Criminal law - Procedural law - Indictments - Direct indictments - Whether the Attorney General can prefer a direct indictment against an accused for offences for which the accused has already been committed for trial after a preliminary inquiry.
The Respondent was originally charged with one count of murder and one count of kidnapping. A co-accused, Bhatti, was jointly charged with one count of kidnapping and manslaughter of the same victim. Counsel for Bhatti was not able to appear at the preliminary inquiry so the proceedings against Bhatti were adjourned, and the Crown proceeded against the Respondent, who was committed for trial. The Attorney General then preferred a direct indictment against both accused so that they could be tried together. The new indictment alleged the same offences as those on which the Respondent was committed for trial.
Counsel for the Respondent wished to apply to quash the committal of the Respondent, but the direct indictment caused the committal for trial to be moot. Accordingly, he applied for certiorari to quash the direct indictment. This application was dismissed by the Supreme Court of British Columbia. He appealed this decision to the Court of Appeal. The appeal was allowed and the direct indictment quashed.

Droit criminel - Procédure - Actes d’accusation - Mise en accusation directe - Le procureur général peut‑il présenter un acte d’accusation contre un accusé pour des infractions à l’égard desquelles il a déjà été renvoyé à procès après l’enquête préliminaire?
L’intimé a initialement été accusé de meurtre et d’enlèvement. Un coaccusé, Bhatti, a été inculpé conjointement d’enlèvement de la victime et d’homicide involontaire coupable à l’égard de celle‑ci. L’avocat de Bhatti n’a pas pu comparaître à l’enquête préliminaire, de sorte que la procédure contre Bhatti a été ajournée, et la procédure a été poursuivie contre l’intimé, qui a été renvoyé à procès. Le procureur général a alors présenté un acte d’accusation contre les deux accusés pour qu’ils puissent être jugés ensemble. Le nouvel acte d’accusation alléguait les mêmes infractions que celles à l’égard desquelles l’intimé avait été renvoyé à procès.
L’avocat de l’intimé voulait présenter une demande d’annulation du renvoi à procès de l’intimé, mais la mise en accusation directe a rendu théorique le renvoi à procès. En conséquence, il a sollicité un certiorari afin d’obtenir l’annulation de la mise en accusation directe. La Cour suprême de la Colombie‑Britannique a rejeté cette demande. L’avocat de l’intimé a interjeté appel de cette décision devant la Cour d’appel. L’appel a été accueilli et la mise en accusation directe a été annulée.
