CASE SUMMARY
Civil procedure - Discovery - Courts ‐ Judges ‐ Did the learned trial judge deprive the Applicants of their right to a fair hearing and determination of their Constitutional rights by prohibiting the Applicants from leading relevant evidence, notably oral history evidence, unless it had been reduced to writing and provided to the Crown in advance of trial? ‐ Did the learned trial judge err in issuing an order striking all 25 of the Applicants’ lay witnesses, notably First Nations Elders, eight of whom had already testified at trial?‐ Would the trial judge’s extraordinarily harsh, unfounded, and insulting statements against the Applicants raise a reasonable apprehension of bias in the mind of the right‐thinking and informed observer?
The Applicants are an Aboriginal Band that applied for an order in 1986, declaring that certain amendments to the Indian Act, R.S.C. 1985, c. I‐5, breached their rights under s. 35 of the Constitution Act, 1982 as an invalid attempt to deprive them of their right to determine the membership of their own bands. The trial began in September of 1993 and ended in a dismissal of the action in 1995. The Federal Court of Appeal set aside that decision on the basis of reasonable apprehension of bias in 1997, and ordered a retrial. In 2004, after the oral discovery process became unproductive, the case management judge ordered that the parties provide disclosure to one another by way of written “will‐says” for all of their lay witnesses. The new trial commenced in January of 2007 after ten years of procedural disputes. The trial judge made a series of rulings in support of the 2004 order that precluded the parties from eliciting any evidence from lay witnesses that had not first been disclosed to the other side in written will‐say statements. The Applicants did not comply with the trial judge’s order that they give court reassurances that their will‐says provided adequate disclosure for their 57 potential lay witnesses. On September 11, 2007, the trial judge struck out all of the Applicants’ past and future lay witnesses because of non‐compliant will‐says. The Applicants were granted extra time to prepare for trial. On January 7, 2008, the Applicants informed the court that they would not call further evidence and were closing their case as they wished to proceed directly to appeal.

RÉSUMÉ DE L’AFFAIRE
Procédure civile - Enquête préalable - Tribunaux ‐ Juges ‐ Le juge de première instance a-t-il privé les demanderesses de leur droit à un procès équitable portant sur leurs droits constitutionnels en leur interdisant de présenter une preuve pertinente, notamment une preuve d’histoire orale, à moins qu’elle ne soit réduite par écrit et fournie à la Couronne préalablement au procès? ‐ Le juge de première instance a-t-il eu tort de rendre une ordonnance de radiation de tous les témoins ordinaires des demanderesses, notamment des aînés des Premières nations, dont huit avaient déjà témoigné au procès?‐ Les déclarations extraordinairement durs, non fondés et insultants du juge de première instance contre les demanderesses soulèveraient-elles un crainte raisonnable de partialité dans l’esprit de l’observateur sensé et informé?
Les demanderesses sont une bande indienne qui a demandé une ordonnance en 1986 déclarant que certaines modifications à la Loi sur les indiens, L.R.C. 1985, ch. I‐5, avaient porté atteinte à des droits que leur garantit l’art. 35 de la Loi constitutionnelle de 1982 en tant que tentative invalide de les priver de leur droit de déterminer qui était membre de leurs propres bandes. Le procès a commencé en septembre 1993 et a pris fin avec le rejet de l’action en 1995. La Cour d’appel fédérale a annulé cette décision en 1997 en raison d’une crainte raisonnable de partialité et a ordonné un nouveau procès. En 2004, après que le processus de communication de la preuve orale est devenue non productive, le juge responsable de la gestion de l’instance a ordonné que les parties se communiquent leur preuve par voie de sommaires écrits des dépositions de tous leurs témoins ordinaires. Le nouveau procès a commencé en janvier 2007 après dix ans de litiges sur la procédure. Le juge de première instance a rendu une série de décisions au soutien de l’ordonnance de 2004 qui ont empêché les parties de présenter toute preuve de témoins ordinaires qui n’avait pas d’abord été communiquée à la partie adverse sous forme de sommaire écrit des dépositions des témoins. Les demanderesses ne se sont pas conformées à l’ordonnance du juge de première instance voulant qu’elles fournissent au tribunal des assurances que leurs sommaires de dépositions constitueraient une communication adéquate des dépositions de leurs 57 témoins ordinaires éventuels . Le 11 septembre 2007, le juge de première instance a radié tous les témoins ordinaires passés et futurs des demanderesses en raison de sommaires non conformes. Les demanderesses se sont vu accorder un délai supplémentaire pour se préparer au procès. Le 7 janvier 2008, les demanderesses ont informé la cour qu’elles ne présenteraient plus de preuve et qu’elles mettaient fin à leur demande, puisqu’elles souhaitaient aller directement en appel.

