L’appel interjeté contre l’arrêt de la Cour d’appel du Québec (Québec), numéro 200‑09‑003505‑010, en date du 9 décembre 2003, entendu le 16 février 2005 est accueilli avec dépens devant toutes les cours. L’arrêt de la Cour d’appel et le jugement de la Cour supérieure sont infirmés et la requête de l’appelante demandant d’annuler la décision arbitrale est accordée. La Juge en chef et les juges LeBel et Fish sont dissidents.
The appeal from the judgment of the Court of Appeal of Quebec (Quebec), Number 200‑09‑003505‑010, dated December 9, 2003, heard on February 16, 2005 is allowed with costs throughout. The judgments of the Court of Appeal and of the Superior Court are set aside and the appellant’s motion to quash the arbitration decision is granted. The Chief Justice and LeBel and Fish JJ. are dissenting.

L’appel interjeté contre l’arrêt de la Cour d’appel de Terre‑Neuve-et-Labrador, numéros 03/101 et 03/119, 2004 NLCA 60, en date du 12 octobre 2004, entendu le 20 octobre 2005, est accueilli et le jugement de première instance est rétabli, avec dépens partie-partie en faveur de l’appelante devant notre Cour et devant les tribunaux d’instance inférieure.
