CORAM: The Chief Justice and L'Heureux‑Dubé, Gonthier, Iacobucci, Major, Bastarache, Binnie, Arbour and LeBel JJ.
The appeal is dismissed with costs, McLachlin C.J. and L'Heureux-Dubé and Binnie JJ. dissenting. The constitutional questions are answered as follows:
1. Does s. 16(4)(c) of the Public Service Employment Act, R.S.C. 1985, c. P‑33, on its own or in its effect, discriminate against persons on the basis of citizenship by providing a preference to Canadian citizens over non‑citizens in open competitions in the federal public service, contrary to s. 15(1) of the Canadian Charter of Rights and Freedoms?
Answer Yes. Arbour and LeBel JJ. would answer in the negative.
2. If the answer to question one is yes, is the discrimination a reasonable limit prescribed by law which can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Answer Yes. McLachlin C.J. and L’Heureux-Dubé and Binnie JJ. would answer in the negative. Arbour and LeBel JJ. would find it unnecessary to answer the question.
L’appel est rejeté avec dépens, le juge en chef McLachlin et les juges L’Heureux-Dubé et Binnie sont dissidents. Les questions constitutionnelles reçoivent les réponses suivantes:
1. L’alinéa 16(4)(c) de la Loi sur l’emploi dans la fonction publique, L.R.C. 1985, ch. P-33, établit-il, en soi ou dans son application, une discrimination fondée sur la citoyenneté en accordant une préférence aux citoyens canadiens par rapport aux non-citoyens canadiens dans le cadre d’un concours public au sein de la fonction publique fédérale, en contravention du par. 15(1) de la Charte canadienne des droits et libertés?
Réponse: Oui. Les juges Arbour et LeBel répondent par la négative.
2. Si la réponse à la première question est affirmative, cette discrimination constitue-t-elle une limite raisonnable prescrite par une règle de droit, dont la justification peut se démontrer dans le cadre d’une société libre et démocratique conformément à l’article premier de la Charte canadienne des droits et libertés?
Réponse: Oui. Le juge en chef McLachlin et les juges L’Heureux-Dubé et Binnie répondent par la négative. Les juges Arbour et LeBel estiment inutile de répondre à la question.
