Droit constitutionnel — Charte des droits — Réparation — Exclusion de la preuve — Violation du droit de l’accusé contre les fouilles, perquisitions et saisies abusives — Refus de la juge du procès d’écarter la preuve en vertu de l’art. 24(2) de la Charte canadienne des droits et libertés — La preuve aurait‑elle dû être écartée?
Lors d’une enquête en matière de trafic de drogue, des agents de la GRC ont obtenu un mandat les autorisant à intercepter les conversations privées de l’accusé. Pendant qu’ils installaient le dispositif d’écoute dans la voiture de ce dernier, ils ont découvert un compartiment secret contenant un étui en cuir dans lequel se trouvait une arme à feu chargée. L’arme a été rendue inutilisable puis remise à sa place dans la voiture. L’accusé a plus tard a été reconnu coupable d’avoir eu en sa possession une arme à feu prohibée chargée. Bien que l’arme à feu n’ait jamais été retrouvée et n’ait donc pas été présentée en preuve au procès, l’accusé a contesté l’admissibilité du témoignage sur sa découverte. La juge du procès a estimé que la fouille dépassait le cadre du mandat et contrevenait à l’art. 8 de la Charte canadienne des droits et libertés, mais il a refusé d’écarter l’élément de preuve en application du par. 24(2), essentiellement au motif que les policiers ne croyaient pas outrepasser les pouvoirs que leur accordait le mandat et qu’ils n’avaient pas fait preuve d’un mépris flagrant pour les droits garantis à l’accusé par la Charte. La majorité de la Cour d’appel a infirmé la décision de la juge du procès d’admettre l’élément de preuve et a annulé la déclaration de culpabilité.
Arrêt: Le pourvoi est accueilli.
Il y a lieu d’annuler la décision de la Cour d’appel et de rétablir la déclaration de culpabilité. Il convient de faire preuve d’une retenue considérable à l’égard de l’appréciation que fait le juge du procès en application du par. 24(2); en l’espèce, la juge du procès a pris en compte les éléments qu’il fallait et n’a tiré aucune conclusion déraisonnable. Le fait que ni la juge du procès ni la Cour d’appel ne disposaient, pour l’analyse fondée sur le par. 24(2), du nouvel examen en trois points établi dans l’arrêt R. c. Grant, 2009 CSC 32, [2009] 2 R.C.S. 353, n’a aucune incidence sur l’issue de l’espèce, puisque les facteurs de cette analyse n’ont pas changé et qu’il ressort clairement des motifs de la juge du procès que l’application des trois facteurs énoncés dans Grant aurait milité en faveur de l’admission de la preuve.
POURVOI contre un arrêt de la Cour d’appel du Québec (les juges Gendreau, Dalphond et Côté), 2009 QCCA 797, [2009] J.Q. no 380 (QL), 2009 CarswellQue 3887, qui a annulé la déclaration de culpabilité de l’accusé. Pourvoi accueilli.

Constitutional law — Charter of Rights — Enforcement — Exclusion of evidence — Violation of accused’s right against unreasonable search and seizure — Trial judge declining to exclude evidence under s. 24(2) of Canadian Charter of Rights and Freedoms — Whether evidence should have been excluded.
During the course of an investigation into drug trafficking, RCMP officers obtained a warrant authorizing them to intercept the accused’s private communications. While installing listening devices in his car, they found a hidden compartment containing a leather case with a loaded firearm in it. The firearm was rendered unusable and placed back in the car. The accused was later convicted of possession of a loaded prohibited firearm. Although the firearm itself was never recovered and therefore not in evidence at trial, the accused challenged the admissibility of the testimony relating to its discovery. The trial judge found that the search exceeded the scope of the warrant and violated s. 8 of the Canadian Charter of Rights and Freedoms but declined to exclude the evidence pursuant to s. 24(2), primarily on the basis that the police officers did not believe they were exceeding the powers granted to them by the warrant and had not evidenced a flagrant disregard of the accused’s Charter rights. A majority of the Court of Appeal reversed the trial judge’s decision to admit the evidence and set aside the conviction.
Held: The appeal should be allowed.
The Court of Appeal’s decision should be set aside and the accused’s conviction restored. Considerable deference is owed to a trial judge’s s. 24(2) assessment and, in this case, she considered the proper factors and made no unreasonable findings. The fact that the trial judge and the Court of Appeal did not have the benefit of the new three‑part s. 24(2) inquiry set out in R. v. Grant, 2009 SCC 32, [2009] 2 S.C.R. 353, does not affect the outcome of this case because the relevant factors in a s. 24(2) analysis have not changed and the trial judge’s reasons make clear that the three Grant considerations point toward admitting the evidence.
