The appeal from the judgment of the Court of Appeal of Manitoba, Number AR 02‑30‑05168, dated March 31, 2003, heard on October 12, 2004, is dismissed and the order for a new trial is confirmed. The constitutional questions are answered as follows:
1. Do ss. 76.1(1), 263.1 and 265 of The Highway Traffic Act, S.M. 1985‑86, c. 3 (H60), as amended, to the extent that they authorize a peace officer to administer physical sobriety tests to the driver of a motor vehicle, infringe s. 10(b) of the Canadian Charter of Rights and Freedoms?
Yes.
2. If the answer to question 1 is in the affirmative, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Yes. LeBel and Fish JJ. would answer no.
3. Do the common law powers of a police officer, to the extent that those powers authorize the police officer to administer physical sobriety tests to the driver of a motor vehicle, infringe s. 10(b) of the Canadian Charter of Rights and Freedoms?
It is not necessary to answer this question.
4. If the answer to question 3 is in the affirmative, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
It is not necessary to answer this question.
L’appel interjeté contre l’arrêt de la Cour d’appel du Manitoba, numéro AR 02‑30‑05168, en date du 31 mars 2003, entendu le 12 octobre 2004, est rejeté et l’ordonnance d’un nouveau procès est confirmée. Les questions constitutionnelles reçoivent les réponses suivantes :
1. Dans la mesure où ils autorisent un agent de la paix à faire subir des tests de sobriété au conducteur d’un véhicule automobile, le par. 76.1(1) et les art. 263.1 et 265 du Code de la route, L.M. 1985‑86, c. 3 (H60), modifié, portent‑ils atteinte à l’al. 10b) de la Charte canadienne des droits et libertés?
Oui.
2. Dans l’affirmative, l’atteinte est‑elle une limite raisonnable prescrite par une règle de droit, dont la justification puisse se démontrer dans le cadre d’une société libre et démocratique conformément à l’article premier de la Charte canadienne des droits et libertés?

The appeal from the judgment of the Court of Appeal of Manitoba, Number AR 02‑30‑05277, dated May 30, 2003, heard on October 12, 2004, is allowed and the order for a new trial is confirmed, with costs of the appeal to the respondent on a solicitor-client basis, LeBel and Fish JJ. dissenting. The respondent’s request for leave to cross-appeal is denied. The constitutional questions are answered as follows:
1. Does s. 76.1(1) of The Highway Traffic Act, S.M. 1985‑86, c. 3 (H60), as amended, to the extent that it authorizes a peace officer to question the driver of a motor vehicle about his or her prior alcohol consumption, infringe s. 10(b) of the Canadian Charter of Rights and Freedoms?
Yes.
2. If the answer to question 1 is in the affirmative, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?

Les juges LeBel et Fish sont dissidents. La demande de l’intimé d’interjeter un pourvoi incident est rejetée. Les questions constitutionnelles reçoivent les réponses suivantes :
1. L’appel interjeté contre l’arrêt de la Cour d’appel de Terre‑Neuve et Labrador, numéro 01/118, en date du 30 avril 2003, entendu le 7 décembre 2004, est accueilli en ce qui concerne la question de la préclusion, la décision de la Cour d’appel relativement aux autres questions est confirmée et la déclaration est radiée, avec dépens en faveur des appelants dans toutes les cours.
