Torts - Damages - Motor vehicle accident - Personal injury - In determining liability for and in assessing quantum of awards for tax gross-up on cost of future care and management fees, whether the Court should take into account the evidence available at the date of the assessment of the actual amount of the fund known to be available to be invested or managed.
The Respondent was a pedestrian when she was struck by a vehicle owned by the Appellant, Currie and driven by the Appellant, Kroppmanns. At trial, it was held that the Respondent was solely responsible for the accident and her action against the Appellants was dismissed. On appeal, the Respondent was found to be 55% at fault for the accident and the driver was apportioned 45% of the fault. The assessment of damages was referred back to the trial court. The Appellants were ordered to pay damages to the Respondent in the sum of $676,988.44 including tax gross-up on future care in the sum of $43,000.00 and management fees in the sum of $40,000.00. The Respondent appealed the damage award and the Court of Appeal allowed the appeal. The Respondent was granted $125,000 for tax gross-up and $90,000 for management fees.

Responsabilité civile délictuelle - Dommages‑intérêts - Accident de la route - Préjudice corporel - Lorsqu’il s’agit d’établir la somme à accorder à titre de majoration pour fins d’impôt de l’indemnité pour soins futurs et à titre d’honoraires de gestion, et de déterminer à cette fin la responsabilité, la Cour doit‑elle tenir compte de la preuve existante au moment de l’évaluation du montant du capital réel censé disponible pour le placement et la gestion?
L’intimée circulait à pied lorsqu’elle a été frappée par le véhicule appartenant à l’appelante Currie et conduit par l’appelant Kroppmanns. En première instance, on conclut qu’elle est entièrement responsable de l’accident et son action contre les appelants est rejetée. En appel, 55 p. cent de la faute lui est attribuée et 45 p. cent, au conducteur. La question de l’évaluation des dommages‑intérêts est renvoyée au tribunal de première instance. On ordonne aux appelants de verser à l’intimée 676 988,44 $ à titre de dommages‑intérêts, y compris 43 000 $ à titre de majoration pour fins d’impôt de l’indemnité pour soins futurs et 40 000 $ à titre d’honoraires de gestion. L’intimée interjette appel avec succès du jugement en dommages‑intérêts. Elle obtient 125 000 $ à titre de majoration de l’indemnité pour fins d’impôt et 90 000 $ pour les honoraires de gestion.
