St‑Germain was convicted of a “criminal organization offence” under s. 467.11 of the Criminal Code, drug trafficking and conspiracy to traffic in drugs. The trial judge wanted to impose an aggregate prison sentence of 39 months. However, since St‑Germain had been in interim detention for eight months, he accepted the joint suggestion of counsel that St‑Germain be credited for 16 months of detention and given the following sentences: 12 months in custody for the first offence, 11 months in custody for the second offence, consecutive to the first sentence, and 11 months in custody for the third offence, concurrent with the second sentence. The trial judge also ordered that St‑Germain be on probation for three years after being released from prison.

Droit criminel - Détermination de la peine - Sanctions particulières - Probation - Calcul de la peine pour fins de probation - Détention provisoire - Une ordonnance de probation peut-elle être ajoutée à une peine d’emprisonnement dont la durée est réduite à moins de deux ans, en raison de la prise en compte du temps passé par l’accusé en détention préventive?
St-Germain est déclaré coupable de “gangstérisme” en vertu de l’art. 467.11 du Code criminel d’avoir fait le traffic d’une drogue et d’avoir comploté à cette dernière fin. Le juge du procès désirait infligée une peine de prison globale de 39 mois. Or, étant donné que St-Germain avait été en détention provisoire durant huit mois, il a accepté la suggestion commune des avocats de donner crédit à St-Germain de 16 mois de détention et de la condamner aux peines suivantes: détention de 12 mois pour la première infraction, détention de 11 mois pour la deuxième infraction consécutivement à la première peine et détention de 11 mois pour la troisième infraction concurremment avec la deuxième peine. CASE SUMMARY
Criminal law — Parole — Whether order extending parole ineligibility period under s. 743.6(1.2) of Criminal Code, R.S.C. 1985, c. C‑46, can be made after sentence of imprisonment of two years or more imposed if credit for interim detention reduces sentence to less than two years.
On July 7, 2006, the Respondent entered guilty pleas on three counts of trafficking in narcotics, conspiracy to traffic and participation in the activities of a criminal organization.
The parties agreed to make a joint recommendation to the judge that the Respondent be sentenced to 39 months in a penitentiary less the months he had spent in interim detention, such that the actual sentence was 23 months in prison as of that date. The judge approved the suggestion.
However, the parties did not agree on whether s. 743.6(1.2) of the Criminal Code, R.S.C. 1985, c. C‑46, could be applied to delay the Respondent’s parole eligibility.
After weighing both parties’ arguments, the judge concluded that, although the actual sentence was for less than two years, account had to be taken of the sentence as a whole, with the result that s. 743.6 applied and was imposed on the Respondent. However, the Quebec Court of Appeal set aside the order.

RÉSUMÉ DE L’AFFAIRE
Droit criminel — Libération conditionnelle — Une ordonnance prolongeant la période d’inadmissibilité à la libération conditionnelle en vertu du paragraphe 743.6 (1.2) du Code criminel, L.R.C. 1985, ch. C-46, peut-elle être émise suite à l’imposition d’une peine d’emprisonnement de deux ans ou plus, si le crédit pour détention provisoire la réduit à une période inférieure à deux ans ?
En date du 7 juillet 2006, l’intimé enregistrait des plaidoyers de culpabilité aux trois chefs d’accusation portés contre lui, soit de trafic de stupéfiants, de complot en vue de commettre un trafic et de participation aux activités d’une organisation criminelle.
Les parties s’entendaient pour soumettre au juge une recommandation commune quant à la peine à être imposée qui était de l’ordre de trente-neuf mois de pénitencier, dont on devait déduire les mois passés par l’intimé en détention préventive, de sorte que la peine effective était de vingt-trois mois de prison à compter de cette date. Le juge a entériné cette suggestion.
Les parties ne s’entendaient cependant pas sur l’application de l’article 743.6 (1.2) du Code criminel, L.R.C. 1985, ch. C-46, relativement à l’augmentation du temps d’épreuve au niveau de l’admissibilité à une libération conditionnelle de l’intimé.
Après avoir soupesé les arguments des parties de part et d’autre, le juge en venait à la conclusion que bien que la peine effective en était une de moins de deux ans, on devait tenir compte de la globalité de la peine et en conséquence l’article 743.6 trouvait application et a été imposée à l’intimé. La Cour d’appel du Québec a toutefois annulé l’ordonnance.

CASE SUMMARY
Criminal law – Sentencing – Whether probation order can be added to sentence of imprisonment where length of sentence does not exceed two years because account is taken of time spent by accused in pre‑sentence custody.
The accused, Feng Jin, was convicted of aggravated assault, sexual assault, uttering threats and possession of incendiary material. By the time he was sentenced, he had already spent 13 months in pre‑sentence custody. The sentencing judge sentenced him to 43 months of imprisonment. Finding that the pre‑sentence custody was equivalent to 26 months of incarceration, the judge concluded that the accused had to serve 17 months in prison and be on probation for 3 years.
Relying on R. v. Fice, [2005] 1 S.C.R. 742, the majority of the Court of Appeal found that the probation order was valid. Dalphond J.A. did not agree with the majority on this point and would have set aside the probation order.

L’accusé, Feng Jin, a été reconnu coupable de voies de fait graves, d’agression sexuelle, de menaces ainsi que de possession de matières incendiaires. Au moment du prononcé de la peine, il avait déjà passé 13 mois en détention préventive. Le juge chargé de déterminer la peine a condamné l’accusé à une peine d’emprisonnement de 43 mois. Estimant que la détention présentencielle équivalait à 26 mois d’incarcération, le juge a donc conclu que l’accusé devait purger une peine de 17 mois et 3 ans de probation.
Se fondant sur l’arrêt R. c. Fice, [2005] 1 R.C.S. 742, la majorité de la Cour d’appel a considéré que l’imposition de la probation était valable. Le juge Dalphond, ne partageant pas l’avis de la majorité sur cet aspect, aurait annulé l’ordonnance de probation.
