The appeal from the judgment of the Court of Appeal of British Columbia (Vancouver), Number CA025465, dated April 17, 2001, heard on June 12, 2002 is allowed with costs throughout to the appellants. The question of whether the books should be approved is remanded to the School Board to be considered according to the criteria laid out in the Board’s own regulation, the curriculum guidelines and the broad principles of tolerance and non-sectarianism underlying the School Act. Gonthier and Bastarache JJ. are dissenting.
L'appel contre l'arrêt de la Cour d'appel de la Colombie‑Britannique (Vancouver), numéro CA025465, en date du 17 avril 2001, entendu le 12 juin 2002 est accueilli avec dépens en faveur des appelants dans toutes les cours. La question de savoir si les manuels devraient être approuvés est renvoyée au Conseil scolaire pour qu’il tranche en fonction des critères établis dans son règlement, des lignes directrices afférentes au programme d’études et des principes généraux de tolérance et de non-confessionnalité qui sous-tendent la School Act. Les juges Gonthier et Bastarache sont dissidents.
