanne Boudreau v. Minister of National Revenue and Attorney General of Canada (FC) (Civil) (By Leave)
Coram : Binnie, Deschamps and Abella JJ.
The motion for a stay of proceedings and the application for leave to appeal from the judgment of the Federal Court of Appeal, Number A‐248‐05, 2007 FCA 32, dated February 5, 2007, are dismissed with costs.
CASE SUMMARY
Taxation — Revocation of pension plan registration — Whether the effective date of a revocation is the date of the related plan’s inception? — Whether the decision to revoke a plan of which the Applicant was a member was made in accordance with the requirements of natural justice? — Income Tax Act, R.S.C. 1985, c. 1 (5th Supp.).
As a result of a complaint from a public servant, the RCMP began an investigation of various pension plans registered under the Income Tax Act (the “Act”). The results of the investigation were shared with the Canada Revenue Agency (the “CRA”). The CRA was informed that members of the Cryptic Web pension plan (the “Plan”) were not employees of Cryptic Web, contrary to a condition of the Plan’s registration under the Act. On the basis of this information, the Plan was revoked. In the interim, the Applicant filed in the Federal Court of Appeal an application seeking to challenge the revocation of Cryptic Web or, in the alternative, to change its effective date of revocation (from the date of Plan’s inception to a later date). In response to a motion brought by the CRA to have the application quashed, the Court concluded that the Applicant had standing to challenge the effective date of revocation of the Plan, but not the decision to revoke. Her application was allowed to proceed on that basis, but was subsequently dismissed. The Court found that the determination of the date at which the Plan had failed to meet the conditions for registration under the Act was essentially one of fact and that the CRA had correctly chosen the date of inception of the Plan as its effective date of revocation.

The application for leave to appeal from the judgment of the Court of Appeal of Manitoba, Number AI 06‐30‐06475, 2006 MBCA 141, dated November 20, 2006, is dismissed with costs.
CASE SUMMARY
Civil procedure - Costs - Whether the appellate court erred in dismissing an appeal of an Order for security for costs - Whether the Applicant should be ordered to pay security for costs in the circumstances of this case.
The Applicant lost her job as a registered medical laboratory technologist with the corporate Respondent. The Applicant made allegations amounting to unjust dismissal and discrimination, and commenced an action in damages asking for $850,000.00, plus an apology. She also filed a complaint with the Manitoba Human Rights Commission. The Respondents claim the Applicant was dismissed because she stopped showing up for work. It defended the action by arguing that the court lacked jurisdiction to hear the matter, given the grievance mechanism available under the collective agreement between the Manitoba Government and General Employees Union and Westman Regional Laboratories Inc. The Applicant was a probationary employee covered by that agreement.

Nature of the case:
Labour law - Arbitration - Statutes - Interpretation - Administrative law - Judicial review - Standard of review - Can the Adjudicator’s jurisdiction in reviewing a dismissal grievance be limited by an employer who simply states that cause is not alleged, rendering access to adjudication a process without an effective remedy - If the Court of Appeal was correct in limiting the Adjudicator’s jurisdiction to whether the notice period was adequate, was the Appellant public servant entitled to procedural fairness where his employment was then at pleasure - Is an adjudicator entitled to deference when interpreting his constituent statute and did the Court of Appeal thereby err in refusing to reinstate the adjudicators’ awards. |
|