Evidence ‐ Admissibility ‐ Hearsay evidence - Judgments and orders ‐ Interlocutory orders ‐ Anton Piller order ‐ Requirements for order ‐ Injunctions ‐ Mareva injunction ‐ Did the Court of Appeal err in law in interfering with the inherent jurisdiction of a superior court judge in an interlocutory ex parte application for an Anton Piller order, to admit as evidence, the uncontested findings of a prior judicial decision of a fellow superior court judge?‐ In the context of an ex parte application, did the Court of Appeal err in law in disallowing the evidentiary use of a prior judicial determination, and in holding that the Rowbotham facts were inadmissible for any purpose, except to the extent that they were binding and could found issue estoppel and/or abuse of process?
Ripudaman Singh Malik (“Mr. Malik”) was charged in connection with the 1985 Air India bombing. He entered into a series of agreements with the Applicant for assistance in funding his defence costs. When Mr. Malik failed to transfer his assets to the Applicant as required by the agreements, the Applicant gave notice it would terminate the funding. Mr. Malik brought an application seeking relief pursuant to the decision in R. v. Rowbotham (1988), 41 C.C.C. (3d) 1, 25 O.A.C. 321. Madam Justice Stromberg‐Stein dismissed Mr. Malik’s application on the basis that he failed to discharge the onus of establishing that he was not in a position to contribute to funding his defence, and that he had disentitled himself to Rowbotham funding by his actions: 2003 BCSC 1439, 111 C.R.R. (2d) 40. The Applicant ultimately brought an action against the Respondents and others seeking recovery of the funds provided, and applied ex parte for a Mareva injunction and an Anton Piller order, relying on affidavit evidence and the findings from 2003 BCSC 1439.

Ripudaman Singh Malik (« M. Malik ») a été accusé en lien avec l’attentat à la bombe contre un avion d’Air India en 1985. Il a conclu une série d’ententes avec la demanderesse pour de l’aide au financement de ses frais de défense. Lorsque M. Malik a cessé de transférer ses biens à la demanderesse comme le prescrivaient les ententes, la demanderesse a donné un avis comme quoi elle cesserait le financement. Monsieur Malik a présenté une demande de réparation fondée sur l’arrêt R. c. Rowbotham (1988), 41 C.C.C. (3d) 1, 25 O.A.C. 321. Madame la juge Stromberg‐Stein a rejeté la demande de M. Malik au motif qu’il ne s’était pas acquitté du fardeau d’établir qu’il n’était pas en mesure de contribuer au financement de sa défense et qu’il s’était privé du droit à du financement fondé sur l’arrêt Rowbotham par ses gestes : 2003 BCSC 1439, 111 C.R.R. (2d) 40. La demanderesse a finalement intenté une action contre les intimés et d’autres pour le recouvrement des fonds fournis et a présenté une demande ex parte d’injonction Mareva et d’ordonnance Anton Piller, s’appuyant sur une preuve par affidavit et les conclusions du jugement publié à 2003 BCSC 1439.

À l’issue d’un procès devant juge et jury, Émile Bergeron est déclaré coupable de meurtre au deuxième degré de son épouse. En effet, le 21 octobre 1998, la victime est morte écrasée sous un tracteur de ferme conduit par son époux. Émile Bergeron présente une procédure conjointe en avis d’appel et pour permission d’appeler de sa déclaration de culpabilité.

CASE SUMMARY
Torts ‐ Negligence ‐ Motor vehicles ‐ Whether it is a reviewable error if a trial judge fails to consider whether the accident which injured the plaintiff would ordinarily occur without negligence, in circumstances where it was practically impossible for the plaintiff to lead evidence on breach of the standard of care.
Catherine Michel was walking along the shoulder of a highway in British Columbia when she was struck in the head by an object that came off a logging truck. She suffered a serious and permanent disabling brain injury. The driver of the truck, who was in all likelihood unaware of the incident, did not stop. Michel, through her litigation guardian, sued the unidentified driver and the unidentified owner of the logging truck.

