SOPINKA J. -- This appeal is here as of right. We agree with the Court of Appeal that this was not one of the clearest cases in which a stay of proceedings was warranted. In our opinion, the Court of Appeal was justified in reviewing and reversing the trial judge’s exercise of his discretion by reason of the trial judge’s failure to take into account the absence on the part of the appellant of timely objection to non-disclosure and by reason of the trial judge’s error in finding that a stay was the only appropriate remedy. The appeal is dismissed.
LE JUGE SOPINKA -- Le présent pourvoi a été formé de plein droit. Nous sommes d’accord avec la Cour d’appel qu’il ne s’agissait pas d’un des cas les plus manifestes où un arrêt des procédures est justifié. À notre avis, la Cour d’appel était justifiée de contrôler l’exercice par le juge du procès de son pouvoir discrétionnaire et d’infirmer la décision de ce dernier pour le motif qu’il n’avait pas tenu compte du fait que l’appelant n’avait pas soulevé, en temps opportun, d’objection concernant la non-communication de la preuve, et pour le motif que le juge du procès avait commis une erreur en concluant que l’arrêt des procédures était la seule réparation convenable. Le pourvoi est rejeté.

Pursuant to the Supreme Court Act and Rules, the following requirements for filing must be complied with before an appeal will be inscribed and set down for hearing:
Case on appeal must be filed within three months of the filing of the notice of appeal.
Appellant's factum must be filed within four months of the filing of the notice of appeal.
Respondent's factum must be filed within eight weeks of the date of service of the appellant's factum.
Intervener's factum must be filed within four weeks of the date of service of the respondent's factum.
The Registrar shall inscribe the appeal for hearing upon the filing of the respondent's factum or after the expiry of the time for filing the respondent's factum
