Le jugement de la Cour d’appel fédérale et les nouvelles cotisations établies à l’égard des appelants pour les années d’imposition 1981 à 1985 sont annulées. L’affaire est renvoyée à Revenu Canada pour qu’il établisse de nouvelles cotisations.
