The appeal from the judgment of the Court of Appeal for Ontario, Number C36517, dated June 17, 2002, heard on October 16, 2003 is allowed, the order of the Court of Appeal is set aside and the order of Cullity J. is restored, with costs to the appellant in this Court and in the Court of Appeal, Bastarache, Deschamps and Fish JJ. dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C36517, en date du 17 juin 2002, entendu le 16 octobre 2003 est accueilli, l’ordonnance de la Cour d’appel est annulée et celle du juge Cullity est rétablie, avec dépens en faveur de l’appelante devant notre Cour et la Cour d’appel. Les juges Bastarache, Deschamps et Fish sont dissidents.