Catherine Michel marchait sur l’accotement d’une route en Colombie-Britannique lorsqu’elle a été frappée à la tête par un objet qui s’est détaché d’un camion grumier. Elle a subi un traumatisme crânien grave qui a entraîné une invalidité permanente. Le chauffeur du camion, qui n’a vraisemblablement pas eu connaissance de l’incident, ne s’est pas arrêté. Madame Michel, par sa tutrice à l’instance, a poursuivi le chauffeur non identifié et le propriétaire non identifié du camion grumier.
Le juge de première instance a rejeté l’action sur une requête en jugement sommaire. À son avis, la demanderesse, Mme Michel, n’avait pas fait la preuve prima facie de négligence. L’appel à la Cour d’appel de la Colombie-Britannique a été rejeté.

Torts - Negligence - Duty of care - Crown liability - Did the Court of Appeal err in striking the Applicant’s statement of claim which alleged that the provincial government has a private law duty of care to prohibit or regulate the use of mercury in dental practice which, it is alleged, has caused injury to the Applicant’s health?
Based on the statement of claim, the Applicant had 17 teeth filled with mercury amalgam fillings as a teenager. She was not informed of the composition of the dental amalgams, given another option, or warned of any risks associated with the use of mercury fillings on her or her future children. Both the Applicant and her son have suffered from a series of health difficulties which she attributes to the mercury amalgam fillings.

Selon la déclaration, la demanderesse s’est fait poser à l’adolescence 17 amalgames dentaires de mercure. Elle n’a pas été informée de la composition des amalgames dentaires, elle ne s’est pas vu offrir d’autres choix et elle n’a pas reçu de mise en garde sur les risques liés à l’utilisation d’amalgames de mercure pour sa santé ou celle de ses enfants à naître. La demanderesse et son fils ont tous les deux soufferts d’une série de problèmes de santé qu’elle attribue aux amalgames dentaires de mercure.

CASE SUMMARY
Criminal law - Private prosecution - Appeal - Adjournment - Whether the justice of the peace exceeded his jurisdiction in refusing to issue process - Whether the lower courts erred in refusing the adjournments and dismissing the application for judicial review and the appeal - Criminal Code, R.S.C. 1985, C‐46, s. 507.1.
The Applicant, Mr. Gebremariam, alleges that in 1994, his six-year-old son was physically and sexually assaulted by his school principal and that a teacher also physically assaulted him and was complicit in the sexual assault. He reported this to various authorities (the Catholic Children’s Aid Society and the police), but after several investigations in 1994, 1997 and 1998, no charges were laid. Medical examinations revealed no signs of physical or sexual abuse. In 2005, Mr. Gebremariam laid a private information before a justice of the peace, seeking to have process issued against the principal and the teacher on charges of sexual and physical assault. The information on the common assault charge was refused in light of the expiration of the limitation period. At a pre-inquiry hearing under s. 507.1 of the Criminal Code, a justice of the peace found that there was no prima facie case against either of the proposed accused and refused to issue process on the sexual assault charge.
Mr. Gebremariam sought judicial review of that decision to the Ontario Superior Court of Justice, claiming that the justice of the peace had exceeded his jurisdiction. He sought a writ of mandamus with certiorari in aid directing a justice of the peace to issue process. He requested and obtained three adjournments, but on December 3, 2007, Speyer J. refused an additional adjournment and dismissed the application for judicial review. Mr. Gebremariam appealed the decision. He obtained two adjournments, but Armstrong J.A. refused him a third adjournment brought on the basis of his need to file a supplementary appeal book and his wish to retain counsel. The day before the hearing, Mr. Gebremariam again sought an adjournment, this time on the ground that he was ill and that he wished to retain counsel. The adjournment request was denied the following day, on the grounds that (1) there was no evidence of medical incapacity and (2) in light of the circumstances, it was clear that Mr. Gebremariam had had ample opportunity to retain counsel, had he wished to do so, since he had used this reason to obtain adjournments in the past. The Court of Appeal dismissed the appeal. It found that Speyer J. had not erred in the exercise of his discretion not to allow a further adjournment. Also, it was open to Speyer J. to find that the justice of the peace had not exceeded his jurisdiction in declining to issue process.

