Subscriptions may be had at $200 per year, payable in advance, in accordance with the Court tariff. During Court sessions it is usually issued weekly.

The Bulletin, being a factual report of recorded proceedings, is produced in the language of record. Where a judgment has been rendered, requests for copies should be made to the Registrar, with a remittance of $10 for each set of reasons. All remittances should be made payable to the Receiver General for Canada.

Le juge LeBel (oralement) -- Après avoir examiné le dossier d'appel et les moyens soutenus par les parties, la Cour est unanimement d'avis de rejeter le pourvoi. Cependant, il n'est pas nécessaire de traiter de l'ensemble des questions de droit soulevées dans le présent appel. Toutefois, au sujet de la question de la nécessité d'une preuve d'expert à propos du changement du comportement de l'enfant que l'intimé aurait agressé selon la poursuite, il appert que la Cour d'appel du Québec n'a jamais entendu imposer une règle de droit exigeant une telle preuve en toutes circonstances. Il suffit alors de constater que la nature de la preuve présentée devant la Cour du Québec justifie la conclusion que l'on peut tirer de l'arrêt de la Cour d'appel du Québec selon laquelle le verdict de culpabilité prononcé par le juge de première instance avait un caractère déraisonnable. Bien que recevable, la preuve présentée à l'appui de la poursuite ne pouvait permettre de conclure à la culpabilité du prévenu, selon la norme de la preuve hors d'un doute raisonnable.
The appeal from the judgment of the Court of Appeal of Quebec (Québec), Number 200-10-001094-007, dated March 5, 2002, was heard this day and the following judgment was rendered:

LeBel J. (orally) -- Having examined the appeal record and the arguments made by the parties, the Court is unanimously of the view that the appeal should be dismissed. However, it is not necessary to deal with all the questions of law raised in this appeal. Nonetheless, with respect to the question of the need for expert evidence concerning the change in behaviour of the child the prosecution alleges was assaulted by the respondent, it appears that the Quebec Court of Appeal never intended to impose a rule of law requiring such evidence in all circumstances. It is sufficient to note that the nature of the evidence presented in the Court of Québec justifies the conclusion that can be drawn from the Quebec Court of Appeal's decision that the verdict of guilty handed down by the trial judge was unreasonable. Although admissible, the evidence presented in support of the prosecution could not support a finding that the accused was guilty, on the standard of proof beyond a reasonable doubt.

ORDONNANCE
Après l'examen du dossier et l'étude des questions constitutionnelles soumises par l'appelant, il paraît à la Cour que ces dernières ne reflètent pas complètement l'ensemble des problèmes constitutionnels que soulève possiblement le pourvoi. En effet, il se peut que l'examen de ces problèmes exige aussi l'étude de problèmes reliés à la validité constitutionnelle des dispositions en cause, à l'égard du partage des pouvoirs entre le Parlement et les législatures provinciales. Dans ce contexte, la Cour estime nécessaire que tous les intéressés soient informés plus précisément des enjeux possibles du présent appel. La Cour signale aussi le problème de concordance que posent les versions française et anglaise de l'article 672.63 du Code criminel et souhaite que les parties y portent attention dans leurs représentations éventuelles.
En conséquence :
- La Cour reporte l'audition du pourvoi à une date à être déterminée.

After examining the record and reviewing the constitutional questions submitted by the appellant, it seems to the Court that the latter do not completely reflect all of the constitutional problems potentially raised by the appeal. It is possible that an examination of these problems will also require a consideration of problems relating to the constitutional validity of the provisions in question, in light of the division of powers between Parliament and the provincial legislatures. In these circumstances, the Court considers it necessary that all those concerned be informed more precisely of what is potentially at stake in this appeal. The Court also notes the problem of consistency between the English and French versions of section 672.63 of the Criminal Code and would like the parties to address it in any representations they may make.
Accordingly:
1. The Court adjourns the hearing of the appeal to a date to be determined.
2. The appellant shall reformulate the constitutional questions so as to include the necessary information concerning any division of powers problems that may be raised by the appeal and submit these amendments to the Court by October 23, 2003.
3. After the constitutional questions have been approved, the necessary procedure and schedule will be determined and communicated to the parties and the interveners.

O.13, and s. 25 of the Ontario Energy Board Act, 1998, S.O. 1998, c. 15, Sched. B, are constitutionally inoperative by reason of the paramountcy of s. 347 of the Criminal Code, R.S.C. 1985, c. C-46.

The Fall Session of the Supreme Court of Canada will commence October 6, 2003.
Pursuant to the Supreme Court Act and Rules, the following requirements for filing must be complied with before an appeal can be heard:
Appellant's record; appellant's factum; and appellant's book(s) of authorities must be filed within 12 weeks of the filing of the notice of appeal or 12 weeks from decision on the motion to state a constitutional question.
Respondent's record (if any); respondent's factum; and respondent's book(s) of authorities must be filed within eight weeks after the service of the appellant's documents.
Intervener's factum and intervener's book(s) of authorities, (if any), must be filed within eight weeks of the order granting leave to intervene or within 20 weeks of the filing of a notice of intervention under subrule 61(4).
Parties' condensed book, if required, must be filed on the day of hearing of the appeal.
The Registrar shall enter the appeal on a list of cases to be heard after the respondent's factum is filed or at the end of the eight-week period referred to in Rule 36.
La session d' automne de la Cour suprême du Canada commencera le 6 octobre 2003.
Conformément à la Loi sur la Cour suprême et aux Règles, il faut se conformer aux exigences suivantes avant qu'un appel puisse être entendu:
Le dossier de l'appelant, son mémoire et son recueil de jurisprudence et de doctrine doivent être déposés dans les douze semaines du dépôt de l'avis d'appel ou douze semaines de la décision de la requête pour formulation d'une question constitutionnelle.
Le dossier de l'intimé (le cas échéant), son mémoire et son recueil de jurisprudence et de doctrine doivent être déposés dans les huit semaines suivant la signification des documents de l'appelant.
Le mémoire de l'intervenant et son recueil de jurisprudence et de doctrine, le cas échéant, doivent être déposés dans les huit semaines suivant l'ordonnance autorisant l'intervention ou dans les vingt semaines suivant le dépôt de l'avis d'intervention visé au paragraphe 61(4).
Le recueil condensé des parties, le cas échéant, doivent être déposés le jour de l'audition de l'appel.
Le registraire inscrit l'appel pour audition après le dépôt du mémoire de l'intimé ou à l'expiration du délai de huit semaines prévu à la règle 36.
