Canadian Charter of Rights and Freedoms - Criminal law - Accused unfit to stand trial - Constitutionality of s. 672.54 of Criminal Code concerning accused persons found unfit to stand trial - Whether s. 672.54 of Criminal Code unconstitutional on ground that it infringes rights and freedoms guaranteed by ss. 7, 11b) and 15(1) of Charter - Whether Appellant entitled to stay of proceedings as remedy under s. 24(1) of Charter, on ground of infringement of his rights guaranteed by ss. 7 and 11(b) of Charter.
In January 1997, the Appellant was charged with sexual assault of a seven-year old boy. Having been diagnosed by a psychiatrist as suffering from a moderate intellectual impairment caused by Down’s Syndrome, the Appellant was found unfit to stand trial. The Appellant was detained at the Robert Giffard Hospital while waiting for a decision of the Review Board under s. 672.47 of the Criminal Code. On May 5, 1997, the Review Board conditionally discharged the Appellant under s. 672.54 of the Criminal Code. Every year since, the Board has issued a similar decision.
The Appellant asked the Quebec Superior Court for a stay of proceedings as a remedy for the alleged infringement of his rights under ss. 7, 11(b) and 15(1) of the Charter and challenged the constitutionality of s. 672.54 of the Criminal Code. The Quebec Superior Court dismissed the Appellant’s motion for a stay and declared s. 672.54 of the Criminal Code to be constitutional.

Charte canadienne des droits et libertés - Droit criminel - Accusé inapte à subir un procès - Constitutionnalité de l’article 672.54 du Code criminel en ce qui a trait aux accusés inaptes à subir leurs procès - L’article 672.54 du Code criminel est-il inconstitutionnel au motif qu’il viole des droits et libertés garantis par les articles 7, 11b) et 15(1) de la Charte ? - L’appelant a-t-il droit à un arrêt des procédures à titre de réparation en vertu du paragraphe 24(1) de la Charte, en raison d’une atteinte portée à ses droits garantis par les articles 7 et 11b) de la Charte ?
En janvier 1997, l’appelant fut accusé de l’agression sexuelle d’un garçon de 7 ans. Un verdict d’inaptitude à subir un procès fut rendu à la suite de l’évaluation de son état mental par un psychiatre, qui a diagnostiqué une déficience intellectuelle modérée causée par le trisomie 21. L’appelant fut détenu au Centre hospitalier Robert Giffard dans l’attente d’une décision de la part de la Commission d’examen en application de l’article 672.47 du Code criminel. Le 5 mai 1997, la Commission d’examen a remis l’appelant en liberté sous réserve des modalités prévues à l’article 672.54 du Code criminel. Chaque année depuis, la Commission a rendu une décision similaire.
L’appelant a demandé à la Cour supérieure du Québec l’arrêt des procédures à titre de réparation pour la prétendue violation de ses droits en vertu des articles 7, 11b) et 15(1) de la Charte et il a contesté la constitutionnalité de l’article 672.54 du Code criminel. La Cour supérieure du Québec a rejeté la requête de l’appelant et déclaré l’article 672.54 du Code criminel constitutionnel.