Droit criminel - Poursuite privée - Appel - Ajournement - Le juge de paix a-t-il outrepassé sa compétence en refusant de délivrer un acte de procédure? - Les juridictions inférieures ont-elles eu tort de refuser les ajournements et de rejeter la demande de contrôle judiciaire et l’appel? - Code criminel, R.C.S. 1985, C‐46, art. 507.1.
Le demandeur, M. Gebremariam, allègue qu’en 1994, son fils de six ans aurait été physiquement et sexuellement agressé par le directeur de son école et qu’un enseignant l’aurait physiquement agressé lui-aussi et aurait été complice de l’agression sexuelle. Il a fait un signalement en ce sens à diverses autorités (le service catholique d’aide à l’enfance et la police), mais après plusieurs enquêtes en 1994, 1997 et 1998, aucune accusation n’a été portée. Des examens médicaux n’ont révélé aucun signe d’abus physique ou sexuel. En 2005, M. Gebremariam a déposé une dénonciation privée devant un juge de paix, demandant qu’un acte de procédure soit délivré contre le directeur et l’enseignant sur des accusations d’agression sexuelle et physique. La dénonciation relative à l’accusation de voies de fait simples a été refusée vu l’expiration du délai de prescription. À une audience préalable à l’enquête tenue en vertu de l’art. 507.1 du Code criminel, un juge de paix a conclu qu’il n’y avait pas de preuve prima facie contre les accusés proposés et a refusé de délivrer un acte de procédure relativement à l’accusation d’agression sexuelle.
Monsieur Gebremariam a demandé le contrôle judiciaire de cette décision à la Cour supérieure de justice de l’Ontario, alléguant que le juge de paix avait outrepassé sa compétence. Il a demandé un bref de mandamus avec certiorari auxiliaire ordonnant au juge de paix de délivrer l’acte de procédure. Il a demandé et obtenu trois ajournements, mais le 3 décembre 2007, le juge Speyer a refusé un ajournement supplémentaire et a rejeté la demande de contrôle judiciaire. Monsieur Gebremariam a interjeté appel de la décision. Il a obtenu deux ajournements, mais le juge d’appel Armstrong lui a refusé un troisième ajournement, demandé en invoquant le besoin de déposer un cahier d’appel supplémentaire et sa volonté de retenir les services d’un avocat. Le jour avant l’audience, M. Gebremariam a encore une fois demandé un ajournement, cette fois là parce qu’il était malade et qu’il voulait retenir les services d’un avocat. La demande d’ajournement a été rejetée le jour suivant vu (1) qu’il n’y avait pas de preuve d’incapacité médicale et (2) qu’à la lumière des faits, il était clair que M. Gebremariam avait eu amplement l’occasion de retenir les services d’un avocat, s’il avait voulu le faire, puisqu’il avait invoqué ce motif pour obtenir des ajournements dans le passé. La Cour d’appel a rejeté l’appel. Elle a conclu que le juge Speyer n’avait pas commis d’erreur dans l’exercice de sa compétence de ne pas autoriser un autre ajournement. De plus, il était loisible au juge Speyer de conclure que le juge de paix n’avait pas outrepassé sa compétence en refusant de délivrer un acte de procédure.

The Applicant, Pierre Latreille, represented some personal insurance agents working for the Respondent, the Industrial Alliance Life Insurance Company (“Industrial”), in a class action. The purpose of the action was to have clause 14 of the contract between Mr. Latreille and Industrial declared null. Clause 14 provided that no compensation was payable as of the date of resiliation of the contract. It related mainly but not exclusively to the future payment of commissions on the renewal of insurance policies sold by the agent. The Superior Court dismissed the action, finding that clause 14 was not abusive within the meaning of art. 1437 C.C.Q. The Court of Appeal dismissed the appeal.

Le recours avait pour objet de faire déclarer nulle la clause 14 du contrat liant M. Latreille à L’Industrielle. La clause stipule qu’aucune rémunération n’est payable à compter de la date de résiliation du contrat. Elle vise surtout, mais non exclusivement, les paiements futurs de commissions de renouvellement des polices d’assurance vendues par l’agent. La Cour supérieure a rejeté le recours jugeant que la clause 14 n’était pas abusive au sens de l’art. 1437 C.c.Q. La Cour d’appel a rejeté l’appel.
