The appeal from the judgment of the Court of Appeal for Ontario, Number C42100, dated January 14, 2005, heard on April 18, 2006 is allowed. The decisions of the Ontario courts allowing disclosure of the entire private record to the requester’s counsel are quashed. The matter should be remitted to the Divisional Court for redetermination in accordance with the reasons for judgment.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C42100, en date du 14 janvier 2005, entendu le 18 avril 2006 est accueilli. Les décisions des cours ontariennes autorisant la divulgation de l’ensemble du dossier privé à l’avocate de l’auteure de la demande sont annulées. L’affaire doit être renvoyée à la Cour divisionnaire pour qu’elle rende une nouvelle décision conformément aux motifs de jugement.
