Criminal Law - (Non Charter) - Sentencing - Young Offenders - Youth Criminal Justice Act - Whether courts erred in interpretation of “violent offence” in section 39(1)(a) of the Youth Criminal Justice Act or in interpretation of the sentencing principles in the Youth Criminal Justice Act - Whether accused’s sentence was erroneously based on facts neither proven nor admitted.
The Court of Appeal set out the following facts. The Appellant pleaded guilty to three separate offences: possession of a weapon for purposes dangerous to the public peace; arson; and, breach of an undertaking. The weapons offence arose when he approached another youth during an argument with a metal table leg held above his head. The arson offence occurred while he was on release for the weapons charge. The Appellant and an adult offender poured gasoline into a truck and the adult offender set the truck on fire, at the request of the truck’s owner who sought to collect $25,000 from his insurer. The breach of an undertaking arose when the Appellant was found in the company of a person he was ordered to have no contact with as a condition of his release on the weapons charge. The Appellant was sixteen and seventeen years old at the time of the offences. For all three offences, he was sentenced to six months deferred custody with mandatory terms, nine months probation, and a prohibition against use of alcohol and non-prescribed drugs. In separate sentencing proceedings, the adults were given conditional sentences of nine and twelve months. The Appellant appealed from his sentence. Before judgment was rendered in his appeal, he breached the conditions of his deferred custody order and he was placed in an open custody facility until the Crown agreed to his release on bail. The Court of Appeal upheld the sentence.

La Cour d’appel a exposé les faits suivants. L’appelant a plaidé coupable relativement à trois infractions distinctes : possession d’une arme dans un dessein dangereux pour la paix publique; incendie criminel; manquement à un engagement. L’infraction touchant la possession d’une arme a été perpétrée lorsqu’il s’est approché d’un autre jeune pendant une dispute en brandissant au-dessus de sa tête un pied de table en métal. Il a commis l’infraction d’incendie pendant qu’il bénéficiait d’une libération après avoir été accusé de possession d’une arme. L’appelant et un délinquant adulte ont répandu de l’essence dans un camion et le délinquant adulte a mis le feu au camion à la demande du propriétaire de celui-ci, qui a tenté d’obtenir une indemnité d’assurance de 25 000 $. Quant au manquement à un engagement, l’appelant a été trouvé en compagnie d’une personne avec laquelle il ne pouvait avoir aucun contact sans enfreindre les conditions de sa mise en liberté relative à l’accusation de possession d’une arme. L’appelant était âgé de seize et de dix-sept ans au moment des infractions. Pour les trois infractions, il a été condamné à une peine de six mois de placement différé assortie des conditions obligatoires, d’une période de probation de neuf mois et de l’interdiction de consommer de l’alcool et des drogues. Dans des procédures distinctes de détermination de la peine, les adultes ont été condamnés à des peines de neuf et douze mois d’emprisonnement avec sursis. L’appelant a interjeté appel de la peine à laquelle il avait été condamné. Avant que jugement soit rendu sur l’appel, il a enfreint les conditions de son ordonnance de placement différé et a été placé sous garde en milieu ouvert jusqu’à ce que le ministère public consente à sa remise en liberté sous caution. La Cour d’appel a confirmé la peine.

The Court of Appeal set out the following facts. The Appellant stole a vehicle and became involved in a high speed police chase in Edmonton. He ran two red lights and one stop sign. He drove at speeds up to 120 km/h in 60 km/h zones. After more than thirty minutes of pursuit, a spike belt deflated all four tires of the stolen vehicle and the vehicle collided with a fence. The Appellant pleaded guilty to charges of dangerous driving and possession of stolen property. A pre‑sentence report recommended closed custody followed by probation. The sentencing judge imposed six months of deferred custody subject to the mandatory conditions and one year of probation. Two weeks after sentencing, the Appellant was found in possession of a concealed weapon. He was returned to custody but released on bail pending the appeal below. At the time of his appeal from sentence, he appeared to be observing the terms of his bail. The Court of Appeal applied C.D. v. Her Majesty the Queen, 2004 ABCA 14, (SCC File No. 30254) and held that the Appellant’s acts constituted a violent offence such that the trial judge could order deferred custody. The Court of Appeal deferred the issue of the appropriateness of the Appellant’s sentence.

La Cour d’appel a exposé les faits suivants. L’appelant a volé un véhicule et a provoqué une poursuite policière à haute vitesse dans les rues d’Edmonton. Il a brûlé deux feux rouges et un arrêt obligatoire. Il a roulé à des vitesses atteignant 120 km/h dans des zones de 60 km /h. Après une poursuite de plus de 30 minutes, les quatre pneus du véhicule volé ont crevé au contact d’une bande cloutée et le véhicule a heurté une clôture. L’appelant a plaidé coupable à des accusations de conduite dangereuse et de possession d’un bien volé. Un rapport présentenciel a recommandé sa mise sous garde en milieu fermé, suivie d’une probation. L’appelant a été condamné à une peine de six mois de placement différé assortie des conditions obligatoires et d’un an de probation. Deux semaines après le prononcé de la peine, l’appelant a été trouvé en possession d’une arme dissimulée. Il a été renvoyé sous garde, mais libéré sous caution jusqu’à ce que son appel soit entendu. Au moment de l’audition de son appel relatif à la peine, il semblait se conformer aux conditions de sa mise en liberté. La Cour d’appel a appliqué l’arrêt C.D. c. Sa Majesté la Reine, 2004 ABCA 14 (No du greffe CSC : 30254), et conclu que les actes de l’appelant constituaient une infraction avec violence et que la juge du procès pouvait de ce fait ordonner le placement différé. La Cour d’appel a reporté l’examen du caractère approprié de la peine infligée à l’appelant.
