Le pourvoi est accueilli, l'arrêt des juges majoritaires de la Cour d'appel du Québec est annulé, et l'ordonnance du juge Rioux sur la responsabilité de la Couronne et les dommages-intérêts accordés par le juge Letarte sont rétablis. Les juges L'Heureux-Dubé, Gonthier et Bastarache sont dissidents. L'appelant a droit aux dépens devant notre Cour et devant les cours d'instance inférieure.
The appeal is allowed, the judgment of the majority of the Quebec Court of Appeal is set aside and the order of Rioux J. on the responsibility of the Crown and the damages award ordered by Letarte J. are restored, L'Heureux-Dubé, Gonthier and Bastarache JJ. dissenting. The appellant is entitled to his costs in this Court and in the courts below.

The appeal is dismissed with party and party costs to the respondent Sparling and solicitor-client costs to the respondent Mangat. The constitutional question is answered as follows:
1. Is s. 26 of the Legal Profession Act, S.B.C. 1987, c. 25, constitutionally inoperative or inapplicable to persons acting under ss. 30 and 69 of the Immigration Act, R.S.C. 1985, c. I-2, and its associated Rules and Regulations and, if so, are the latter provisions ultra vires Parliament?
Answer Section 26 of the Legal Profession Act is constitutionally inoperative to persons acting under ss. 30 and 69(1) of the Immigration Act and its associated Rules and Regulations. It is not necessary to determine whether this disposition is constitutionally inapplicable. The provisions are intra vires Parliament.
Le pourvoi est rejeté, des dépens entre parties sont accordés à l’intimée Sparling et des dépens procureur-client à l’intimé Mangat. La question constitutionnelle reçoit la réponse suivante:
1. Réponse L’article 26 de la Legal Profession Act est inopérant du point de vue constitutionnel à l’égard des personnes agissant en vertu de l’art. 30 et du par. 69(1) de la Loi sur l’immigration et ses textes d’application. Il n’est pas nécessaire de déterminer si cette disposition est inapplicable du point de vue constitutionnel. L’article 30 et le par. 69(1) de la Loi sur l’immigration relèvent de la compétence du Parlement.
