Coram: McLachlin C.J. and Gonthier, Major, Bastarache, Binnie, Arbour and LeBel JJ.
The appeal from the judgment of the Court of Appeal for Ontario, Numbers C35254 and C35835, dated March 13, 2002, heard on April 10, 2003 is allowed without costs. The Court would not disturb any order as to costs awarded in the courts below.
The constitutional questions are answered as follows:
1. Is s. 5.1(4) of the Department of Veterans Affairs Act, R.S.C. 1985, c. V-1, as amended, inconsistent with s. 1(a) of the Canadian Bill of Rights, S.C. 1960, c. 44?
Answer: No.
2. Is s. 5.1(4) of the Department of Veterans Affairs Act, R.S.C. 1985, c. V-1, as amended, inconsistent with s. 2(e) of the Canadian Bill of Rights, S.C. 1960, c. 44?
Answer: No.
3. If the answer to question 1 or 2 is in the affirmative, is s. 5.1(4) of the Department of Veterans Affairs Act, R.S.C. 1985, c. V-1, as amended, inoperable by reason of such inconsistency?
Answer: It is unnecessary to answer this question.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéros C35254 et C35835, en date du 13 mars 2002, entendu le 10 avril 2003 est accueilli sans dépens. Il n’y a pas lieu de modifier l’adjudication des dépens dans les instances inférieures.
Les questions constitutionnelles reçoivent les réponses suivantes :
1. Le paragraphe 5.1(4) de la Loi sur le ministère des Anciens combattants, L.R.C. 1985, ch. V-1, modifiée, est-il incompatible avec l’al. 1a) de la Déclaration canadienne des droits, S.C. 1960, ch. 44?
Réponse : Non.
2. Le paragraphe 5.1(4) de la Loi sur le ministère des Anciens combattants, L.R.C. 1985, ch. V-1, modifiée, est-il incompatible avec l’al. 2e) de la Déclaration canadienne des droits, S.C. 1960, ch. 44?
Réponse : Non.
3. Si la réponse aux questions 1 ou 2 est affirmative, le par. 5.1(4) de la Loi sur le ministère des Anciens combattants, L.R.C. 1985, ch. V-1, modifiée, est-il inopérant en raison de cette incompatibilité?
Réponse : Il n’est pas nécessaire de répondre à cette question.

The appeal from the judgment of the Court of Appeal for Ontario, Number C35074, dated May 22, 2001, heard on December 12, 2002 is allowed with costs throughout, and the respondent’s application is dismissed, Major, Bastarache and Deschamps JJ. dissenting.
The constitutional question is answered as follows:
Q. Is section 275 of the Insurance Act, R.S.O. 1990, c. I.8, as amended, constitutionally inapplicable to the appellant because its application in the circumstances of this case would not accord with territorial limits on provincial jurisdiction?
A. Yes. Major, Bastarache and Deschamps JJ. would answer no.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C35074, en date du 22 mai 2001, entendu le 12 décembre 2002 est accueilli avec dépens dans toutes les cours, et la demande de l’intimée est rejetée. Les juges Major, Bastarache et Deschamps sont dissidents.
La question constitutionnelle reçoit la réponse suivante :
Q. L’article 275 de la Loi sur les assurances, L.R.O. 1990, ch. I.8 et ses modifications, est-il constitutionnellement inapplicable à l’appelante pour le motif que, dans les circonstances de la présente affaire, son application ne serait pas conforme aux limites territoriales de la compétence provinciale?
R. Oui. Les juges Major, Bastarache et Deschamps répondraient non.
