The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA32104, 2005 BCCA 94, dated February 18, 2005, heard on April 19, 2006, is dismissed, with the parties to bear their own costs.  Binnie and Fish JJ. are dissenting.

 

L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA32104, 2005 BCCA 94, en date du 18 février 2005, entendu le 19 avril 2006, est rejeté, les parties devant supporter leurs propres frais.  Les juges Binnie et Fish sont dissidents.
