Canadian Charter - Criminal - DNA - Search and Seizure - Warrants to seize DNA samples - Seizure of a blood sample to conduct a DNA analysis under ss. 487.04 to 487.09 of the Criminal Code - Whether sections 487.05 to 487.09 of the Criminal Code, R.S.C. 1985, c. C‑46 (as they read in January 1997) infringe sections 7 or 8 of the Canadian Charter of Rights and Freedoms - If so, is the infringement a reasonable limit which can be demonstrably justified under section 1? - Whether trial judge erred by placing weight on the opinion of the expert.
A 14 year old complainant alleged that she became pregnant as a result of a sexual assault by the Appellant. She had an abortion and the police seized the fetal tissue for DNA testing. Pursuant to an ex parte warrant authorizing the seizure of a blood sample from the Appellant issued under ss. 487.04 to 487.09 of the Criminal Code, R.S.C. 1985, c. C‑46, the police seized a blood sample from the Appellant and conducted a DNA analysis. The Appellant was arrested and charged with sexual assault. At trial, the Appellant sought a declaration that the DNA warrant provisions in ss. 487.04 to 487.09 violate ss. 7 and 8 of the Charter. To save time, counsel agreed to enter evidence relating to DNA science from a previous trial of another individual, R. v. Brighteyes (1997), 199 A.R. 161 (Q.B.). Brighteyes had been argued before the same trial judge on behalf of the accused in that case by the same counsel as represents the Appellant in these proceedings. A voir dire in Brighteyes had raised the same constitutional challenge to ss. 487.04 to 487.09. Evidence and exhibits from Brighteyes were incorporated into the proceedings below and, relying on his previous decision in Brighteyes, the trial judge found that ss. 487.04 to 487.09 violate s. 7 of the Charter but not s. 8, but that the provisions were saved under s. 1 of the Charter. The trial judge convicted the Appellant based on the complainant’s testimony, circumstantial evidence and the DNA evidence.
The Appellant appealed and argued that the provisions breached s. 8 as well as s. 7 of the Charter and that the opinion evidence of the DNA expert lacked a factual foundation. The Court of Appeal also reviewed s. 7 of the Charter. The majority of the Court of Appeal dismissed the appeal. Berger J.A. dissented with respect to s. 7 of the Charter and the opinion evidence. The Appellant filed a notice of appeal as of right to this Court on the s. 7 Charter issue and leave was granted to raise the s. 8 Charter issue.

C‑46 (en vigueur en janvier 1997) violent-ils l’art. 7 ou l’art. 8 de la Charte canadienne des droits et libertés? - Dans l’affirmative, la violation est-elle une limite raisonnable dont la justification peut se démontrer au sens de l’article premier? - Le juge du procès a-t-il commis une erreur en accordant de l’importance à l’opinion de l’expert?
Une plaignante âgée de 14 ans a allégué être tombée enceinte après avoir été victime d’une agression sexuelle par l’appelant. Elle s’est fait avorter et la police a saisi le tissu foetal pour fins d’analyse génétique. Conformément à un mandat ex parte décerné en application des art. 487.04 à 487.09 du Code criminel, L.R.C. 1985, ch. C‑46, et autorisant la saisie d’un échantillon de sang de l’appelant, la police a saisi un échantillon de sang de l’appelant et a effectué une analyse génétique. L’appelant a été arrêté et accusé d’agression sexuelle. Au procès, l’appelant a demandé à la cour de déclarer que les dispositions relatives au mandat pour fins d’analyse génétique, contenues aux art. 487.04 à 487.09,violent les art. 7 et 8 de la Charte. Pour économiser du temps, les avocats ont convenu de déposer une preuve concernant la science génétique, déposée dans le cadre du procès antérieur d’un autre individu (R. c. Brighteyes (1997), 199 A.R. 161 (B.R.)). Dans l’affaire Brighteyes, l’avocat qui représente l’appelant en l’espèce avait défendu l’accusé devant le même juge du procès que dans la présente affaire. Le voir-dire tenu dans l’affaire Brighteyes avait donné lieu à la même contestation de la constitutionnalité des art. 487.04 à 487.09. La preuve et les pièces produites dans l’affaire Brighteyes ont été intégrées dans les procédures des instances inférieures et, se fondant sur sa décision antérieure dans l’affaire Brighteyes, le juge du procès a conclu que les art. 487.04 à 487.09 violent l’art. 7, mais non l’art. 8, de la Charte, ajoutant cependant que ces dispositions sont sauvegardées en vertu de l’article premier de la Charte. Le juge du procès a conclu à la culpabilité de l’appelant sur la foi du témoignage de la plaignante, d’une preuve circonstancielle et de la preuve génétique.
L’appelant a interjeté appel en faisant valoir que les dispositions en cause violaient à la fois l’art. 8 et l’art. 7 de la Charte et que la preuve constituée de l’opinion de l’expert en matière d’ADN était dénuée de fondement factuel. La Cour d’appel a également examiné l’art. 7 de la Charte. La Cour d’appel à la majorité a rejeté l’appel. Le juge Berger était dissident quant à l’art. 7 de la Charte et à l’opinion soumise en preuve. L’appelant a déposé devant notre Cour un avis d’appel de plein droit relativement à la question de l’art. 7 de la Charte, et il a obtenu l’autorisation de soulever la question de l’art. 8 de la Charte.
