AND THE MATERIAL FILED having been read;
IT IS HEREBY ORDERED THAT:
The motion for leave to intervene by Raoul Wallenberg Centre for Human Rights is dismissed because this motion is not compliant with the requirements of Rule 57(2)(b) of the Rules of the Supreme Court of Canada.
The motions for leave to intervene by the Attorney General of Alberta; the Attorney General of Manitoba; the Attorney General of Ontario; Criminal Trial Lawyers’ Association; Trial Lawyers Association of British Columbia are granted and the five (5) interveners shall be entitled to each serve and file a single factum, not to exceed ten (10) pages in length, and a book of authorities, if any, on or before August 30, 2024.

The appeals from the judgment of the Court of Appeal for Ontario, Numbers C66455 and C68595, 2021 ONCA 779, dated November 5, 2021, heard on November 8, 2023, are allowed in part and the cross-appeals are dismissed.
It is declared that:
1. Under the Augmentation Clause of the Robinson Treaties, the Crown has a duty to consider, from time to time, whether it can increase the annuities without incurring loss.
2. If the Crown can increase the annuities without incurring loss, it must exercise its discretion as to whether to increase the annuities and, if so, by how much.
3. In carrying out these duties and in exercising its discretion, the Crown must act in a manner consistent with the honour of the Crown, including the duty of diligent implementation.
4. The Crown’s discretion must be exercised diligently, honourably, liberally, and justly. Its discretion is not unfettered and is subject to review by the courts.
5. The Crown dishonourably breached the Robinson Treaties by failing to diligently fulfill the Augmentation Clause.
6. The Crown is obliged to determine an amount of honourable compensation to the Superior plaintiffs for amounts owed under the Augmentation Clause for the period between 1875 and the present.
In addition, further directions are provided at paras. 305 to 310 of the Court’s reasons for judgment.
The stay imposed in respect of the Stage Three trial proceedings shall continue for an additional six months from the release of the present judgment.
The respondents/appellants on cross-appeal are awarded their costs of the appeals and cross-appeals, on a solicitor-client basis.

Les appels interjetés contre l’arrêt de la Cour d’appel de l’Ontario, numéros C66455 et C68595, 2021 ONCA 779, daté du 5 novembre 2021, entendus le 8 novembre 2023, sont accueillis en partie et les pourvois incidents sont rejetés.
Il est déclaré que :
1. Suivant la clause d’augmentation des Traités Robinson, la Couronne a le devoir de se demander, de temps en temps, si elle peut majorer les annuités sans encourir de pertes.
2. S’il lui est possible de majorer les annuités sans encourir de pertes, la Couronne doit exercer son pouvoir discrétionnaire de décider si elle majore les annuités et, si oui, de combien.
3. Dans l’accomplissement de ces devoirs et dans l’exercice de son pouvoir discrétionnaire, la Couronne doit agir conformément à son honneur, et notamment à son devoir de mise en œuvre diligente.
4. Le pouvoir discrétionnaire de la Couronne doit être exercé avec diligence, honorablement et avec justice et libéralité. Ce pouvoir n’est pas illimité et son exercice est susceptible de contrôle par les tribunaux.
5. La Couronne a violé de façon déshonorante les Traités Robinson en ne respectant pas avec diligence la clause d’augmentation.
6. La Couronne est tenue de déterminer le montant d’une indemnisation honorable à verser aux demandeurs du lac Supérieur à l’égard des sommes dues au titre de la clause d’augmentation pour la période écoulée depuis 1875.
De plus, des directives supplémentaires sont énoncées aux par. 305 à 310 des motifs de jugement de la Cour.
Le sursis imposé à l’égard des procédures de la troisième étape du procès est prorogé pour une période additionnelle de six mois à compter du prononcé du présent jugement.
Les dépens relatifs aux pourvois et aux pourvois incidents sont adjugés aux intimés/appelants aux pourvois incidents, sur une base avocat‐client.
