Nature of the case:
Criminal Law - Evidence - Evidence to contrary - Testimony of accused - Expert witness - Whether, in assessing evidence to contrary, court must consider defendant’s testimony even though it has rejected that testimony outright - Whether evidence to contrary can be based solely on testimony of expert that is itself based not on proven facts but on hypothetical facts or conjecture - Whether, in assessing evidence to contrary, court may consider absence of apparent symptoms of intoxication of defendant even though no expert evidence has established defendant’s tolerance to alcohol.
|
|

Nature of the case:
Canadian Charter of Rights and Freedoms - Criminal law - Right to silence - Post-offence conduct - Cross-examination - Jury instruction - Does the right to silence extend to a situation when a person who is not detained or under investigation voluntarily elects to seek out and speak to police with respect to crimes of which the police have no knowledge? - Does the right to silence preclude the Crown from asking the trier of fact to draw inferences from what was knowingly omitted or not said by this person about these crimes prior to his detention?
