Criminal law - Sentencing - Order for delayed parole - Whether the New Brunswick Court of Appeal erred in law in holding that the imposition of an order pursuant to s. 743.6 (1) of the Criminal Code on the Appellant was justified - Whether the Court of Appeal erred in law in holding that the Appellant was not denied procedural fairness in the imposition of the order.
The Appellant was charged with second‑degree murder in the killing of 19-year-old Stéphane Caissie (“Caissie”). According to the judgment of the Court of Appeal, the crime occurred at a house where there had been several break and enters. The Appellant, who was drinking heavily the day of the incident and does not recall the event, arrived at the Caissie home late at night and began to yell and bang at the door. When the victim opened the door, the Appellant shot him in the face with a single shot from a shotgun. Caissie died instantly. The Appellant threw away the spent cartridge, left his shotgun at the scene and went to a nearby residence, informing the occupant that he had just shot Caissie in the head. The neighbour called the police. The Appellant pleaded guilty to the included offence of manslaughter. The trial judge sentenced the Appellant to 12 years’ imprisonment, with the restriction that he serve at least one‑half of the term before being eligible to apply for parole. The Court of Appeal granted leave to appeal the sentence and dismissed the appeal.

Droit criminel - Détermination de la peine - Ordonnance d’augmentation du temps d’épreuve - La Cour d’appel du Nouveau‑Brunswick a‑t‑elle commis une erreur de droit en concluant qu’il était justifié de décerner l’ordonnance prévue au par. 743.6 (1) du Code criminel à l’égard de l’appelant? - La Cour d’appel a‑t‑elle commis une erreur de droit en concluant que l’appelant n’a pas été privé d’une procédure équitable lorsque l’ordonnance a été rendue?
L’appelant a été inculpé du meurtre au deuxième degré de Stéphane Caissie, âgé de 19 ans. D’après l’arrêt de la Cour d’appel, le crime s'est produit dans une maison dans laquelle plusieurs introductions par effraction avaient été commises. L’appelant, qui avait beaucoup bu le jour de l'incident et ne se souvient pas des faits, est arrivé chez les Caissie en fin de soirée et a commencé à hurler et à frapper à la porte. Lorsque la victime a ouvert la porte, l’appelant lui a tiré un seul coup de fusil de chasse au visage, et M. Caissie est mort instantanément. L’appelant a jeté la cartouche vide, a laissé son fusil de chasse sur les lieux et est allé dans un logement voisin pour informer l'occupant qu'il venait de tirer une balle dans la tête de M. Caissie. Le voisin a appelé la police. L’appelant a plaidé coupable à l'infraction incluse d'homicide involontaire coupable. Le juge du procès a condamné l'appelant à 12 ans d'incarcération. À cette peine s'ajoutait la restriction voulant que le délinquant purge au moins la moitié de sa peine avant d'avoir le droit de demander la libération conditionnelle. La Cour d’appel a accordé l’autorisation d’en appeler de la peine et a rejeté l’appel.
