Commercial law - Insurance - Automobile insurance - General liability insurance - Coverage - Exclusions - Concurring causes - Whether in a case involving multiple sources of causation, coverage under a liability policy should be afforded where one of the sources of causation is excluded from coverage while others are not - Whether the exclusion clause in the Commercial General Liability policy is triggered in that the loss arose out of the ownership, use or operation of an automobile.
Bell Canada entered into a contract with 539938 Ontario Ltd, operating as Roy’s Electric (the “Contractor”), for the placement of underground cables upon lands adjacent to Highway 11 in the District of Rainy River. Douglas Zub, a shareholder and employee of the Contractor, acted as a working foreman for the Contractor with respect to this work. Because of adverse weather conditions in the afternoon of December 5, 1994, work at the site was halted somewhat earlier than usual. During the clean up of the site, Mr. Zub removed a sign assembly from the side of the road. The sign assembly was made up of three components: a sign component, a shaft component and a steel base plate. Both the sign component and the shaft component were placed inside the Contractor’s supply truck. However, the steel base plate was placed on a cross-member of a compressor unit attached to the rear of the supply truck.
Mr. Zub then drove the supply truck towing the compressor unit in an easterly direction along Highway 11. The steel base plate flew from its position on the cross-member of the compressor unit and travelled through the window of an oncoming school bus, causing the death of one child and injuries to three others.
At the time of the accident, the Contractor was covered by an automobile insurance policy, a commercial general liability policy and an umbrella liability policy. A motion was brought for the determination of a special case seeking the opinion of the Ontario Court (General Division) on questions relating to the coverage provided by the various policies.
On September 9, 1998, Stach J. found that both the automobile insurance policy and the comprehensive provided primary coverage for damages resulting from the accident. The Appellants’ appeal of this decision was dismissed on July 22, 1999.

Bell Canada a conclu avec 539938 Ontario Ltd., exploitant son entreprise sous la raison sociale Roy’s Electric (l’« entrepreneur »), un contrat d’installation de câbles souterrains près de l’autoroute 11 dans le district Rainy River. Actionnaire et employé de l’entrepreneur, Douglas Zub était contremaître exécutant pour le compte de l’entrepreneur relativement à ces travaux. À cause du mauvais temps l’après‐midi du 5 décembre 1994, les travaux ont pris fin un peu plus tôt qu’à l’habitude. Pendant le déblaiement des lieux, M. Zub a enlevé un dispositif de signalisation se trouvant au bord de la route. Le dispositif se composait de trois éléments : un panneau, une tige et un socle d’acier. Le panneau et la tige ont été chargés à bord du camion d’approvisionnement de l’entrepreneur. Par contre, le socle d’acier a été posé sur une traverse du compresseur fixé à l’arrière du camion d’approvisionnement.
M. Zub a ensuite pris le volant du camion et s’est engagé sur l’autoroute 11 en direction est. Le socle d’acier reposant sur la traverse du compresseur a été projeté dans la vitre d’un autobus scolaire roulant en sens inverse causant ainsi la mort d’un enfant et en blessant trois autres.
Au moment de l’accident, l’entrepreneur était titulaire d’une assurance‐automobile, d’une assurance de la responsabilité civile commerciale et d’une assurance de la responsabilité civile complémentaire. La Cour de l’Ontario (division générale) a été saisie d’une requête afin qu’elle statue sur exposé de cause et se prononce sur des questions relatives à la garantie prévue par les différents contrats.
Le 9 septembre 1998, le juge Stach a conclu que le contrat d’assurance‐automobile et le contrat de la responsabilité civile - formule générale offraient une garantie de base pour les dommages causés par l’accident. L’appel interjeté par la partie appelante relativement à cette décision a été rejeté le 22 juillet 1999.
