The appeal from the judgment of the Court of Appeal for Ontario, Number C38335, dated November 1, 2004, heard on June 9, 2005, is allowed. The decision of the Court of Appeal is set aside and the conviction is restored. The case is remitted to the Court of Appeal to deal with the respondent’s appeal with respect to sentence.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C38335, en date du 1er novembre 2004, entendu le 9 juin 2005, est accueilli. L’arrêt de la Cour d’appel est annulé et la déclaration de culpabilité est rétablie. L’affaire est renvoyée à la Cour d’appel pour qu’elle se prononce sur l’appel interjeté par l’intimé relativement à la peine.

L’appel interjeté contre l’arrêt de la Cour d’appel du Québec (Montréal), numéro 500‑10‑002226‑015, en date du 2 février 2004, entendu le 10 mai 2005 est accueilli. L’arrêt de la Cour d’appel et le jugement de la Cour supérieure sont infirmés et le jugement de la Cour municipale déclarant l’intimé coupable d’avoir conduit avec un taux d’alcool supérieur à la limite permise est rétabli. Les juges Binnie, LeBel, Fish et Charron sont dissidents en partie.
The appeal from the judgment of the Court of Appeal of Quebec (Montreal), Number 500‑10‑002226‑015, dated February 2, 2004, heard on May 10, 2005 is allowed. The decision of the Court of Appeal and the judgment of the Superior Court are set aside and the judgment of the Municipal Court convicting the respondent of driving with a blood alcohol level over the permitted limit is restored. Binnie, LeBel, Fish and Charron JJ. are dissenting in part.

L’appel interjeté contre l’arrêt de la Cour d’appel du Québec (Montréal), numéro 500‑09‑011829‑025, en date du 27 janvier 2004, entendu le 10 mars 2005, est accueilli avec dépens devant toutes les cours. Les jugements de la Cour d’appel et de la Cour supérieure sont infirmés. Le dossier est renvoyé à la Cour supérieure pour qu’elle détermine le mode de réclamation, les montants dus et les modalités de paiement. La juge Deschamps est dissidente.
The appeal from the judgment of the Court of Appeal of Quebec (Montréal), Number 500‑09‑011829‑025, dated January 27, 2004, heard on March 10, 2005, is allowed with costs throughout. The judgments of the Court of Appeal and the Superior Court are set aside. The case is remanded to the Superior Court to determine the method for making claims, the amounts owed and the payment procedures. Deschamps J. is dissenting.
